The use of generative AI models, such as Midjourney, raises new and untested copyright issues. The World Intellectual Property Organization (WIPO) has identified numerous issues relating to copyright and AI, which warrant discussion. This article addresses a few of the issues in respect of establishing copyright protection in the UK for AI-generated works under section 9.3 of the Copyright, Designs and Patents Act.

Video games often include real-life 3D objects, particularly if the game is to be realistic. The trouble with real-life objects is that they may be protected by various intellectual property rights. Unless the right holder has consented to the real-life object being used in the game, the game’s developer or publisher risk infringing IP. The article discusses reported cases from the US and EU regarding in-game use of 3D objects.
This is accompanied by significant growth in business-to-business (B2B) disputes between life sciences companies including, for instance, those concerning failed joint ventures for new drugs or unauthorised use of third-party intellectual property (IP) rights. The panel will discuss the unique features of the life sciences industry and how the disputes can be avoided or resolved through mediation, litigation and arbitration.

This article explores the complex interplay between compulsory licensing and patent evergreening within the pharmaceutical sector. It examines the implications of these two tools on innovation, public health, and market competition across various jurisdictions. While a compulsory licence is supposed to safeguard public interest at large by allowing a third party to use a patented invention for the public good, evergreening allows organisations to extend their patent protection beyond the original 20-year term by making incremental changes to their original innovation. Consequently, when employed judiciously, these approaches can help maintain a healthy balance between a country’s public welfare and its financial ecosystem. This article therefore looks at some interesting perspectives on the outlook of different countries on these provisions.
This panel will discuss identifying IP assets, verifying ownership of the IP assets, assessing how coverage of the IP assets aligns with a company's business goals, and identifying third-party IP risks.

Telemedicine has become more important in Germany since the Covid-19 pandemic. Such services include video consultations, teleconsultations and remote monitoring. Although telemedicine is generally permitted, it is subject to strict legal requirements, particularly in the context of statutory health insurance. Professional regulations, advertising law and data protection regulations set clear obligations in this context. Cross-border treatment, liability and reimbursement are also important legal aspects. The current laws, such as the Digital Healthcare Act and EU regulations, support digital healthcare services. However, clearer framework conditions are still required to ensure legally compliant and efficient implementation of such services, particularly with regard to artificial intelligence (AI)-driven tools, which offer new opportunities, but also raise legal uncertainties.
The discussion will include the weight of the TRIPS waiver expansion and WHO pandemic treaty and the central role USTR have in determining IP policies which could have influence in the public and private sectors.
The mRNA space, especially in the context of the global rollout of the vaccines, also intersects with ongoing global IP policy issues. In many ways, pandemic, also demonstrated how innovators and governments were able to make progress together to improve global health.

This article aims to provide a preliminary outline of the major venture capital (VC) trends in the life sciences sector targeting Italian biotech companies, mainly operating in certain specific sub-segments, as a result of it being ascertained that the Italian life sciences market ranked as one of the most funded industries by VC in 2024. The article focuses on the importance of intellectual property (IP) assets in VC life science deals, through a discussion of how IP generally qualify as a ‘deal maker’ or ‘deal breaker’, capable of having a significative impacts on all the phases of VC deals: (1) related to the due diligence process and regardless of whether the biotech is the IP owner or uses such IP in the context of a licence agreement; (2) taking into account specific peculiarities of the Italian legal framework, such as the reform of the so-called abolition of the professor’s privilege; and (iii) with a focus on the contractual structure of VC deals, by pointing out some of the most common closing conditions and the market standards in terms of the release of IP representations and warranties.

The panel discussed the role of transfer pricing (TP) in the post-Pillar Two tax world, focusing in particular on the potential impact of the Organisation for Economic Co-operation and Development’s Pillar Two rules on TP (section 1); recent developments at European Union level involving the proposed EU Directive on Transfer Pricing (commonly known as the ‘TP Directive’), recent intellectual property fact patterns (section 3) and the current trends in intercompany financing (section 4).
