This panel on decentralised finance discussed how blockchain-based finance works and how it may be treated for tax purposes for individuals in the respective jurisdictions of the panellists. The discussion focused on explaining how typical transactions work and possible interpretations of how such transactions could be treated for tax purposes in the case of individuals only.

A recent English High Court decision concerning a non-fungible token (NFT) auction has brought into focus the use of arbitration agreements in crypto disputes. It is a caution to crypto and NFT holders worldwide, who may find themselves bound to arbitrate their disputes with crypto exchanges and NFT marketplaces in a foreign jurisdiction and applying a foreign law.
By their nature, international arbitrations involve lawyers, clients and others from multiple jurisdictions where ethical and the way in which lawyers practice can vary widely. This panel considers the impact of these differences from the perspective of both counsel and arbitrators in seeking to acknowledge how these differences can be highlighted to more efficiently resolve disputes.

The tightening of sanctions, increasing pressure on traditional payment systems and the concurrent advancement of digital financial technologies are reshaping the rules of the game for cross-border trade between Russia and Brazil. Since August 2023, Russia has been piloting the Digital Ruble, and since late 2024 it has been implementing pilot programmes for cross-border settlements using cryptocurrencies and digital assets. In Brazil, the first federal regulations on virtual assets have taken effect, while the Brazilian Central Bank continues to introduce a phased regulatory framework and integrate cryptocurrencies into the formal financial system.
From global law firms to local practices, differences in a lawyer's ethical obligations and the cultural underpinnings of those obligations impact the way in which ethical obligations in law practices are implemented. This panel considers the complexities of adhering to ethical obligations within and across jurisdictions, and discusses strategies to assist in lawyers fulfilling their ethical obligations.

The advent of the ‘crypto winter’ in early 2022, which saw cryptoasset values decline sharply and major crypto businesses fall into bankruptcy, has prompted an increase in disputes related to cryptoassets and associated businesses. A notable consequence of this trend is that national courts and arbitral tribunals will face a wave of complex and novel valuation issues over the coming months and years, including in the context of quantifying damages for highly volatile cryptoassets. This article aims to identify valuation challenges in the fast-developing area of business, law and practice that surrounds crypto disputes before making practical suggestions to help parties and their counsel successfully navigate these challenges.

In this session at the IBA Annual Conference in Paris, a group of experts from various backgrounds addressed topics such as doping, bribery, governance and social responsibility, and offered a comprehensive examination of the complex issues plaguing the world of sport.
In this session, we will focus on:
• Law firms’ decision and the behind the scenes decision-making process about whether to speak out or stay silent in such situations and why;
• Dentons’ (and maybe also other firms’) reaction wherein they have originally made a post on LinkedIn about the terror attacks and when an associate from the firm has criticised it, they have removed it;
• big law firms’ open letter asking law school deans to respond to antisemitism in campus protests; and
• rescission of contracts/revocation of offers by Winston & Strawn, Davis Polk, etc, for inflammatory comments in regards to the terror attacks and the current situation is Israel.

This session will examine attitudes to plagiarism amongst students and junior lawyers, and the challenges it represents to the profession. Many students now see "copy and paste" as a legitimate means of preparing assessments, and this can bleed into their approach to practise as lawyers. While such an approach may be efficient, if done excessively and without proper attribution, it represents an academic offence of plagiarism. In a practice context, it represents unethical practice and potentially significant breach of copyright. It also demonstrates a lack of the ability to articulate ideas and themes in the lawyer’s own words, basic communications skills needed at all professional levels. How should law firms and universities deal with this worrying new mindset and potentially unethical practice - do we need to be more accepting of such new approaches and, if not, how can we effectively control this rapidly escalating problem?
