10th World Women Lawyers' Conference: Driving Change
The International Franchising Committee focuses on the law and business of international franchising. Committee interests include: competition law principles, cross-border sales and licensing issues, the business forms employed and trademark and intellectual property protections required to assure franchising success.

Amid worsening restrictions on free expression and political debate in Cambodia, two people have become the first to be charged under a controversial new lèse-majesté law.
The vaguely worded law was added to Cambodia’s criminal code in February, introducing offences against the dignity of the reigning sovereign. It has been widely criticised by rights groups and legal monitors.

2nd IBA African Competition Law Conference
The European Regional Forum (ERF), established in 1989, has over 8,000 members. The forum is divided into four regions - Northern, Western, Central, and Southeastern - each led by a Chair and Vice-Chair. On 26 September 2019, 30 Rohingya Muslims were arrested in the south of Myanmar while travelling from Rakhine State to Yangon, where they planned to seek work or passage abroad. Local media reported that the 21 adults were sentenced to two years in prison with labour and the eight teenagers sent to a ‘youth training school’.
The panel members will discuss the differences in approach to the discovery and inclusion of evidence at trial considering the differing civil and common law systems operating across several jurisdictions in Asia and the obligations arising thereunder. The panel members will also discuss the implications of these different obligations in a cross border, multi-jurisdictional litigation. In a recent dispute brought before the Brazilian Superior Court of Justice (STJ – the highest Brazilian court for settling disputes concerning federal law matters), the validity of an arbitral award was challenged by one of the parties at the enforcement stage on the grounds that its counterparty had not signed the document containing the arbitration agreement. The STJ confirmed the validity of the award in its ruling.

The Irish Takeover Rules are set to be revised, following a consultation process run by the Irish Takeover Panel, the takeover regulator for Ireland. This article provides an overview of how the Irish 'put-up or shut-up' regime is to be overhauled by: (1) the introduction of a mandatory 42-day 'put-up or shut-up' deadline for all publicly identified possible bidders; and (2) a new obligation for targets to name all potential bidders when announcing a possible offer.

Protecting confidential information and enforcing restrictions not to compete, now have a number of challenges, when employees are not bound by a specific territory and can work from anywhere (WFA), thanks to the digital age. This paper was given at the 23rd Annual IBA Arbitration Day in 2022 which considered new and novel ideas for the practice of arbitration. It equates the role of a tribunal in an arbitration to that of the conductor of an orchestra, noting that it is the conductor who unifies the different sections of the orchestra to achieve harmony. By focusing on the role played by tribunals, the paper considers radical ideas to improve the services provided by arbitrators to the users of arbitration. The first innovation debated is the creation of an Arbitrator Academy to teach those necessary skills required by an arbitrator which are not typically learnt as counsel. The paper then turns to acknowledge the importance of appraisals for professionals and considers whether arbitrators would benefit from receiving appraisals and, if so, how appraisals could be given to arbitrators. The paper then considers the utility of peer-to-peer coaching and whether it would be helpful to aspiring and experienced arbitrators before finally considering the importance of cognitive diversity in tribunal deliberations.
Indian Courts often decide the outcome of a dispute in the first few days through interim orders. The main dispute can take years thanks to high ‘pendency’ or case arrears in most courts. Pendency increased with the advent of Covid-19, leading to a side-effect described as the ‘pendency pandemic’. Simultaneously, new technology-based reforms and solutions emerged as India realigned itself for virtual hearings, digitised records, online filing and even the somewhat-controlled broadcast of court proceedings. The result may yet be work-in-progress.
This panel will examine the future of Indian litigation, whether a commercial case can be fast-tracked, the risk of innocent undertrials awaiting justice and the prospects of expedited dispute resolution over the next few years. The panel will also explore solutions and advocate best practices for achieving faster adjudication.
