On 1 July 2020, new legislation in the state of Virginia, United States, will devolve decision-making on statues from state to municipal authorities, resolving a three-year dispute over the planned removal of an equestrian statue, in the city of Charlottesville. ‘Sad to see the history and culture of our great country being ripped apart with the removal of our beautiful statues and monuments,’ US President Donald Trump tweeted on 17 August 2017, amid violent protests over the statue.
IBA Maritime and Transport Law Committee Conference
On 17 June, the governing council of Oriel College, Oxford, United Kingdom, voted to remove a statue of college benefactor Cecil Rhodes, which has graced its High Street entrance for more than a century. The vote followed fierce debates, street protests, and an admonishment by the Chancellor of the University of Oxford.
While the gender gap in data is not always life threatening, the design and use of artificial intelligence models in different industries can significantly disadvantage women’s lives. And while there is agreement that lots of good data can indeed help close gender gaps, there remain concerns that if the “right” questions are not being asked in the data collection process (including by women), gender gaps can actually widen when algorithms are misinformed.

During the Black Lives Matter protests in the first week of June, a bronze statue of slave trader Edward Colston was toppled from a pedestal in Bristol, United Kingdom, dragged through the streets, and dumped in the harbour. A crowd applauded and cheered. ‘It could only have happened that way,’ said Bristol poet laureate Miles Chambers. ‘It could only have been ripped down.’ The UK Prime Minister Boris Johnson saw things differently.
However, the main part of the session will be dedicated to a live mock negotiation of FDI provisions in a European acquisition agreement.

The killing of Black American citizen George Floyd by a while police officer in late May gave fresh momentum to the Black Lives Matter movement. Subsequently, businesses of all stripes declared that racial equality would become a key feature of their employment practices.
The stresses associated with judicial service have not been widely discussed. There are various pressures: government interference, meeting performance expectations, appellate review and workload. There may be issues associated with illness, including mental illness. What happens when a judge is not coping? How should we ensure that judges do not end up leaving a career simply because problems were allowed to develop? What is best practice in ensuring judicial wellbeing?

In February, the Court of Appeal of England and Wales rejected a challenge to the country’s first unexplained wealth order (UWO). Introduced by the Criminal Finances Act 2017, UWOs can be issued when there is an obvious gap between the value of an asset – which must be worth at least £50,000 – and the income of the person who appears to own it.
A number of jurisdictions have implemented mechanisms for the review of the performance and conduct of judges. Some of these can result in removal. Very rarely, judges have been held liable for criminal conduct or civil remedies. Whilst judges should be accountable, should they serve at the whim of the executive? What is appropriate review of judicial conduct?

In April, former Minneapolis police officer Derek Chauvin was convicted of the murder and manslaughter of George Floyd, who was Black. Floyd was arrested by Chauvin and three other officers in May 2020, on suspicion of trying to use a fake $20 bill.
Judges determine issues and cases that shape our society. They need ability and skills to ensure they have correctly understood the issues in trial and justice has been done. The selection of judges under national procedures must be impartial and respectful of their independence from the state and free from influences. How should national systems ensure both quality and diversity to achieve justice for society?

Portugal has undergone a profound shift in competition enforcement in recent years, marked by more assertive public enforcement, most notably in the context of labour markets. In parallel, the emergence of class actions seeking large damages – driven by a permissive procedural regime – has placed new pressures on public enforcement, particularly leniency. While such claims risk undermining incentives to self-report, labour market cases appear less exposed to follow-on litigation, which likely explains why Portugal’s leniency regime is not as dormant as elsewhere. This article assesses these developments and considers how public and private enforcement could be better aligned going forward.
Over the last decade, the curtailment of funding for justice systems around the world has had serious consequences for the administration of justice. Many jurisdictions have witnessed a degrading in the courts estate; administrative systems have struggled to cope with demand; recruitment and retention within many areas of the justice system is adversely affected due to funding concerns; and publicly funded legal systems have been subject to repercussive cuts.
These effects compromise access to justice and diminish respect for the justice system as a whole. Rather than justice being seen as a valuable commodity worthy of investment, it is too often seen as an unwelcome cost which should be subject to imposed decline. This has concerning repercussions for both the state and its citizens, creating real impediments to the rule of law and meaningful access to justice.
The scope of legal aid systems across the world varies. As legal aid is a crucial vehicle by which the fundamental protection of human rights may be guaranteed, and the availability of legal aid is inextricably linked to access to justice, it is the responsibility of governments to guarantee that legal aid systems ensure that this protection is practical and effective, including the provision of adequate funding. This session will explore, through a number of case studies, the consequences of failing to invest in a country’s justice system and the response of the legal profession in safeguarding access to justice and the rule of law.

In 1968, after the race riots of the civil rights era tore America apart, the Kerner Commission concluded that ‘abrasive policing tactics’ only escalate violence. The 21-year-old Donald Trump instead absorbed the lesson drawn by the segregationist presidential candidate George Wallace: ‘When the looting starts, the shooting starts.’ Trump’s violent antipathy to protest goes well beyond looters.
In this session we explore how the courts intervene in arbitral hearings and awards across various jurisdictions and judicial systems and cultures. The courts in some of these jurisdictions profess minimal intervention – is that a good idea? What are the benefits associated with judicial restraint? What are the appropriate avenues for challenging arbitrations, and how do these vary across the different jurisdictions?

The rule of law depends upon an independent judiciary. Appointment to judicial office carries with it the responsibility to be, and be seen to be, independent. Why? What does that mean in practice? SustainabilityFocusRuleOfLawAt the 2021 IBA Global Showcase, Sanda Ojiambo, the CEO and Executive Director of the UN Global Compact sent a clear message to the international legal community: “We cannot deliver on the UN Sustainable Development Goals without peace, justice and strong institutions”. Although the legal profession has a role to play in the effective implementation of most, if not all, of the 17 UN SDGs, and their translation into ESG activity, UN SDG 16 covering "Peace, Justice and Strong Institutions” lies at the heart of the IBA’s mission. The business of law is not possible without the Rule of Law, which in its turn requires peace, justice and strong institutions.
This showcase session, presented by the IBA Section on Public and Professional Interest, will focus on how UN SDG #16 provides a golden thread that runs through much of the IBA’s activity. The session will be interactive and innovative, aiming to:
- pool the ideas relating to SDGs and ESGs discussed at other conference sessions held earlier in the week, and connect them to “Peace, Justice and Strong Institutions”; and
- crowdsource the core content to ensure the IBA is actively collating key work on SDGs and ESG and sharing knowledge with members and others.
By drawing directly and immediately on the activities of IBA committees, sections and regional fora, we will build up a portrait of how the legal profession is contributing to UN SDG 16.

The International Bar Association (IBA) and the International Bar Association’s Human Rights Institute (IBAHRI) condemn the police brutality that led to the death of United States citizen George Floyd, as well as the attacks against peaceful protestors and journalists by law enforcement agencies. The entities call on the US Government to address the structural inequalities and institutional racism at the root of the rolling protests following the murder of yet another unarmed Black man in police custody.
