In 2019, the Supreme Court of Canada released Canada v Vavilov. That decision reworked the legal framework governing the standard of review by courts of administrative decisions. But Vavilov has also created uncertainty about the continued applicability to domestic arbitral awards of the deferential standard of review articulated in previous (but relatively recent) Supreme Court case law. This article explores recent Canadian decisions on the standard of review in the domestic arbitral award context, and related questions about when courts will step in to review arbitral awards and the standard of review they will apply in doing so, along with other developments in Canadian arbitration law.

An employee’s gender can play a crucial role during their employment period and the entitlements arising from it. Austrian law so far has only known a binary gender (female and male) system. In 2018, the Austrian Constitutional Court ruled that a person can have different genders other than female or male. Thus, as a result of Constitutional Court case law, a third gender was introduced into the Austrian legal system. The following article discusses the effects this ruling has on current Austrian employment law related to the gender of the employee.

In response to the coronavirus pandemic, the Uruguayan government initially issued legislation and orders closing courts and staying local proceedings. Activity later resumed (around mid-May) and courts are now working in a reasonably ‘normal’ fashion in a context where the health situation in Uruguay has been under control (with a peak of approximately 300 simultaneous cases so far).

IBA Global Insight February/March 2018 - Airbnb started as a home-sharing scheme in San Francisco, but is now an international travel giant, with rumours of a lucrative IPO. Global Insight assesses its meteoric rise and whether more can and should be done – by the company and regulators – to mitigate the effects.
The panel will provide some selected IBA diversity data, which shows that IBA is already doing well in some aspects, but that there is some room for improvement in other areas. The speakers will discuss with each other as well as the audience through Q&A; various practical methods of enhancing diversity they have used within their firms or organizations, effects of using diversity data as a nudging tool to accelerate voluntary efforts for change, tips and taboos when using data especially in terms of privacy and LGBTQ right; what they expect of the IBA from now in diversity and inclusion; and which of the common D&I methods are in name only, and which of them are truly effective, such as target, quota, “comply or explain” rules, policies, training, sharing best practices, mentorship, messages from leaders, or otherwise raising awareness.
