Report on the session of the Insolvency Section of the Latin American Regional Forum at the IBA Annual Conference in Miami
With no doubt the world has accelerated a number of significant changes affecting the way employees work. Work from home, cross-border remote work, hybrid on-and-off the office arrangements, need to conciliate with personal requests, are all just examples on how the world at work has changed. These changes also affect other significant issues such as how to give proper training, how to motivate employees, how to compensate employees, and how to monitor performance. These were all aspects to be discussed as part of this session.

The changing workplace and today’s way of working brings with it some challenges and considerations for employee mental health and workplace wellbeing. While the benefits of remote and hybrid working have clearly been shown, more than four out of ten workers (44 per cent) say that their work stress has increased as a result of the pandemic, according to one Europe-wide survey. Remote and hybrid working raise issues around facilitating inclusivity and participation in the workforce, combatting isolation, a culture of always ‘being on’ and other mental health issues. During this session we will discuss the responsibilities on both sides of the employment relationship in respect of protecting and safeguarding the mental health of employees including the extent of an employer’s duty to an employee, the responsibilities an employee has, considerations around identifying mental health issues, best practice, and practical tips.

In Sweden, the Swedish Pharmaceutical Insurance enables individuals to obtain compensation for vaccine-related personal injuries. However, liability under the Insurance has recently been limited in relation to certain personal injuries caused by Covid-19 vaccines. In order to ensure an efficient and comprehensive compensation system for potential Covid-19 vaccine injuries, the Swedish Government has recently proposed a new law on state compensation.
The world has been turned upside down by Covid and other new risks. The insurance community is always directly affected by new and unexpected risks. This was demonstrated by the issues resulting from Covid and other risks that have come to the fore in the past year. This session will look at the issues in direct and reinsurance related to these emerging and emerged risks.

It is clear that the Covid-19 pandemic has produced challenges for the global community and important lessons can be learnt to ensure that the international community is better prepared to ideally avert and, if not, identify, contain, and manage pandemics and reduce associated loss of life and social and economic damage.

Two of the main challenges general counsels (GCs) have faced in 2020 are the Covid-19 pandemic and its associated economic downturn. This session looked at how these challenges have affected the role of the GC and global business as a whole, as well as how in-house legal leaders are adapting to a new climate. Due to the current circumstances and the uncertainly surrounding the coronavirus outbreak (Covid-19), the IBA has had to take the unfortunate decision to postpone the scheduled conferences listed below.
As countries emerge from the pandemic in 2022, we take stock of what Covid-19 has meant for diversity and equality and whether Covid-19 has been an unexpected diversity catalyst for positive change or has had a disproportionate impact on certain sectors and further entrenched disadvantage?
