The German arbitration community is on a quest for practical solutions that can better suit multi-party disputes in arbitration. Prominent German practitioners recently proposed the DIS Supplemental Rules for Third-Party Notices in Arbitration (“SRTPN”), which the DIS and the wider arbitration community are currently scrutinizing. The authors contribute here to the discussion by re-viewing existing practices on multi-party arbitration and the possible advantages of third-party notices, particularly for the stakeholders of the construction industry.

Family businesses often look to the next generation to run the business. But the next generation is not always prepared or qualified to take over the business. There may be multiple members of the next generation involved. Or the retiring generation needs cash from the sale of a family business in order to comfortably retire. More and more investment funds invest in family businesses to facilitate the succession. The issue of exit strategies or liquidation of the shareholding of family business has several angles. Not only the family dynamics, the interests of the investment fund who invests in view of a return on investment and the perspective of the (founding) shareholder who has long term goals need to be aligned. What are the appropriate mechanism that would cover such contradicting interests. In this session we will try to discuss standard clauses that are used in practice as well as examples of how such legal solutions reflected in particular situations in practice.

The role of the courts in arbitration: an Asia Pacific perspective

This article reviews the recent European Union regulations, namely the Digital Services Act and the Digital Markets Act which regulate digital platforms with operations in Europe, from different perspectives. Likewise, the article revises some regulatory projects in Brazil and the United States, before turning to Argentina, where the regulation of the intermediaries’ responsibility is an issue of current relevance. Due to the lack of an ex-ante regulation regarding these topics, this article goes over some of the cases treated with consumer protection regulations as well as with antitrust law and data privacy provisions.
Every insurance case inherently involves a delicate balance between the insurer’s obligation and right to investigate and verify the occurrence of an insured event, ensuring the legitimacy of the claim, on the one hand, and the policyholder's urgent need to receive compensation promptly in order to recover financially, from the other hand.
This presentation will explore the complex dynamics of this tension, based on Zaki Diab’s experience as a litigator specialising in property insurance claims within the insurance market, and will offer insights into addressing these challenges from multiple perspectives.

Ever since the last financial crisis, executive compensation has remained high on the agenda of many authorities. When there are concerns about executive remuneration, legislators first of all try to find the remedy through increasing the level of transparency. DiversityInclusionHumanRightsRuleOfLawIn 1857, in the case of Dred Scott v Sandford 60 US 393, a majority of the United States Supreme Court delivered one of the clearest examples of a judiciary breaching the rule of law. In this notorious case, it was held that coloured people were property and, as chattels, were not entitled to citizenship of the United States and the protection of its Constitution. A bloody civil war followed this decision, which ultimately led to an end of slavery in the United States. However, progress towards any form of racial equality was hindered by the United States Supreme Court. In Plessy v Ferguson 163 US 537 (1896) a majority of the court held that racial segregation did not breach the equal protection clause of the Constitution, bringing about the infamous doctrine of “separate but equal”. Racial segregation did not end until 1954, when a unanimous Supreme Court held in Brown v Board of Education 347 US 483 that the equal protection clause applied to everyone, regardless of race.
On the other side of the Atlantic, a majority of the Judicial Committee of the Privy Council – comprised of judges also sitting at the Supreme Court of the UK – held, in Boyce v the Queen [2004] UKPC 32, that colonial laws dating from the time of the British Empire, regardless of their being “inhumane or degrading”, cannot be held to be inconsistent with the declaration of fundamental rights and freedoms of the written constitution. Immunity was said to be “complete”, i.e. absolute in perpetuity. Such interpretation of a codified declaration of fundamental rights and freedoms obviously feels wrong and may be argued to as defying any basic sense of human dignity or understanding of what the rule of law means. The implications are profound and broad-ranging. The decision’s precedential value has consequences beyond the case in which it was decided in that many Caribbean laws that discriminate against LGBTI people, or even still criminalise consensual sexual intercourse between two adults of the same sex, are also untouchable colonial laws as a result.
The Diversity and Inclusion Council along with [x] call for a special panel discussion to consider the implications of wrong judicial decisions what mechanisms can be employed to mitigate against such eventualities (e.g. such as not representing governments that wish to perpetuate errors of law) and if there are means to hold the judiciary to account for clearly erroneous decisions.

The application of artificial intelligence (AI) to pharmaceutical research represents one of the most significant transformations the sector has experienced in recent decades, with the global AI-in-pharma market projected to grow at a 40–43 per cent Compound Annual Growth Rate (CAGR) through 2030. This rapid expansion also brings significant regulatory and governance challenges, particularly with respect to the regulatory acceptability of data generated through AI based methods and the requirements governing the appropriate use of personal data for algorithm training. These issues are prompting authorities worldwide to develop principles and frameworks aimed at ensuring the trustworthy, transparent, and responsible integration of AI into medicinal product development.
Second, many jurisdictions have moved to force digital platforms like Google and Facebook to compensate news organisations for the use of their content.
