The Antitrust Section provides an international forum for thought leadership with respect to antitrust law developments and the profession through submissions to competition agencies, training programs/missions, developing the law through our conferences, publications, and interaction with antitrust enforcement authorities and the profession.

Andrea Lee and Kaleigh Duvernet argue that companies need to continue developing and implementing initiatives to attract and retain a diverse workforce or fall behind in economic growth. They discuss initiatives to enable progression in this area, such as diversifying management, working with external organisations committed to fostering diversity, mentoring and addressing pay gap issues.
Shortages of medicines and medical devices are caused not only by manufacturing challenges, but also by distribution unavailability, due to issues at distribution chain level. This session will examine the phenomena within the distribution chain that can lead to shortages of medicine and medical devices, such as parallel trade. The session will also explore different approaches to deal with such shortages by several jurisdictions, including the imposition of regulated prices, blacklist, export controls/restrictions, government mandated distribution and challenging product registration rules.

Healthcare is one of the key sectors targeted by 5G and may benefit from its deployment throughout the patient’s pathway, with enhanced remote health services.
Distressed M&A transactions arise when companies face debt and contingent liabilities that are too big or when markets are shut. These can be terrific opportunities to acquire at attractive pricing. However, making these investments requires speed, cash, clever tactics and an iron stomach to take risks, often without diligence. This article discusses how environmental, social and governance (ESG) factors and human rights considerations are increasingly influencing mergers and acquisitions (M&A) deals worldwide, and the importance of an ESG focus on due diligence, integration and disclosure throughout the transaction process. The article explores: the impact of ESG and human rights factors on deal value and corporate reputation; the nature of ESG due diligence; incorporating ESG factors into M&A transaction documents; and best practices for ESG and human rights disclosure in M&A transactions.
Over the last decade, the curtailment of funding for justice systems around the world has had serious consequences for the administration of justice. Many jurisdictions have witnessed a degrading in the courts estate; administrative systems have struggled to cope with demand; recruitment and retention within many areas of the justice system is adversely affected due to funding concerns; and publicly funded legal systems have been subject to repercussive cuts.
These effects compromise access to justice and diminish respect for the justice system as a whole. Rather than justice being seen as a valuable commodity worthy of investment, it is too often seen as an unwelcome cost which should be subject to imposed decline. This has concerning repercussions for both the state and its citizens, creating real impediments to the rule of law and meaningful access to justice.
The scope of legal aid systems across the world varies. As legal aid is a crucial vehicle by which the fundamental protection of human rights may be guaranteed, and the availability of legal aid is inextricably linked to access to justice, it is the responsibility of governments to guarantee that legal aid systems ensure that this protection is practical and effective, including the provision of adequate funding. This session will explore, through a number of case studies, the consequences of failing to invest in a country’s justice system and the response of the legal profession in safeguarding access to justice and the rule of law.

3D printing can be used to create customised medical devices using patient-specific data. This article addresses the regulatory status of this transformative technique and its development in Argentina. Although there are no regulations specific to 3D printing used in the manufacturing of medical devices, the National Administration of Drugs, Food and Medical Devices has published a guide outlining the key technical considerations for products developed through additive manufacturing, a broad category that includes 3D printing within its scope.
The issue of consent for children, the aged and the mentally disabled gives rise to a number of legal, ethical and human rights issues.
This session will include:
- At what age does the laws in various jurisdictions allow a child to decide for themselves?
- The younger child, is it really in the child's best interest or the interests of others?
- Can or should the consent of a capacious but underage young person be overridden?
- Elderly, disabled and incapacious; similar issues might arise with regards to best interests decisions in relation to restrictive practices (physical and chemical) - is it in the patients' best interest or the best interest of others?
- Compulsory treatment under mental health legislation - when should this be used and under what circumstances?
- Consent of children in relation to the disclosure of their personal information to their parents and/or family members.

This article explores the regulatory, institutional and operational development of telemedicine in Uruguay, highlighting its evolution since the Covid-19 pandemic. It examines the benefits of this model, particularly in terms of accessibility and equity, and proposes a reform agenda for the advancement towards more sophisticated healthcare practices. Key challenges include interoperability, professional training, ethics, cybersecurity and quality evaluation. Ultimately, the article emphasises the need for a structural public policy that fully integrates telemedicine into the national health system.
After leaving university he worked as a clinical epidemiologist in medical research, before becoming an occupational physician at the State Secretary for Economic Affairs of Switzerland. For ten years he has been responsible for the occupational health aspects of health protection in the workplace and serves as the medical backbone of the labour law. His areas of expertise include motherhood protection, protection of apprentices, the organisation of first aid and also protection against psychosocial stress.
