Law, Ethics and Armed Conflict

14 May 2025, Kuwait City, Kuwait.

The Human Rights Law Committee, in partnership with the Task Force Spartan Office of the Staff Judge Advocate and Advocates Group Academy, hosted an international legal symposium entitled Law, Ethics, and Armed Conflict in Kuwait City on 14 May 2025. The Symposium, which was co-sponsored by the IBA Business Human Rights Committee and the Japanese Federation of Bar Associations, brought together 30 speakers from 18 nations and over 140 attendees, including human rights lawyers, academics, military officers, diplomats and professionals in humanitarian assistance, to discuss the principle of humanity in armed conflict.

 

Over the course of the day, we heard from the world’s leading international human rights law and international humanitarian law experts from governments, the United Nations, international NGOs, academic institutions and international tribunals.

Speakers included:

  • U.S. Ambassador Karen Hideko Sasahara, who opened the event with remarks highlighting the earliest written codes governing conduct in war, including the Lieber Code;
  • Ms. Ghada Al-Taher, United Nations Resident Coordinator to Kuwait, gave a moving presentation on her lived experiences through armed conflict in war zones across Africa and the Middle East;
  • Former U.S. Ambassador-at-Large for Global Criminal Justice (ret.) Stephen Rapp treated the Marten’s Clause within the context of the principle of humanity and discussed the evolution of the crime of aggression;
  • Sara Elizabeth Dill, Co-Vice Chair of the IBA War Crimes Committee, highlighted common themes in international criminal law and Islamic law in her cogent presentation on the prohibition of conflict-related sexual violence;
  • Dr. Saad Rüstem, Syria Program Coordinator for Geneva Call, discussed humanitarian assistance and protection within the context of Syria;
  • Ms. Nisreen Rubaian, Representative of the United Nations High Commissioner for Refugees (UNHCR) to the State of Kuwait, spoke about her decision to dedicate her professional life to the protection of displaced persons in armed conflict;
  • Prof Mohamed Elewa Badar of Northumbria University called for greater inclusion within the “general principles of law” that form part of the sources of public international law, as recognised by the ICJ Charter;
  • Omar Mekky, the ICRC Regional Legal Coordinator for the Near and Middle East, presented the challenges of engaging with armed groups in the Middle East towards compliance with international humanitarian law;
  • Ms. Federica D'Alessandra, Director of the Oxford Programme on International Peace and Security, examined the immunity of government officials within the framework of international criminal justice;
  • Prof. Mohammad Fadel of the University of Toronto discussed Islamic public international law, taking the audience through 1,000 years of Islamic diplomatic and treaty practice and outlining the concept of state sovereignty in Islamic international law; and
  • Dr. Iyad Nasr of the European City University-France and Dr. Mohamed Abdelaziz GadelHak Ibrahim of the United Nations in New York discussed their success stories and lessons learned in negotiating with armed groups towards the protection of fundamental human rights and humanitarian protection in time of armed conflict.

The 2024 INTERPOL Repository of Practice: the unresolved tension between facilitating police cooperation and upholding human rights

Few institutions wield as much influence over global law enforcement as International Criminal Police Organisation otherwise known as INTERPOL. With its notices and diffusions systems linking 196 member countries (three more than the United Nations), INTERPOL plays a critical role in facilitating international cooperation to combat serious crime. However, this unparalleled reach is not without risks. In recent years, authoritarian regimes have increasingly misused INTERPOL’s systems, particularly red notices and diffusions, as tools of transnational repression (TNR).

Podcast: The Human Rights Law Committee podcast series looks at both obvious and overlooked aspects of litigating and documenting torture, in an ‘A-Z’ format. Although the obligations under the Convention against Torture are of a jus cogens nature, the scope of these obligations, and the range of physical and psychological torture/cruel, inhuman and degrading treatment, tend to be understood or construed narrowly. Human Rights Conference, 5-7 April 2024, Tokyo

The IBA, in partnership with the Japan Federation of Bar Associations, held its inaugural Human Rights Conference from 5-7 April 2024, in Tokyo.

Centered on the theme Climate, Justice, and Law – Challenges and Opportunities, the event brought together legal experts and advocates to address urgent global issues, including LGBTIQ rights, gender-based violence, arbitrary detention, migration, business and human rights, modern slavery, and the challenges faced by lawyers in high-risk environments. Discussions also explored the social impacts of climate change, the role of the death penalty in justice, Myanmar’s post-coup legal landscape, and initiatives to establish a chemical weapons tribunal.

Conference Co-Chair Makoto Saito emphasised the significance of the event, stating, 'As a Japanese human rights lawyer, I am excited to have the first-ever IBA Human Rights Conference in Tokyo. The conference presents a fantastic opportunity for lawyers from various jurisdictions to gather in one place and exchange views on the special topic of ‘Human Rights.'

Marking the 75th anniversary of the Universal Declaration of Human Rights, the conference reaffirmed the commitment of the IBA and the Japan Federation of Bar Associations to advancing human rights and the rule of law worldwide.

Persecution Prevention Project - report series on Yazidi Genocide

The Persecution Prevention Project was established in 2019. It is a pro bono project supported by the IBA Human Rights Law Committee and Yale University’s Genocide Studies Program.

On 18 September 2024, at the IBA Annual Conference, the IBA Human Rights Law Committee, in partnership with the IBA War Crimes Committee, the Mexico Bar Association and the IBA Foundation, hosted a screening of War and Justice, a documentary about the International Criminal Court.
