The unprovoked Russian invasion of Ukraine has had tremendous impacts on energy and food supply. Impacts of sanctions and Russian attempts to influence Europe by reducing hydrocarbon supply has resulted in an energy crisis which has dominated the recent public discussion. Less attention has been given to the impacts of the invasion on minerals supply from Ukraine, Russia and the minerals supply globally. The session will focus on how the war impacts the future possibilities of developing mineral resources in Ukraine, Russia’s ability to trade and develop mineral resources and global supply more widely.

Citizens around the world are divided over many issues— public health, climate change and the rise in nationalism—to name a few. These divisions have caused, or have the potential to cause, a decreasing faith in the legitimacy of institutions and a growing distrust among their citizenry. We have seen attacks on the justice system, and indeed physical attacks on judges (and lawyers) themselves.

The Two-Pillar Solution acknowledges the importance of the STTR in achieving a consensus on Pillar II for developing countries, but so far has only identified interest, royalties and a “defined set of other payments” as being subject to the rule, has set the minimum rate for the STTR at a range from 7.5% to 9% and has relegated implementation to a bilateral negotiation upon request. This panel will explore the practical tension inherent in the Pillar II proposals in addressing the concerns of developed and developing countries with a particular emphasis on the challenges faced by developing countries in protecting their tax base and competing for revenue.

SustainabilityFocusWhere there is an apparent failure of governments, corporates and other "entrusted" institutions to act in the best interests of the community as a whole, the law and in particular class actions emerge to seek to hold those responsible to account. This session will take the temperature of the current state of global climate change class actions and try and look over the horizon at the next wave of climate change litigation.

SustainabilityFocusThe discussion will cover the different approaches to the issue of sustainability in aviation (e.g. flight ban for domestic flights and governments’ incentives for purchase and use of SAF), investigating their impact on the reduction of CO2 in the sector and evaluating the strategies to which the aviation industry reacts with more participation. The topic will also address the relevance of new technologies to promote sustainability, including the most virtuous applications of Unmanned Aircraft Systems in recent years and the future of vertiplanes.

IBA Showcase: atrocity prevention – from Rwanda to Ukraine, why international law still matters (Showcase)

This IBA Showcase will focus on the timely and important issue of atrocity prevention and ensuring that those who commit atrocity crimes are brought to justice. The panel discussion will consider issues such as justice through the ICC, universal jurisdiction, the UN Security Council, the Responsibility to Protect principle, and other accountability mechanisms.
The session will also focus on relevant country case studies, including the current war in Ukraine, and attendees will have an opportunity to review, comment, and debate ways of highlighting atrocity crimes to the general public.
