IBA Insurance Conference 2024: AI in insurance and other global insights
On 1 July 2020, new legislation in the state of Virginia, United States, will devolve decision-making on statues from state to municipal authorities, resolving a three-year dispute over the planned removal of an equestrian statue, in the city of Charlottesville. ‘Sad to see the history and culture of our great country being ripped apart with the removal of our beautiful statues and monuments,’ US President Donald Trump tweeted on 17 August 2017, amid violent protests over the statue.
Public procurement is consistently identified as a sector raising significant corruption risks around the world. Efforts to combat corruption in the public procurement sector have been sporadic, and have had mixed results. Panelists will discuss developments concerning corruption-related risks in public procurement contexts, different legal regimes, and trends in particularly jurisdictions, along with practical cases and approaches by companies. The panel will address the importance of compliance steps and prevention in avoiding higher corruption-related risks in public procurement matters, including in the context of recent geopolitical developments.

In a growing number of jurisdictions, regulators and the organized bar have begun implementing limited, supervised testing of new methods of delivery via a policy tool called a regulatory sandbox. What is a sandbox and how does it work? Can it really increase access and do so in a way that preserves professional values and public protection? • Impact on the access to fast delivery judgments: AI technologies have the potential to enhance the quality of judgments by streamlining legal research, analysing vast datasets and providing data-driven insights to judges and legal practitioners. This sub-topic will explore how AI tools can assist in making informed, evidence-based decisions and potentially reduce errors and inefficiencies within the justice system.
• Addressing bias in AI: ensuring that AI is not biased by its programmers or by the data it learns from is a crucial aspect of integrating AI into the legal system. This sub-topic will delve into the evolving field of AI ethics and its role in shaping AIs understanding of fairness. • Role of AI in judgment elaboration: a critical consideration is the extent of AIs role in the legal process. Should AI be limited to assisting in the analysis of evidence, or should it participate in elaborating judgments? This topic will examine the advantages and disadvantages of AI involvement in judgment elaboration and the implications for human oversight.

On 17 June, the governing council of Oriel College, Oxford, United Kingdom, voted to remove a statue of college benefactor Cecil Rhodes, which has graced its High Street entrance for more than a century. The vote followed fierce debates, street protests, and an admonishment by the Chancellor of the University of Oxford.
The growth of ESG is a priority for many corporations as well as law firms. What is less settled is the connection between the two. Companies are certainly investing internally and externally to grow their sophistication and success in how they govern ESG - and law firms are rapidly growing practice areas in the ESG space. Women and Black people have historically had a severe employment disadvantage in Brazil, compared to men and white people. Because of this, a growing number of recruiting processes have been directed by employers only to female and Black workers. In the past year the Public Labour Prosecution Office advocated for the use of affirmative action to reduce social inequalities based on the principle of isonomy, recognising the lawfulness of positive discrimination practices in Brazil.
The ABA recently conducted a survey: "In their own words: Experienced Women Lawyers - Explain Why They Are Leaving Their Law Firms and the Profession". There is a global trend to note in the legal industry that female lawyers leave the law firms much earlier than their male colleagues – irrespective or even despite of being “on track”. Law firms have started to steering against this trends, but so far the success is limited. Based on the ABA survey this session shall review the following questions: what negative factors or experiences do women identify as forces that make them consider leaving the practice of law in a law firm? And what changes can be made to encourage women to stay in law practice? Are there any models or structures on the market which appear to be promising?
On our panel we shall have (male and female) legal practitioners and HR experts from different jurisdictions analysing the above questions.

In April, former Minneapolis police officer Derek Chauvin was convicted of the murder and manslaughter of George Floyd, who was Black. Floyd was arrested by Chauvin and three other officers in May 2020, on suspicion of trying to use a fake $20 bill.
Over the past decade, the use of third-party funding (TPF) has grown and developed, raising concerns in the field of investment arbitration about the parties’ equality of arms. This panel will discuss whether TPF really facilitates investors’ claims and the measures so far proposed by the arbitral community to address the alleged imbalance brought to the system by the wider use of TPF.

Employment law continues to evolve and impact on in-house legal teams, particularly during these eventful times. From the impact made by 2020’s Black Lives Matter protests to the ramifications of Brexit, Polly Botsford explores key developments.
All organisations today are expected by their members to explain how they are doing in terms of diversity. The panel will provide some selected IBA diversity data, which shows that IBA is already doing well in some aspects, but that there is some room for improvement in other areas. The speakers will discuss with each other as well as the audience through Q&A; various practical methods of enhancing diversity they have used within their firms or organizations, effects of using diversity data as a nudging tool to accelerate voluntary efforts for change, tips and taboos when using data especially in terms of privacy and LGBTQ right; what they expect of the IBA from now in diversity and inclusion; and which of the common D&I methods are in name only, and which of them are truly effective, such as target, quota, “comply or explain” rules, policies, training, sharing best practices, mentorship, messages from leaders, or otherwise raising awareness.

The freezing order, or Mareva injunction, is a powerful tool to combat fraud and dishonest conduct. Since its creation in 1975, the ownership of assets and wealth structuring has become increasingly complex. Rarely will the assets, the underlying cause of action, and the location of relevant individuals all be in the same jurisdiction. The complexities are usually magnified where fraud is involved. The courts must be equipped to respond effectively and swiftly to these scenarios. To its credit, the common law world has demonstrated a keen appetite to develop the jurisdiction of freezing orders to meet the increasing complexities of commerce, and in particular to combat the sophistication of international fraud and money laundering. It has been and continues to be fine-tuned to the demands of the day, whether through common law development or the adoption of statutory remedies. This article considers how the freezing order jurisdiction has evolved since 1975, significant developments in its evolution for both onshore and offshore jurisdictions, and hazards a look into the crystal ball of its future.

What is the right answer and how do you work out what is the right answer for your law firm? Deciding upon office locations, networks and/or alliances is hard, but it is much harder making them work, both within your law firm but also within a network or alliance.

The South African Competition Act 1998 has from the outset reflected a clear focus on both competition law and public interest issues, the latter including provisions to enhance small business and overcome historical discrimination wrought by apartheid. Interpretation and implementation of these provisions has developed over time, culminating in the introduction of amendments to these provisions in the Competition Amendment Act 2018, which came into force in 2019. This article reviews the applicable legislative provisions and how they have been interpreted by the competition authorities in practice and through case law, and considers whether they have been effective.
This session will examine which role male champions of gender equity and equality at corporate law firms can have as catalysts for change. While women law firm leaders and women lawyers need to work towards achieving greater gender parity, they are keenly aware of the challenges they face and what needs to be done to have an increasingly levelled playing field. Thus, having women discuss these matters solely amongst themselves is like preaching to the choir. Given that in most countries a wide majority of law firm leaders are men (including managing partners, executive committee members, shareholders/equity partners, etc), the question arises whether greater male involvement in and ownership of gender parity goals can serve as an accelerator towards reaching those goals. The panel will present the latest research on the subject, as well as the panellists' experiences and best practices regarding male champions of gender equity and equality at corporate law firms.

Following the announcement of the ousting of Sudan’s President Omar Al Bashir and the Defence Minister, Ahmed Awad Ibn Auf, assuming leadership of the country, the International Bar Association’s Human Rights Institute (IBAHRI) calls on the army and transitional government to ensure respect for human rights and the rule of law in Sudan.
‘Sustainability’ permeates political, legal, economic and social discourse. It covers environmental monitoring, business and human rights, reporting and compliance and other governance issues, among other things. Lawyers are called upon to navigate not just legal advice but also provide context for that advice. This panel will explore the role of the lawyer, and the type of guidance, tool kits or other resources that Bars can and should be providing. To illustrate this, the session will also include discussion of the new IBA Bar Issues Commission roundtable on bar association and law society climate initiatives: implementation and inspiration post-event report.
18th Annual Bar Leaders' Conference
In late 2020, the National Bar Council of Italy (known as the Consiglio Nazionale Forense, or ‘CNF’), the public institution that represents lawyers in Italy, launched a project to study and combat discrimination on the basis of sexual orientation, gender identity or race. The project marks the first major institutional drive by the CNF to focus on this area in Italy.
The IBA Bar Issues Commission (BIC) is participating in the presidential initiative to address artificial intelligence and, in particular, the BIC is focusing on guidance for bar associations in advising their members.
