Fashion labels and brands have become more protective of their intellectual property rights. This consciousness is undoubtedly more pronounced in Europe and North America. Sub-saharan Africa and Nigeria, in particular, are still playing catch-up. The fashion industry in most parts of Nigeria and sub-Saharan Africa involves a lot of innovation and creation, so much so that the owners of the labels give a second thought to the issues of intellectual property protection. This article explores the challenges of inadequate regulatory frameworks in this respect and makes a case for a change.

The iconic 1970s English soccer player, Kevin Keegan was the first sports personality to enter actively into what was known at the time as a ‘face contract’ for what was essentially his image rights. Since the People’s Republic of China’s adoption of the Anti-Monopoly Law (AML) in 2007, and its coming into effect in 2008, scant enforcement attention has been directed at abuse of dominance in the digital economy. While there have been some – mostly unsuccessful – abuse of dominance cases brought by private plaintiffs, the enforcement authorities, previously the National Development and Reform Commission (NDRC), State Administration of Industry and Commerce (SAIC) and, currently, the State Administration for Market Regulation (SAMR) and their provincial and local counterparts, have put relatively less emphasis on abuse of dominance cases.
This panel will discuss and analyse a new trend where mining companies are sued in their home jurisdictions for operations located outside those jurisdictions.

In rapid succession, a number of jurisdictions have moved away from focusing on antitrust enforcement to the proposed regulation of digital platforms. Ostensibly, the regulatory focus is about competition and potential concerns that traditional ex post enforcement may be ill-equipped to address the power of digital platforms. This article focuses on the realities of what platform regulation might mean, and how to better frame and structure the nature of appropriate regulation. This article first identifies a number of the different approaches to regulation that various jurisdictions have put forward, and then lays out six basic principles for platform regulation to help address some of the potential harms that such approaches may unwittingly be pursuing.

A person’s most valuable asset is their personality, and the wealth that is beginning to be associated with this in the 21st century is increasingly becoming evident. Technological advancement, especially the evolution of social media, has introduced complexities into the exploitation of image rights in the fashion industry. These platforms have suddenly become a theatre of sorts, for infringers who commercially exploit the images and persona of athletes, models and fashion brands without permission. Consequently, the efforts to commercially control both images and information belonging to fashion brands have never been greater. For elite models and fashion brands at the pinnacle of their career, not even the engagement of social media experts and consultants has been able to address this malaise.
Consumer claims are becoming more prevalent. Access to justice and the growing recognition of consumer rights are one factor behind this. At the same time governments in many countries are trying to stimulate growth through encouraging enterprise and innovation. Producers can be caught between balancing these competing risks and opportunities. Are we achieving an appropriate balance of risk as between consumers and producers? Should producers accept greater risk of product claims? How will that impact innovation? Is it becoming easier for consumers to bring and prove their claims? European Union (EU) moves in this area include a change of approach to presumptions of defect and a shift in the evidential burden for consumers. Is this fair? This session will take a cross-jurisdictional perspective on these questions, looking at the status quo and what is on the horizon for consumer product liability claims across the globe.
