And it’s no wonder – multiple studies show that salespeople are widely perceived as untrustworthy, and lawyers aren’t rated much higher. The encouraging part, though, is that great lawyers already apply the core principles of good sales. The real shift is in mindset: moving from ‘selling’ to consultative relationship-building – something most great lawyers are already doing when supporting their clients.

This session examines what has led to a crisis in attorney wellbeing and launches the IBA Presidential Taskforce, which aims to help tackle the root causes. During the session, Steven Richman of Clark Hill, Deborah Enix-Ross of Debevoise & Plimpton and Sara Carnegie, Director of the IBA Legal Policy and Research Unit, posed the questions explored by the panel.
Their behaviour may be subject to the bar rules of their home jurisdictions, but not all representatives are members of a bar and not all bar rules are applicable to arbitration proceedings conducted in a foreign jurisdiction. Thus, counsel acting in the same case might not be subject to the same rules of conduct, potentially creating an unlevel playing field when it comes to possible sanctions for misconduct.

Arriving in Budapest, I was excited to join my first IBA European Regional Forum (ERF) retreat as a council member. Bringing together over 50 officers, council members and Advisory Board members, this was a great (and slightly daunting!) opportunity to immerse myself in the ERF and find out more about their current and upcoming projects.
The rationale behind this can vary, but no matter what the reason, there is one common trait: the perpetrator wants to keep the profit. Thus, sophisticated individuals prepare the schemes in advance, across more than one jurisdiction, while betting on the likelihood that the victims won’t be able to seek justice due to lack of funds.

We were happy to see 110 participants in Munich on 27 March, in the unique location of Upside East for a day of discussions concerning the very challenging times that the automotive industry is now facing. Attendees had a chance to ease into the conference at the welcome cocktail which took place the evening before and it was good to see many familiar faces showing that the conference is becoming a familiar item on the IBA calendar.
The fight against corruption is caught by the ‘G’ of ESG and thus is the focus of exclusions and debarments. But what about other ESG-related issues?

From 11–13 June, leading legal experts in life sciences and healthcare convened at the Ritz-Carlton, Boston, for the 11th Annual IBA World Life Sciences Conference. The event, co-hosted by the IBA Intellectual Property and Healthcare and Life Sciences Law Committees, brought together regulators, corporate counsel, private practitioners and academics to address the most pressing developments at the intersection of law, innovation and global health. This articles considers the key themes and panel highlights of the conference.
Similarly, in the Petrobras case, the Department of Justice publicly praised the assistance of its Brazilian law enforcement counterparts. It is thus predictable that many future international corruption cases likewise will be resolved using cross-border cooperation.

On the afternoon of Thursday 2 November 2023, at the IBA Annual Conference in Paris, the European Regional Forum lead the organisation of the automotive session titled ‘The European automotive and mobility service industry: transformation and revolution’. Contrary to its title the panellists came from different areas of the world, including Europe, India, Mexico and South Korea. During the session, panellists discussed issues relating to data privacy, developments concerning autonomous vehicles, the future of electric vehicles and more.

The European Fashion and Luxury Law Conference, meticulously organised by the European Regional Forum (ERF) of the International Bar Association (IBA) in Milan on 23 April 2024, was a resounding success. The event, which was fully booked, showcased a remarkable assembly of speakers, each highly esteemed within the industry. These speakers brought with them a wealth of knowledge and expertise, which they shared across a series of discussions and presentations.
Lots of jurisdiction provide for tax incentives related to research and development (R&D) but also for tax exemption regimes available sometimes for many years, which, in practice, may trigger heavy tax audits on the tax incentive regimes thus granted. Therefore, this panel will discuss such issues as practical considerations that star-up founders and institutional investors should be aware of from the perspective of practitioners in multiple jurisdictions.

While women law firm leaders and women lawyers need to work towards achieving greater gender parity, they are keenly aware of the challenges they face and what needs to be done to have an increasingly levelled playing field. Thus, having women discuss these matters solely amongst themselves is like preaching to the choir.

This year brought a slight change in how we approached our Big Retreat. The Officers’ Retreat and the Council Members’ Retreat were joined into a single event which took place in Budapest at the start of March 2025. Our Senior Vice Chair, Viktória Szilágyi from Lakatos Köves and Partners, carried out the work as this year’s gracious host and needed to accommodate such a large crowd with a full schedule. She certainly lived up to it!
The attendees are invited to read the materials in advance, to acquaint themselves with the case and thus follow the seminar more effectively.
The session will start with the panel (formed of experts in damage valuation and barristers/lawyers) conducting a mock cross-examination of expert witnesses, before providing advice on the dos and don’ts and discussing differences between expert witness examination methods in different jurisdictions.
IBA Annual Litigation Forum: Litigation in the digital era - challenges and opportunities

Innovation was the leading topic at the 4th European Automotive and Mobility Services Conference convened on 14 March 2024. Nearly 100 delegates gathered at Upper East, a unique venue boasting an industrial chic vibe on the 9th and 10th floors, located behind Ostbahnhof station.
It is surely incumbent on the legal regulator to ensure that all citizens have access to a lawyer and therefore is there a role for regulators to address the development of 'legal deserts' and thus improve people's access to justice.

In this session, Antonia Verna and Pavla Prikrylova presented the European Regional Forum Diversity & Inclusion Working Party with the Diversity and Inclusion Toolkit for Lawyers. The Toolkit was developed by the International Bar Association (IBA) to provide law firms with an action plan to embed the core principles of diversity and inclusion into their organisations.
The law firms are employing strategies aimed at steering against this development but with limited success, thus far. We will explore the drivers behind women leaving before being promoted and which changes can be implemented to encourage women to remain in the law practice.

The panel on digital assets at the 37th International Financial Law Conference in Venice was co-chaired by Dirk Bliesener, Vice-Chair of the IBA Banking Law Committee and partner at Hengeler Mueller in Frankfurt, and Benjamin Leisinger, member of the IBA Securities Law Committee and partner at Homburger in Zurich. It began by examining some of the fundamentals of crypto markets and the different asset standards.
This session will report on the work of the task force responsible and their progress thus far with a panel of distinguished speakers who will survey the landscape of digital service across the world and comment on the results collated.
IBA Annual Conference Copenhagen 2026
With the ushering in of South Africa's Companies Act 71 2008 came innovative rules with provisions that are somewhat difficult to understand. Some of the puzzling and mysterious provisions that formed part of Act 71 were corrected through the Companies Amendment Act 3 2011. The aim of this article is to explain the provisions and effects of section 136(2) of the 2008 Act and section 87 of the Amendment Act. Both these sections relate to alteration of agreements.
Furthermore, the panel will tackle how Saudi lawyers are trained and the legal profession is regulated including through the Saudi Bar Association, and the route to becoming a lawyer in the KSA. We’ll thus also cover the key legal players in KSA and in the region.

Neither investment arbitration nor international commercial arbitration are isolated from the phenomenon of corruption as a repeated but globally sanctioned conduct. Considering this, allegations of corruption may arise in the context of a dispute in both areas. The purpose of this article is to contrast the treatment given to such allegations, including the sanctioning of corruption by arbitrators, which is clearly determined by the specificities of each of these mechanisms, as well as by the nature of the disputes addressed.

The pandemic, political disruptions and increasing financing costs had and have a significant impact on the real estate market. At the same time, new tax rules have created further challenges for planning cross-border real estate investments. This session provided an overview of the recent developments regarding the relevant tax rules and the opportunities and constraints resulting therefrom, including the latest developments under the Multilateral Convention to Implement Tax Treaty Related Measures to Prevent BEPS (MLI), the upcoming third EU Anti-Tax Avoidance Directive, the United States Foreign Investment in Real Property Tax Act regulations, the interpretation of the Swiss Treaty Law on sales of real estate investment companies and similar Italian and Finnish legislation related to the MLI.

The new Foreign State Immunity Law 2023 of the People’s Republic of China came into force on 1 January 2024. This shifts the country (as well as its special administrative regions, Hong Kong and Macau) away from absolute state immunity to restrictive state immunity, bringing it more in line with the relatively prevalent practice among the international community. This article discusses the status of state immunity in public international law, analyses the new law’s provisions and examines practical challenges that will be faced by those seeking to utilise this law to enforce judgments or awards against foreign states and state entities, and the new law’s innovations that go beyond the United Nations Convention on Jurisdictional Immunities of States and Their Property of 2004 and the UK State Immunity Act 1978.
