The arbitration agreement provokes dilemmas when related to legal acts with implications in consumer protection law (including class claims). The solutions have oscillated between favoring either arbitration or consumer protection. I propose that there is a better view: their coexistence. This alternative has the merit that the protected interest of each of them is respected and achieved. This leads to more rights, which is always desirable, particularly when dealing with protected parties (as consumers).
What about initiatives in the Common Market and International Trade Agreements that may be capable to change the professional lives of lawyers in civil law countries (and not only there…)? We will talk with lawyers, policy makers and legal tech providers from civil and common law jurisdictions, to understand where the legal profession stands today and how it will flow tomorrow in the international legal market on ABS.

A summary of the IBA Aviation Law Committee’s activities at the IBA Annual Conference in Mexico City from 15–20 September 2024.
Traditionally, international trade has been seen as a way in which countries and individuals seek to exchange goods and increase wealth. However, recent global trends, including the environmental, social and governance (ESG) movement, have placed basic human rights at the forefront of all human interactions including within international trade.

President Donald Trump’s draft budget reportedly reduces federal funding for civil legal aid from $375m to zero. Venture debt, a different funding alternative for startups, has positioned itself firmly in the venture business in the past few years, reaching high numbers in the US market by 2022, and more recently has begun to gain position in other markets, such as Latin America. This type of financing seems counterintuitive at first, since the logic behind loan financing has not aligned traditionally with the high-risk profile and low cash flows of startups. This has led to burdensome requirements for its founders, who have had to back up the loans personally, but the empirical data seems to point towards a significant use and growth of this type of financing. This article looks at how venture debt works and why it works.
