4th European Automotive and Mobility Services Conference
The European Regional Forum (ERF), established in 1989, has over 8,000 members. The forum is divided into four regions - Northern, Western, Central, and Southeastern - each led by a Chair and Vice-Chair. We have five working parties - communications, D&I, ESG, mental wellbeing, and next-gen law - and we organise four conferences annually (automotive & mobility services, fashion & luxury law, ESG and start-up) in addition to many leading and participating in many smaller initiatives.
Our goals include: addressing the needs of professional organisations and individual members, increasing participation in the IBA, fostering cross-border collaboration among European lawyers and bars and supporting the Rule of Law and civil society. The ERF promotes professional development and networking opportunities through our many initiatives.

11th Biennial IBA Global Immigration Conference
China has witnessed continuing progress in personal data protection laws as well as the tightening of law enforcement in this field. Recently the authorities’ spotlight has been on mobile applications or apps, which are the most popular way that businesses collect personal information. Chinese authorities have adopted the carrot and stick approach by cajoling app operators into following the best practice, while aggressively going after violators to curb illegal apps
As the global community struggled to contain the Covid-19 pandemic throughout 2020, various international governments incorporated new data-driven technologies within their suite of regulatory tools to reduce the spread of the coronavirus.

This article provides an introduction to the Damages in International Arbitration (DIA) app, an interactive web application prepared by the ICCA-ASIL Task Force on Damages following five years of work. It has been prepared on the basis of the author’s contribution at the 2022 IBA Day Istanbul in March 2022 in the panel chaired by Mark Friedman and including David Dearman and Smitha Menon. The DIA guides users through the key legal, quantitative and procedural issues implicated by quantifying damages in international arbitration. The article is illustrated with some screen shots from the DIA web application and also refers to Friedman’s presentation on the suggested Quantum Academy (see pages 69–78).
Conference report – Building the necessary physical and regulatory infrastructure to support new forms of mobility services
During this panel, we will discuss the use cases of AI in the automotive industry and their impact. Is the OEM the gatekeeper of the new smart device vehicle and will that change with future information exchange obligations? We will further cover the cybersecurity obligations and specific type approval requirements, as well as the ownership of intellectual property and the role of standards and standard essential patents regarding digitalisation and AI applications in the automotive sector. Finally, we will learn about the effects of the AI Act on the automotive industry and what to expect in the future.
4th European Automotive and Mobility Services Conference

Restrictive covenants in various guises are being scrutinised by legislatures, governmental agencies (both competition and employment) and courts around the world. This session will consider the interaction of employment law with competition law and assess the future viability of various practices such as non-competes, no-poach agreements, wage fixing and collective bargaining.

Over the past few years, digital lending apps (DLAs) have greatly aided both business users and retail customers in India. However, to curb growing malpractice and the misuse of customers’ personal data, on 2 September 2022, the Reserve Bank of India (RBI) issued official guidelines to restrict the activities and improve the oversight of DLAs. All RBI regulated entities have until 30 November 2022 to put in place adequate systems and processes to ensure that all their digital loans are in compliance with the new guidelines.

We were happy to see 110 participants in Munich on 27 March, in the unique location of Upside East for a day of discussions concerning the very challenging times that the automotive industry is now facing. Attendees had a chance to ease into the conference at the welcome cocktail which took place the evening before and it was good to see many familiar faces showing that the conference is becoming a familiar item on the IBA calendar.
The panel will discuss proposed forthcoming legislation in the EU, UK and around the world regarding artificial intelligence, as well as competition and regulatory issues raised by artificial intelligence.

30th Annual International Private Client Tax Conference: transforming (un)expected challenges into opportunities for the next 30 years

One of the current trends within the Israeli tech startup environment is that startups are increasingly considering restructuring their corporate structures by placing a non-Israeli company at the top of their holding structure, often referred to as a ‘flip’. While this can involve various non-Israeli jurisdictions, it is particularly common for the resulting parent company to be based in the US. The reasons behind this trend include tax incentives, investor preferences and regulatory advantages. The typical process of a flip involves the transfer of rights by rightsholders in the Israeli company to a newly formed foreign parent company, often creating immediate tax implications for Israeli stakeholders. However, the Israel Tax Authority has the ability to offer a favourable tax decision in this regard that can exempt Israeli rightsholders from tax, provided certain conditions are met. This decision by the regulator may also have a potential impact on the company’s future exit strategies and tax obligations. The implications of flips should, therefore, be carefully considered by startups and investors.
In the hot topics session we explore current themes of interest to the maritime and transport law community. The exact choice of topics will be decided later.

The landscape of the workplace is evolving due to the meteoric rise of remote work and a globalised talent pool in the last few years. The benefits of a borderless workforce working remotely without geographical restraints extend to both organisations and the workforce alike. Organisations are able to access a global pool of talent whereas the workforce appreciate the freedom and flexibility to work from anywhere. Indian employment laws, though technical, offer a fair amount of flexibility for engaging a foreign workforce in India or vice versa when sending an Indian workforce abroad. However, organisations should certainly have a clear understanding of employment law, social security, tax, exchange control and immigration law requirements before moving forward. A legally thought through approach goes a long way in mitigating risks and treading the right path with greater awareness.
A panel discussion on the opportunities and pitfalls faced by a buyer in making an offer in a pre-pack sale. This session will cover practical aspects to be considered by the buyer, such as valuation, pricing, employees and insolvency procedural issues depending on the jurisdiction. The panel will also address whether buyers should consider taking on board fund managers in distressed asset acquisitions.

Russia’s invasion of Ukraine has led to hundreds of human rights defenders in the embattled country downloading the eyeWitness to Atrocities camera app and submitting 10,000 verifiable videos, photographs and audio files of alleged war crimes. These pieces of potential evidence represent the largest haul for the app in a single conflict zone to date. The 10,000 milestone demonstrates Ukrainian human rights defenders’ desire to ensure that declared violations are captured and processed in a way that is acceptable for investigators and courts of law.
This expert panel will review the interplay between telecoms, antitrust and data rules in the newly emerging new worlds of the metaverse, ‘internet of things’ and artificial intelligence. It will discuss and debate key questions including:

At the 2nd IBA European Automotive and Mobility Services Conference held last week we heard from Professor Nick Reed as the keynote speaker of the need for a radical transformation of mobility services based on a coherent vision that embraces safety, sustainability, prosperity, equality and inclusion. The panel discussed the growth in recent years of nomad visas and permanent remote workers in a post-Covid world and the Organisation for Economic Co-operation and Development’s guidance on this topic. The panelists discussed practical considerations for remote workers and referred to recent case law and practices in Austria, Bulgaria, France, Switzerland and the United States.
Shortages of medicines and medical devices are caused not only by manufacturing challenges, but also by distribution unavailability, due to issues at distribution chain level. This session will examine the phenomena within the distribution chain that can lead to shortages of medicine and medical devices, such as parallel trade. The session will also explore different approaches to deal with such shortages by several jurisdictions, including the imposition of regulated prices, blacklist, export controls/restrictions, government mandated distribution and challenging product registration rules.
