Introduced by the Criminal Finances Act 2017, UWOs can be issued when there is an obvious gap between the value of an asset – which must be worth at least £50,000 – and the income of the person who appears to own it.

The article analyses the 1989 Italy–Brazil treaty on judicial cooperation, focusing on the recognition and enforcement of commercial judgments. It outlines the historical background, the legal frameworks in both countries, and the procedural requirements for cross-border enforcement. A recent Italian Supreme Court case is analysed to illustrate how the treaty operates and especially how it is being used in resolving jurisdictional conflicts and balancing party autonomy with public policy limits. Thanks to the ruling of 2023 by the United Sections, it was finally possible to put an end to these divergences.

IBA Annual Conference Miami 2022
The International Commerce and Distribution Committee examines legal issues fundamental to the growth and development of international commerce.
The Committee deals extensively with issues relating to international sales contracts, agency and distribution, cross-border acquisitions, warranties and financing of international sales.
In addition to reviewing the current legal position in different countries from a comparative perspective, the committee also examines international and supranational instruments, such as the United Nations Convention on the International Sale of Goods, Incoterms and the Uniform Customs and Practice for Documentary Credits and relevant instruments of the European Union and Mercosur.
The Committee also focuses on law reform in the fields of law within its scope, and since 1997 has monitored and offered suggestions in connection with the proposed Hague Convention on International Jurisdiction and the Effects of Foreign judgments in Civil and Commercial Matters.
On 17 June, the governing council of Oriel College, Oxford, United Kingdom, voted to remove a statue of college benefactor Cecil Rhodes, which has graced its High Street entrance for more than a century. The vote followed fierce debates, street protests, and an admonishment by the Chancellor of the University of Oxford.
The panel will discuss recent regulatory developments regarding tender offer rules across the various regions, especially in light of the proposed amendments to adopt mandatory tender offer rules in Korea. Among other issues, there will be a focus on:
- how different jurisdictions protect investors from the risk of ‘creeping control’;
- the different approaches to mandatory tender offers in Korea, Japan, EU and the US and background of these differences;
- how ‘tender offers’ are defined;
- how mandatory tender offer rules play out in countries where they are adopted; and
- special considerations in adopting mandatory tender offer rules.

Since UNCITRAL opened the Singapore Convention on Mediation (the ‘Convention’) for signature on 7 August 2019, there have been 55 signatories and nine countries have ratified the Convention. The Convention, which came into force on 12 September 2020, aims to make the enforcement of mediated settlements in international commercial business-to-business disputes quicker and easier.
Recently, the achievements of Artifi cial Intelligence have broadened in a myriad of fi elds and applications. One doubt lingers regarding these technological advances: their ability to replace humans in fi elds typically reserved for highly specialized professionals such as lawyers. We will discuss the general understanding and expectations over this uncertainty and the possible challenges it presents.

Poland’s ruling Law and Justice party proposed on 21 November an amendment to reverse a law requiring supreme court judges to retire at 65 instead of 70, following the decision of the Court of Justice of the European Union (CJEU) on the law in mid-October.
Interestingly, however, most of us have never been formally taught this skill and so generally think it is more a question of talent and luck than of hard work and preparation. The short response to this is: presenting at a so-called beauty parade is both an art and a science. In this session, the panel will engage in a live pitch. Two transaction lawyers will be pitching together for an upcoming major cross-border transaction and two general counsels will, under the lead of our moderator, evaluate the pitch.

Portugal has undergone a profound shift in competition enforcement in recent years, marked by more assertive public enforcement, most notably in the context of labour markets. In parallel, the emergence of class actions seeking large damages – driven by a permissive procedural regime – has placed new pressures on public enforcement, particularly leniency. While such claims risk undermining incentives to self-report, labour market cases appear less exposed to follow-on litigation, which likely explains why Portugal’s leniency regime is not as dormant as elsewhere. This article assesses these developments and considers how public and private enforcement could be better aligned going forward.

2nd IBA African Competition Law Conference
The Asset Management and Investment Funds Committee provides a convenient forum for its members to consider current developments in the global investment funds industry, including both regulatory and product development. It also produces newsletters and occasional e-bulletins for its members. In addition to its programmes at the annual IBA conferences, the committee presents an annual conference on Globalisation of Investment Funds normally held in June, which celebrated its 30th successful year in 2020. The event attracts delegates from approximately 30 countries, and features presentations by senior regulators from around the world, senior executives of top fund managers and other fund service providers as well as from leading practitioners in the field.
On 26 September 2019, 30 Rohingya Muslims were arrested in the south of Myanmar while travelling from Rakhine State to Yangon, where they planned to seek work or passage abroad. Local media reported that the 21 adults were sentenced to two years in prison with labour and the eight teenagers sent to a ‘youth training school’.

Takeover laws in India enable the ‘white knight’ defence in the case of attempted hostile takeovers, by allowing competing offers to the public shareholders of the target company. While this provision has rarely been used, we seek to briefly analyse and delve into the growing pertinence of competing offers in the transforming landscape of the Indian economy and public markets.
This panel will explore various pre-signing dispute risks, including the sudden termination of discussions, pre-signing misrepresentations and issues arising in connection with deals subject to employee consultations.
