The article highlights the devastating impact that the global Covid-19 pandemic has had on the live music industry and shows how this might be mitigated by embracing the newer forms of exploitation of copyright to bolster artists’ income streams.
This panel explores recent case law in copyright infringement cases in the music industry, discussing the “Blurred Lines” between inspiration and copying, the impact of the digital market on infringement claims and whether AI is the Stairway to Heaven or Highway to Hell for Copyright in the world of music. This panel will focus on the various rights and issues in music, recent decisions on copyright infringement cases, what is the future for the music industry in the age of AI.

The Honourable Chief Justice Geoffrey Ma Tao-Li, GBM QC SC was appointed Justice of Appeal in the Hong Kong Court of Appeal in 2002, and became Chief Judge of the High Court in 2003 before being appointed Chief Justice of the Court of Final Appeal in 2010. Chief Justice Ma spoke to the IBA’s Director of Content, James Lewis, about freedom of expression in Hong Kong, the independence of the judiciary, and the drafting and enforcement of the national security law.
This workshop will focus on insurance companies as investors in private equity funds and the structures that General Partners (GPs) have been establishing to attract this capital in light of applicable insurance regulatory considerations. The back-and-forth on trade tariffs stirs up financial markets and deepens recession fears around the world. But what does a looming trade war mean for real estate? At this year’s real estate investment conference in London, Jennet Siebrits, who heads Global Commercial Real Estate Services’ (CBRE) UK market research team, shares her insights into what might be ahead of us. It is a long-standing tradition for the real estate investment conference to start with a macro-economic and geo-political outlook. The conference, organised by the IBA Real Estate Section and supported by the European Regional Forum (ERF), is being held for the 15th time in London this year.

We will delve into the potential legal and business risks associated with moonlighting, including conflicts of interest, decreased productivity, health and safety issues, intellectual property concerns, and potential data security breaches. We will also discuss with experts and leaders in the legal community how employers should address the issue. Legal professional privilege is not to be tampered with. It is a principle of such a fundamental nature that it imposes itself even on legislators. This is, in essence, the Belgian Constitutional Court’s message in its judgment of 20 July 2023 in a matter initiated by the Order of Flemish Bars (Orde van Vlaamse Balies or OVB) and other petitioners against the Flemish regional implementation decree of the DAC-6 Directive, as this article explains.
The legal frameworks applicable to corruption and sanctions present some similarities, such as their extraterritorial nature, but also striking differences. There is no universal convention on sanctions comparable to the United Nations Convention Against Corruption, however, the regimes have become increasingly linked one to the other:
• In 2021, the UK adopted its global anti-corruption sanctions regime.
• Since 2022, US authorities have described sanctions as ‘the new FCPA’.
• In her 2022 State of the Union address, the European Commission president proposed including corruption in the EU human rights sanctions regime, following the path opened by the Global Magnitsky Act. The draft directive on corruption (and related joint communication) further illustrates the new role of the European Union.
Today, some argue that – given that some frozen assets were obtained through corruption – this should be a valid basis for confiscation. At the same time, the implementation of sanctions regime can lead to an increase in corruption.
The panel will explore the various aspects of this complex intermingling and assess challenges that lie ahead.

In liberalising Nigeria’s electricity sector, the distribution of electricity was handed to Distribution Successor Companies. The assumption was that the licences issued to these Companies over certain geographical areas were exclusive. This court case provides clarity through the judicial interpretation of Section 71(6) of the Electric Power Sector Reform Act 2005.

In 2021, the United Kingdom’s CMA (Competition and Markets Authority) – like other competition agencies worldwide – faces a future where competition law enforcement and policy are very different from what we have been used to for decades. Quite apart from its new post-Brexit functions (taking on cross-border merger and cartel cases that would previously have been reserved to the European Commission), the CMA is having to deal with a panoply of new challenges. First, the Covid-19 pandemic, which has touched every aspect of people’s lives, has inevitably had an impact – changing external priorities, and changing the way the authorities deal with them. Second, there are the effects of digitalisation of the economy which, unlike the worst of the pandemic, are likely to be long-lasting: immense benefits for competition and consumers, but also major new issues in competition enforcement, which seem different in scale, and perhaps different in kind, from those thrown up by earlier waves of technological change. Third, and less visible but perhaps most fundamental, there are questions about the ability to command public legitimacy and support in a world where market competition is increasingly questioned as a solution to economic problems. This article discusses ways of dealing with these challenges.

When the Bolar exemption was introduced at the EU level in 2004 (though some Member State case law applied it prior to that date), it struck a balance between the need for patent owners to preserve their proprietary rights as long as possible and the desire of businesses to enter the market without undue delay the day after patent expiration (known as 'Day 1').
Mastering the fundamentals: building stronger legal directory submissions and connections
In recent times, many of the enterprises entering the FinTech space in Singapore are typically involved in the following areas: (1) initial coin offerings; (2) virtual currency exchanges; (3) asset tokenisation; and (4) digital payment systems and services. This article aims to offer an insight into the Singapore legal and regulatory framework, analyse the place of FinTech within the broader Singapore policy objective of becoming a ‘Smart Nation’ and forecast the evolving legal landscape.
In this panel discussion we look at the growing role in non-bank financial institutions such as tech companies, credit funds, asset managers and insurers are playing in providing credit to the real economy and the financial sector. The panel will consider both opportunities and challenges this poses for the financial markets, including the impact it has on traditional players, how it might change both the mix of debt and the attractiveness of debt that is available (both private debt and public capital markets), and whether the rise of these alternative financiers poses a threat to financial stability.

Business development prowess is not a skill that lawyers are born possessing. How do successful rainmakers become who they are? Is business development a skill that can be taught? The first part of this program will feature panellists from some of the world’s leading law firms as they discuss how their firms developed state-of-the-art training programs using a combination of internal resources, external consultants and mentoring. The second part of the session will introduce some of the world’s leading rainmakers, who will share some of the secrets to how they were able to build and maintain robust practices.

This article examines the antitrust treatment of most-favored-nation (MFN) clauses in online travel platforms, focusing on Brazil’s prohibition of wide MFNs and contrasting it with certain US case law. The author explores theories of harm and potential efficiencies, highlighting the complexities of assessing MFNs in two-sided digital markets. Arguing against a blanket ban, the article advocates for a rule of reason approach grounded in evidence and economic analysis. Drawing from selected US precedent, it suggests that Brazilian authorities could adopt a more balanced framework that carefully weighs pro-competitive benefits against potential anti-competitive risks.
