Various sanction regimes imposed against Russia raise unresolved questions about the certifications of Russian marine insurers, more precisely their issued Blue Cards under the Civil Liability Convention of 1992 (CLC 92), the Bunkers Convention of 2001 (Bunkers Convention) and the Nairobi International Convention on the Removal of Wrecks, 2007 (Nairobi Convention, sometimes collectively referred to as ‘the Conventions’), if in the case of an event triggering the scope of application of the conventions, a Russian insurer can no longer meet its insurance obligation due to, for example, banking sanctions. This brief article addresses this problem, which also occupied the Legal Committee of the International Maritime Organization (IMO) on 22 and 23 March 2022.

7th Annual Corporate Governance Conference
The Forum for Barristers and Advocates represents Bar Associations whose members practice as independent referral practitioners in jurisdictions with a divided legal profession. The panel discussed a variety of selected issues with regard to dual tax residency, which can arise both in an income and estate/inheritance and gift tax context. As tax residence is determined under the highly diverse domestic tax laws of each jurisdiction, a person can qualify as a tax resident in more than one jurisdiction at the same time. In this situation, so-called tie-breaker rules in bilateral tax treaties may resolve this issue. If there is no such treaty, the resolution depends solely on the respective provisions of national tax law. The panel focussed on the interaction of United States tax law with that of France, Italy, Malta, Spain, Switzerland and the United Kingdom, respectively.
Many large mergers and acquisitions are abandoned before closing because of value-creation, regulatory and political issues.

Acting as a central hub within the IBA, the Committee will coordinate efforts on access to justice and legal aid, collaborating with other committees on joint projects. The IBA’s global reach will support the exchange of best practices, offering valuable insights for jurisdictions facing challenges in maintaining or improving access to justice during times of austerity.

More and more, banks’ customers file judicial actions to hold the bank responsible for losses incurred when the bank has completed a payment request made at the request of third-party fraudsters instead of the ‘real’ customer. This article looks at how the Portuguese Supreme Court of Justice decided who should be held accountable in two recent cases, the first involving a case of phishing via text message and the second involving the misuse of an e-mail address belonging to the bank’s customer.
The session will look at how these issues can arise, including supply chain issues, fraudulent disclosure and climate control.

This article presents the current and future trends, as well as the hurdles for the implementation of full interoperability in healthcare in Brazil, from a legal and practical point of view.
