Much has been said that Fintech's threaten the business of traditional banking, but increasingly they seem to be complementary businesses. While they certainly compete, they also collaborate. Banking-as-a-Service (BaaS) is increasingly becoming an important complement to traditional banking which has slowly given certain access to Fintech which in turn have helped improve financial services offered by traditional banks. What are the most relevant regulatory trends in the region to, on the one hand, encourage this collaboration or disruption and on the other preserve the strength of the traditional financial system? How should BaaS evolve and with it, how will the regulation evolve?

The Business Human Rights (BHR) Committee creates awareness of business and human rights and broader corporate sustainability principles. Preventing and addressing business-related human rights risks is key to ethical business, good governance and increasingly legal compliance for businesses including law firms.
The UN Guiding Principles on Business and Human Rights, as the core international standard, provide guidance on governments’ duty to protect against human rights harm by business; business’ responsibility to respect human rights; and access to remedy for business-related human rights harm.
The BHR Committee promotes legal skills to advise clients in this area and facilitates dialogue among lawyers to support evolution.

The mission of the Committee is to address issues of particular interest to start ups, owner-managed, closely held and family businesses and their legal advisors, and to organisations with ambitions for growth. The Committee's aim is to provide a focus for the different needs of ownership, management and financing of such organisations. Particular focus is placed on: management and ownership issues, finance and the raising of tier one and two capital, shareholder issues and agreements, business succession plans, exit planning, relationships with outside investors, protection of minority interests, dispute monitoring and resolution, the role of professionals in management and advisory roles and relevant issues arising from tax, employment, real estate, estate planning and family law.

This panel at the 2024 IBA Annual Conference in Mexico City addressed the main recent developments in the tax structuring of foreign investments into Mexico. Considering that such foreign investments are predominantly made by United States investors (41.4 per cent of investment over the period 2006–2024), and by Spanish investors (10 per cent of investment over the same period), the panel focused first on the main general tax implications arising in Mexico for foreign investors.

For many law firms, international legal work is already part of their practice. Whether it is advising foreign investors, navigating cross-border transactions or handling disputes with an international element, legal teams often engage beyond their own jurisdictions. But true internationalisation is more than just taking on occasional cross-border matters.
ESG issues are also gaining traction in other circles in the legal profession, notably alternative business structures. ESG frameworks evaluate business practices and performance but also measure risks and opportunities. The panel will assess each pillar of ESG (environmental, social, governance), exploring the practices and steps law firms and alternative business structures can adopt and implement to uphold the 2030 UN Sustainability and Development Goals.

The Indigenous Peoples Committee addresses development issues affecting land and people from the legal perspective of those impacted, rather than developers, governments, or businesses. The committee aims to enhance communication among lawyers worldwide on issues concerning indigenous peoples, and establish links with organisations like the UN Sub-Committee on Indigenous Peoples and the World Bank. The Committee plans to publish a regular newsletter and is seeking an editor, along with volunteers, particularly from outside Canada. To reduce travel costs, the committee will utilise e-communication to advance its projects, programs, and publications.
A summary of the panel session at the IBA Annual Conference 2019 in Seoul, chaired by Hermann Knott from Andersen Tax & Legal, Germany; PPID/SPPI Representative, LPD Council and Kathryn Rousin from White and Case, England; Co-Chair, Academic and Professional Development Committee. The Public Law Section provides a global platform for discussing public law topics, exchanging ideas, and fostering development. Our members actively engage in debates about government policy, administrative action, judicial review, and constitutional law. The Section examines how citizens and businesses interact with government actions and anticipates future trends, including the evolving relationship between government and the private sector. Key topics include the principles of fairness, deregulation, and the comparison between civil and common law systems. The Section has an interest in international legal developments and the differences between the various systems.

Each country has developed four different chapters, covering foreign investment, capital markets, rendering of public services and real estate regulations.

The Immigration and Nationality Law Committee is concerned with all aspects of immigration and nationality law on a worldwide basis, including business-related immigration, family reunion policies, refugees and compassionate cases.
The Committee aims to provide a forum for the discussion of comparative data on immigration and nationality policies of countries worldwide.
The mission and focus of the committee is to provide a platform for lawyers practising immigration laws to receive input and update about the immigration laws of their country and also immigration laws and procedures of other jurisdictions. We achieve this by holding annual conferences and presentation of papers, newsletters and providing other online resources to enhance the knowledge of its member in multiple jurisdictions.

The Women Lawyers’ Committee (WLC) aspires to empower its 3000 highly valued members from all over the world to engage, network and share knowledge. The committee was originally an interest group which was introduced as an IBA constituent in 1996 to allow efficient global networking of women lawyers.
WLC aims to level the playing field in the legal profession and inspire leaders to work to achieve gender parity. It's 20 committee officers create awareness tools to help the profession achieve this goal, while at the same time facilitate an efficient global network for women lawyers to connect and develop business and expertise, supported by its Advisory board.
