Despite growing scientific consensus on climate and environmental challenges and extensive regulatory developments in recent years, the implementation and enforcement of ESG accountability frameworks face significant headwinds globally. Companies operating cross-border projects confront conflicting ESG standards, extraterritorial regulations, and asymmetric enforcement regimes, whilst states grapple with the limits of traditional policy tools in driving meaningful corporate accountability. Simultaneously, ESG-related litigation is emerging as a powerful enforcement mechanism, with courts increasingly called upon to adjudicate climate obligations, supply chain due diligence failures and greenwashing claims.
Against this background, this session explores ESG accountability from four complementary perspectives: international normative frameworks, state-level mechanisms, corporate obligations and judicial enforcement.

It has been said that there are basically three types of practice orientation: (1) the legal technical approach (2) the wise advisor (3) the lawyer with a high moral purpose as guided by the lawyers' conscience. It has been well recognised that the solution to the social challenges which intersect poverty such as migration climate change and wealth inequality must involve a lawyer’s commitment to a high moral imperative. This requires that that the lawyer approach legal problem-solving guided by such purpose. International norms particularly norms that are grounded upon soft law increasingly call for a holistic approach to business planning. The panel discussion will focus on how such things as the independence of the legal profession can assist in pursuing the practice orientation of a high moral purpose while still maintaining the support of the client in such pursuits.
A pre-recorded video made for the session, by Hon Mia Amor Mottley QC, Prime Minister of Barbados, on the topic, will be played and used in the discussion.

This article examines the development of pro bono advocacy in Brazil following the enactment of OAB Provision 166/2015, which established a regulatory framework legitimising gratuitous legal services, and analyses how legal rankings, awards and diversity commitments have incentivised law firms to structure institutional pro bono programs that complement public legal aid and advance access to justice.

One of the many dilemmas of L&D is figuring out how to use advances in technology as a means of engaging learners and improving access to learning for a more diverse audience with different needs and preferences. This session will be led by industry experts in learning design and delivery who will provide an insight into how a digital approach to learning can best serve learners of the future.
