The new Foreign State Immunity Law 2023 of the People’s Republic of China came into force on 1 January 2024. This shifts the country (as well as its special administrative regions, Hong Kong and Macau) away from absolute state immunity to restrictive state immunity, bringing it more in line with the relatively prevalent practice among the international community. This article discusses the status of state immunity in public international law, analyses the new law’s provisions and examines practical challenges that will be faced by those seeking to utilise this law to enforce judgments or awards against foreign states and state entities, and the new law’s innovations that go beyond the United Nations Convention on Jurisdictional Immunities of States and Their Property of 2004 and the UK State Immunity Act 1978.
This unique experience will offer an in-depth exploration of the organization and configuration of the Mexican Supreme Court, providing insight into its pivotal role within the country's judicial system.

The Rule of Law Forum, established in 2007, supports IBA members in advocating for the Rule of Law, as per the 2005 Prague Resolution. Originally the Rule of Law Action Group, the Forum operates within the Section on Public and Professional Interest (SPPI). Its purpose is to assist members in responding to the IBA Council's call to support the Rule of Law in their communities. The Forum's activities are led by Co-Chairs, with Vice-Chairs assisting them. The Forum does not have formal membership but maintains a circulation list. Liaison members from other IBA committees help integrate Rule of Law into their work.

Arbitration has become the preferred option for dispute resolution in cross-border commercial transactions in Africa. Many African countries, including Kenya, have signed and ratified the 1958 New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards. This article provides a detailed analysis of the challenges that have bedevilled the recognition and enforcement of awards in Africa, with a particular focus on the Kenyan experience. This article concludes by providing an assessment of the impact that the challenges bedevilling the recognition and enforcement of awards has on the role of arbitration, taking into account cross-border commercial transactions, and providing recommendations on the way forward.

The International Commerce and Distribution Committee examines legal issues fundamental to the growth and development of international commerce.
The Committee deals extensively with issues relating to international sales contracts, agency and distribution, cross-border acquisitions, warranties and financing of international sales.
In addition to reviewing the current legal position in different countries from a comparative perspective, the committee also examines international and supranational instruments, such as the United Nations Convention on the International Sale of Goods, Incoterms and the Uniform Customs and Practice for Documentary Credits and relevant instruments of the European Union and Mercosur.
The Committee also focuses on law reform in the fields of law within its scope, and since 1997 has monitored and offered suggestions in connection with the proposed Hague Convention on International Jurisdiction and the Effects of Foreign judgments in Civil and Commercial Matters.

On 14 June 2023, around 300 human rights lawyers, judges, reporters and associations worldwide attended, online and in-person, the third International Fair Trial Day (IFTD) and Ebru Timtik Award.
The Forum for Barristers and Advocates represents Bar Associations whose members practice as independent referral practitioners in jurisdictions with a divided legal profession. Formed by Bar Leaders, the Forum advocates for the principles of independent advocacy within the IBA. The Forum addresses the importance of advocate and judiciary independence, ethical conduct, and training. The Forum supports human rights and collaborates with the Judges' Forum and other committees on litigation and trial topics. The Forum’s inaugural members include Bar Associations from England and Wales, Scotland, Ireland, South Africa, Australia, and Hong Kong, representing over 16,000 barristers and advocates. Membership is open to bar associations which are full or supporting members of the IBA, and to individual members of any Divisions.
On 27 February 2020, the Colombian Council of State set aside an international arbitral award under Law 1563 of 2012 (the ‘Arbitration Statute’) for the first time, citing departure from the procedure agreed by the parties.

Like many other jurisdictions in recent years, Germany will introduce commercial courts in April 2025 in an attempt to establish itself as a more attractive jurisdiction for commercial disputes, particularly in competition with arbitration. However, it remains to be seen whether the commercial courts will provide a significant alternative. When choosing between the new commercial courts and arbitration, there are several aspects parties should consider.
The question now is to what extent and how quickly will this change occur and be embraced by forward thinking lawyers and clients. This session will explore the rapidly developing technologies and novel products that are changing the way lawyers are supporting M&A activity in the digital age, the benefits to both law firms and clients of embracing new ways of doing deals, the opportunities technology presents, as well as the challenges created by such innovation. Topics to be explored include: how technological innovations are impacting transactional efficiency; how the M&A lawyer’s role has evolved and will evolve in shaping successful deal making by leveraging technology; the potential impacts of the digital age on shareholder engagement, empowerment and transaction approval; and regulatory implications and ethical considerations of utilising new technologies to support M&A transactions.

Stephen Denyer, who sadly passed away in early 2024, was honoured with the IBA Benjamin B Ferencz Rule of Law Lifetime Achievement Award at this session. Adam Goodman, Co-Chair of the IBA Rule of Law Forum, and many other IBA officers, paid tribute to him. Stephen's wife Monika accepted the Award on his behalf.

An initiative in Germany calls for a change to the German Stock Corporation Act (Aktiengesetz) that would give members of the management board the option to suspend their mandate for a period of up to six months in specific cases, such as a parental leave, long-term illness or the care of close relatives, without having to fear liability risks. This article discusses the background to and details of this initiative.
The Poverty and Social Development Committee, builds on years of work under various IBA auspices. We engage the legal profession to contribute to UN Sustainability Goal #1: Eradicating Poverty. Our committee advocates for using law to protect individuals and communities from poverty, promoting well-being. We believe legal professionals have a duty to create and apply law for good, preventing exploitation and mitigating harm. Planned projects include a podcast, a practical book for lawyers, a session at the IBA Annual Conference, and supporting NGOs focused on poverty eradication. We invite members to join our efforts.

Telemedicine has become more important in Germany since the Covid-19 pandemic. Such services include video consultations, teleconsultations and remote monitoring. Although telemedicine is generally permitted, it is subject to strict legal requirements, particularly in the context of statutory health insurance. Professional regulations, advertising law and data protection regulations set clear obligations in this context. Cross-border treatment, liability and reimbursement are also important legal aspects. The current laws, such as the Digital Healthcare Act and EU regulations, support digital healthcare services. However, clearer framework conditions are still required to ensure legally compliant and efficient implementation of such services, particularly with regard to artificial intelligence (AI)-driven tools, which offer new opportunities, but also raise legal uncertainties.
The role of the courts in arbitration: an Asia Pacific perspective
Very few legal fields face the revolutionary changes that employment and industrial relations laws do. Issues such as technology, human rights, globalisation, corporate citizenship and increased movements of people have created unprecedented legal complexity as they interact with traditional laws often formulated decades ago. As the largest of the Human Resource Section Committees of the IBA, the purpose of the Committee is the identification, technical analysis and proactive management of national, regional and global developments in these rapidly evolving fields. The Committee takes a ‘cutting edge’ approach to its selection of topics and speakers and draws upon the combined experience of its officers and panellists to present the members with innovative solutions to the employment law problems of today.

Thanks to globalisation, the assimilation of legal principles across jurisdictions is not uncommon. Assimilation is not a novel concept, as laws, being statutory responses to states’ socio-economic needs, cannot be perceived in isolation with international trends drifting towards globalisation. Assimilation comes with specific advantages for emerging economies, as their commercial legal systems are relatively nascent and, consequently, flexible enough to mould themselves towards garnering investments.
For start-ups and family businesses, establishing a professionalized board and other aspects of corporate governance tend to be far down the priority list. And yet, several experiences have demonstrated that investing in good governance is crucial for long-term success of non-listed companies. In this panel we will examine the advantages of adopting good corporate governance for private companies and the main risks associated with inertia, with a close look to the key issues that any private company should consider when structuring its governance, alongside with the new trends in legislation.

Despite its potential, cultivated meat remains a novel and scarcely adopted technology. Its unfamiliar production methods raise valid questions about regulation and food safety. Since cultivated meat is derived from animals, yet produced through biotechnology, it falls outside traditional regulatory frameworks for either conventional meat or genetically modified organisms. This article explores how Singapore and the United States, the first two countries to approve the release of cultivated meat for the consumer market, have addressed these challenges and discusses the lessons Mexico can draw from their experience in the developing its own regulatory framework for cultivated meat.
The Asset Management and Investment Funds Committee provides a convenient forum for its members to consider current developments in the global investment funds industry, including both regulatory and product development. It also produces newsletters and occasional e-bulletins for its members. In addition to its programmes at the annual IBA conferences, the committee presents an annual conference on Globalisation of Investment Funds normally held in June, which celebrated its 30th successful year in 2020. The event attracts delegates from approximately 30 countries, and features presentations by senior regulators from around the world, senior executives of top fund managers and other fund service providers as well as from leading practitioners in the field.
The phrase “Mexico, so far from God and so close to the United States” is attributed to Mexican President Porfirio Díaz, who at the turn of the 20th century purportedly lamented Mexico’s proximity to the U.S.

Mexico’s President Andrés Manuel López Obrador has a plan for the country’s electoral commission, the Instituto Nacional Electoral (INE). His ‘Plan B’ electoral reform was passed by the national Congress in February and is now sitting before the Supreme Court, which in early May ruled that part of the reforms is invalid under Mexico’s Constitution.
The Corporate and M&A Law Committee connects corporate, compliance, private equity, and M&A practitioners globally. Focused on education, networking, and collaboration, we address key challenges in corporate law and M&A.

Leisure and Hospitality Industry in Mexico represents one of the biggest sources of income. In addition to the foregoing, there are states in the country that depend 90% on tourism. The arrival of Covid-19 in Mexico represented a huge challenge to its economy and particularly to the touristic, leisure and hospitality sector, considering the travel bans and international and local restrictions.
