A conference report on the ‘Rise of the machines: will lawyers be replaced by Artificial Intelligence? What do the services providers have to offer?’ session from the Biennial IBA Latin American Regional Forum Conference: Technology, social media and artificial intelligence: challenges for the legal industry in the digital age.
The session will take stock of the developments made in cross-border legal practice up to now, reviewing the jurisdictions having opened their legal services market to the practice of foreign lawyers and law firms and assessing what the experience has been. The session will also discuss the rising challenges to globalisation (eg, sanctions, decoupling and de-dollarisation) and the impact, if any, on trade in legal services.

Session summary from IBA Annual Conference 2023: The session ‘The role of the profession, ethics, representation and social responsibility’, held on 1 November 2023 in the chamber of the International Chamber of the Paris Commercial Court in central Paris, was led by Sandrine Giroud (of LALIVE in Geneva), Vice-Chair of the Litigation Committee, and Adam S Goodman (of Dentons in Toronto), Vice-Chair of the Rule of Law Forum. Panellists were Robert Steven Bernstein (of Holland & Knight, New York), Christopher Stephens (of the World Bank, Washington), and Ambassador Ret. François Zimeray (of Zimeray Finelle, Paris). The discussion addressed the pressure lawyers could face from their clients, the limits of free speech, but also whether the concept of universal rights was under attack.
The 11 members of the Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPPa) have combined economies representing 13.4 per cent of global gross domestic product, at approximately US$13.5tn making the CPTPP one of the world’s largest free-trade areas by gross domestic product (GDP). Mexico and seven Asia Pacific countries make up eight of the 11 signatories. This session will critically examine whether the CPTPP has delivered on its promise, and what the Asia Pacific region, in particular, can look forward to in the next few years.

The Women Lawyers’ Committee (WLC) aspires to empower its 3000 highly valued members from all over the world to engage, network and share knowledge. The committee was originally an interest group which was introduced as an IBA constituent in 1996 to allow efficient global networking of women lawyers.
WLC aims to level the playing field in the legal profession and inspire leaders to work to achieve gender parity. It's 20 committee officers create awareness tools to help the profession achieve this goal, while at the same time facilitate an efficient global network for women lawyers to connect and develop business and expertise, supported by its Advisory board.

The Anti-Corruption Committee provides an international forum for private and public-sector practitioners to meet and discuss anti-corruption laws, compliance practices, enforcement trends and asset recovery issues.It facilitates the sharing of best practice and the regular communication of legal and other developments, including new legislation, case-law, prosecution guidance and government policy, as well as developments in civil society, the private sector and international organisations. Committee members have the opportunity to assist one another in understanding transnational corruption, share domestic legal expertise and extend their professional experience internationally.

During the current Covid-19 pandemic, businesses and corporations of all sizes – particularly start-ups and budding entrepreneurs, are being pushed to their limits. Even such routine tasks such as paying rent and employees on time have proved to be game changers and given us a chance to examine the way we function, process and plan our business models so that everyday operations are not interrupted.
This panel will look at the different approaches to regulating digital platforms that have been taken in different jurisdictions around the world. Speakers will consider whether sector specific regulation such as the EU’s Digital Markets Act (DMA) is necessary and whether it has the intended effects, or whether other laws, such as existing competition and consumer protection laws, are adequate to address market failures or consumer harms. Also to be considered are whether regulatory focus should be on areas such as AI or the protection of minors, and how digital platforms regulation, if required at all, may be future proofed to address rapidly evolving technologies.

As President of the International Bar Association, Horacio Bernardes Neto has ratified the IBA Climate Crisis Statement. In a message to IBA members, Mr Neto outlined the IBA’s responsibilities as the global voice of the legal profession, stating, ‘I believe the legal profession must be prepared to play a leading role in maintaining and strengthening the rule of law, and supporting responsible enlightened governance in an era marked by climate crisis’.
The Forum for Government and Public Lawyers provides a platform for government and public lawyers worldwide. As the global voice of the legal profession, the IBA supports these lawyers and connects them with both public and private sector practitioners. The Forum focuses on the role of government and public lawyers, covering public service values, ethics, specialist skills, and public international law developments. Membership is open to Bar Associations that are IBA members and individual members of any Division. The Forum is especially relevant to practitioners working in government or public entities at domestic, regional, or international levels.

Biennial IBA Latin American Regional Forum conference
The Taxes Committee encourages interface between international tax specialists and promotes the building of networks among tax lawyers worldwide to assist them in better serving the interests of their clients. The committee is divided informally into four practice group areas: Income Taxes, Other Taxes, Tax Litigation and Employee Benefits.
Members are encouraged to contribute to the committee newsletter which is published two to three times per year and to present papers at committee conferences and seminars. The committee also offers tax executives a forum, in its Tax Executives group, to exchange expertise and skills with their colleagues in industry on topics of special interest.

IBA India Technology Law Symposium: disruptive technology and digital transformation in modern day India
The African Regional Forum aims to enhance the value and significance of the International Bar Association (IBA) by addressing issues unique to African lawyers. When algorithms used by businesses or government agencies make unintentionally biased decisions, the impact on people can be profound. Global Insight assesses what can be done to re-humanise these decisions, and to provide explanations of the outcomes to those affected.
In 2022 many countries adopted ambitious and generous strategies to scale-up renewable energy capacity, through a combination of funding or offtake programs to rapidly build-out renewable power production or to expand domestic manufacturing capacity and supply chains and access to components and raw materials. The programmes were often taken to address energy price inflation and volatility or in response to perceived threats to national security due to armed conflicts and natural disasters. What were these legal regimes? What is the impact a year later?

The Committee provides a forum for all international lawyers who are interested in discussing and debating issues affecting the practice of law. In today's world a lawyer may face conflicting duties and the application of professional standards may be far from apparent. How will the development and use of drone technology affect the property industry? It’s easier to see how new buildings can adapt to drone technology with landing pads and rooftop charging zones, but the bigger challenge might be how readily the property industry embraces retrofitting existing properties. The question of who owns the sky creates interesting legal issues over the flight passage of drones as well as other issues surrounding this technology.
In the fast-paced and exciting world of sports, the role of ethics and compliance is key, as recent events repeatedly have demonstrated. The multifaceted nature of compliance in sports, from upholding the integrity of the game to protecting the well-being of athletes, encompasses a wide range of regulatory, anti-corruption and ethical considerations, including gender equality, discrimination, doping scandals and match-fixing controversies. 20th Annual IBA Anti-Corruption Conference
The Maritime and Transport Law Committee is one of the oldest and most established committees of the IBA, with more than 650 members worldwide.The Committee is a platform where leading maritime law professionals meet, create connections and discuss the most current legal issues in the field of maritime and transport law. The Committee arranges a number of sessions on developments in maritime and transport law at the annual conferences of the IBA. Frequent half-year seminars are held in the world’s maritime centres, and the Committee is also active in cooperating with other organisations in the maritime law area such as Comite Maritime International, International Maritime Organisation Legal Council, and maritime law societies in jurisdictions around the world.

What legal implications will these steps have? Landlords and tenants have a common interest here and it is fundamental to any safe and successful reopening that they work collaboratively and cooperatively.

2nd IBA Global Professional Ethics Symposium
Membership of the Forum is open to judges of all levels of court and seniority, whether exercising general or special jurisdiction, and including part-time retired judges. It is hoped that members of the IBA who have been active in its committees and constituents while in practice as lawyers will find in the Judges' Forum an additional means of maintaining their involvement after appointment or election to the Bench.
The activities of the Forum are normally concentrated on organisation of sessions at the Annual Conferences of the IBA. It has been the practice in recent years for those sessions to be co-sponsored with other IBA committees and constituents, dealing with subjects of mutual interest such as litigation, education, ethics and elimination of bias. The Forum also produces an ad hoc newsletter; contributions are encouraged.

With an escalating climate crisis and economic and geopolitical uncertainties in the background, the debate around the risks of ‘greenwashing’ is – fortunately – becoming increasingly intense. Leaving the issue of state responsibility to one side, the spotlight of the debate seems to be on both the corporate and financial sectors, as market trends, consumer demands and regulatory pressures push for an integration of sustainability criteria into business models and strategies. Without covering all aspects of greenwashing, which is a complex and multifaceted topic, this overview intends to contextualise the debate with respect to past, present and future relevant market and regulatory developments in Europe, focusing in particular on the impact on financial intermediaries. Not forgetting the bigger picture, developments in the corporate sector are also briefly analysed through the same lens. Finally, some considerations follow on the cross-border nature of the greenwashing phenomenon and on how key jurisdictions, such as the United States and United Kingdom, are reacting to such a global phenomenon.

The Laws of Sports: fast and furious or stable and reliable?
The Asset Recovery Committee, re-launched as an independent committee in 2023, provides an international platform for private and public-sector practitioners, civil society, international and regional organizations, policy makers, experts and funders to meet and discuss best practice and experience in the field of asset tracking and recovery, including asset recovery laws and orders, practical tools and techniques, know-how and case studies, from both criminal and civil law perspectives, across both civil and common law jurisdictions.
The principles of equal treatment and non-discrimination have recently been in the spotlight as social awareness has increased the need to protect specific categories of person, particularly in the workplace. Women were the first protected category against discrimination based on sex. Nowadays, whether gender reassignment can be protected through the provisions safeguarding gender discrimination is a controversial topic.
SMRs have a smaller footprint and can be built in locations where large-scale renewable installations may not be feasible. They offer a form of low-carbon energy generation that can also provide a solution for areas that lack the necessary infrastructure or transmission capacity to support renewable energy projects. This session will discuss how SMR projects are perceived in various parts of the world.
Biennial Conference of the Section on Energy, Environment, Natural Resources and Infrastructure Law (SEERIL): A transformative era of action for the law and lawyers - implementing the energy transition and global sustainability
The main areas are patents, trade marks, copyright, trade secrets and unfair competition. Allied to these are a number of related areas including data protection, database protection, privacy, design rights, domain names and the like.
In the entertainment law area the key focus is on the creation, provision and delivery of content in relation to print, films, broadcasts, cable programmes, musical works and sound recordings. There is also involvement with media law including defamation and privacy and authors' rights in a more general sense.
Continuing developments in machine learning and artificial intelligence (AI) have raised concerns that algorithms may be unfairly or even illegally biased. This session allowed participants to hear from and interact with leading specialists in the fields of machine learning and AI as they intersect with ethics and the law, in order to understand if eliminating bias in machine learning is possible or even desirable from a technical standpoint.
The Aviation Law Committee is concerned with several major areas of law. Aircraft transactions and financing are always a major interest. The Committee also follows developments of international law with respect to airlines in both economic and tort areas, and also focuses on competition issues related to aviation.
The Committee provides an opportunity not only to contribute to the development of aviation law but also to make useful contacts with aviation attorneys from all over the world. This is particularly important in an international industry such as aviation, where attorneys are required to deal with aviation attorneys in other countries on a regular basis.

The European ‘fair share’ debate is certainly one of the ‘telecommunications’ hypes of 2023, and so far has created an incredible mass of work for consultants, lobbyists and conference organisers. This subject has become an absolute priority for the largest European telcos, assuming a very important role in the digital agenda of the European Commission lead by commissioner Thierry Breton, former Chief Executive Officer of Orange, the French telecom incumbent.
Challenging the prosecution of anti-war expressions at the Russian Constitutional Court
The topics and problems covered by the Product Law and Advertising Committee are regularly part of and interlinked with bigger issues related to the international trade of goods and services in a globalised economy.
The Committee therefore deals with the legal aspects surrounding the use and safety of products, their presentation as well as advertising.
The main areas of interest are product liability, unfair competition, relevant trade regulation, product safety regulations, consumer law and advertising law. Special areas of interest include online advertising and advertising issues related to the latest technological developments.
‘This is already beyond Watergate,’ the renowned historian Simon Schama tweeted of Donald Trump’s emerging Russia scandals. As a legal matter, that grave assessment will need to be tested by a duly-constituted authority. What form that will take is subject of keen debate.
The US Government has traditionally handled similar matters in one of three ways. First, the professionals at the Justice Department investigate it themselves. Second, the DOJ appoints a ‘special counsel,’ as was the case with Watergate

Our committee advocates for using law to protect individuals and communities from poverty, promoting well-being. We believe legal professionals have a duty to create and apply law for good, preventing exploitation and mitigating harm. Although international human rights law is relatively settled on the rights of Indigenous peoples, governments around the world vary greatly in protecting and implementing these rights (including the UN Declaration on the Rights of Indigenous Peoples (UNDRIP)) into domestic legal frameworks. This session will explore whether class actions are the only remaining way to effectively protect and respect rights holders in a modern industrialised world. Shining a light on the rich jurisprudence from Latin America, and taking into account other global perspectives and experiences, this session explores the intricate relationship between Indigenous peoples, the natural environment and natural resources, the threats to their cultural heritage, and the role class actions are playing in this critical area.

Major institutional investors are taking a principled approach towards companies that provide insufficient ESG disclosures and regulators across the globe are increasingly making adequate annual ESG disclosures mandatory. The purpose of the session was to discuss emerging worldwide trends in ESG disclosure, as well as the related risks and opportunities.
The panel will discuss the current state of domain name protection and what companies need to be thinking about over the next 25 years.

The Media Law Committee focuses on sharing knowledge among members and stakeholders on legal matters related to the media industry. This includes both content and communication, which has become increasingly international due to global media networks. As media law expands beyond print, radio, and TV to new media such as e-commerce, the committee fosters cooperation with journalists and other media professionals. We regularly address legal developments through programs at the IBA Annual Conference and newsletters, reflecting the evolving nature of media law in a globalised world.

The Committee offers members access to a worldwide network of leading practitioners, in-house counsel and regulators active in digital, communications and media markets. We encourage the sharing of sectoral expertise through regular publication of articles, periodic issues of our technical journal, the annual committee conference hosted jointly with IBA Antitrust Section, and specialised sessions at the IBA Annual Conference.
The scope of the Committee’s work covers network, service and content-related developments across all delivery platforms. This provides members with access to practical global perspectives on the array of technological, commercial and policy issues which confront communications lawyers, their companies and clients.

Many lawyers feel uncomfortable with the word ‘sales’. The idea of pitching, persuading or promoting can feel unnatural. And it’s no wonder – multiple studies show that salespeople are widely perceived as untrustworthy, and lawyers aren’t rated much higher. The encouraging part, though, is that great lawyers already apply the core principles of good sales. The real shift is in mindset: moving from ‘selling’ to consultative relationship-building – something most great lawyers are already doing when supporting their clients.

The Negligence and Damages Committee has the object of providing information from a range of jurisdictions worldwide. Participants will gain practical knowledge which will enable them to deliver a better service to clients in their own jurisdiction. Equally, when consulted by clients who were injured in other jurisdictions, on ships, on aircraft or elsewhere, the committee activities provide information and networking opportunities with colleagues which will enable lawyers to undertake such cases on an international basis.
Negligence and Damages are evolving fields of law in many jurisdictions. The committee seeks to equip its members with the ability to understand and influence these changes in the legal environment.

Jurisdictions vary widely in their approaches, with some countries facing fundamental challenges. Global coordination in prosecuting and defending major cases is growing, with fostering collaboration and knowledge-sharing being vital. The Committee provides a forum for international lawyers to come together and discuss these differences, as well as network with other professionals within this space.

Increasingly, sports organisations are relying on specialised dispute resolution bodies to decide sports-related disputes. From the ad hoc tribunals at the Olympic Games and the FIFA World Cup that hear eligibility and doping disputes in real time, to the specialised sports tribunals located around the world, these sports arbitral institutions aim to resolve sports-related disputes as efficiently as possible. This session will shed light on how sports-related disputes are resolved, looking at the common features shared by sports tribunals (compared to internal dispute resolution bodies of sports federations), including as regards their independence and decision-making process.
IBA Annual Conference Mexico City 2024
The Asset Management and Investment Funds Committee provides a convenient forum for its members to consider current developments in the global investment funds industry, including both regulatory and product development. It also produces newsletters and occasional e-bulletins for its members. In addition to its programmes at the annual IBA conferences, the committee presents an annual conference on Globalisation of Investment Funds normally held in June, which celebrated its 30th successful year in 2020. The event attracts delegates from approximately 30 countries, and features presentations by senior regulators from around the world, senior executives of top fund managers and other fund service providers as well as from leading practitioners in the field.
