10th World Women Lawyers' Conference: Driving Change
The Negligence and Damages Committee has the object of providing information from a range of jurisdictions worldwide. Participants will gain practical knowledge which will enable them to deliver a better service to clients in their own jurisdiction. Equally, when consulted by clients who were injured in other jurisdictions, on ships, on aircraft or elsewhere, the committee activities provide information and networking opportunities with colleagues which will enable lawyers to undertake such cases on an international basis.
Negligence and Damages are evolving fields of law in many jurisdictions. The committee seeks to equip its members with the ability to understand and influence these changes in the legal environment.

The Norway Transparency Act, a mandatory human rights due diligence law that came into force last year, includes a right to information. While the right to information is considered a part of freedom of expression, the right has previously applied only to states. Its inclusion in the Norwegian law has led stakeholders in Norway, as well as non-governmental organisations, investors, unions and others outside of Norway, to use the law as a discovery tool to obtain specific insights into global company programmes and issue management, and how salient risks are being addressed. While we have not yet seen other national governments or the EU adopt a similar provision, it is certainly something to watch.

Chinese enterprises and individuals have increasingly become involved in cross-border investigations in relation to extraterritorial enforcement activities or other activities for which provision of information is required by foreign entities. However, under the Chinese legal framework – especially the new 2021 Data Security Law – cross-border provision of information has become increasingly difficult. The provision of such requested information to an entity in a foreign jurisdiction may conflict with mandatory Chinese laws. This article first provides an overview of Chinese legislative framework under the new Data Security Law, the Personal Information Protection Law (PIPL) – both promulgated in 2021 – and the Cybersecurity Law. It includes reference to the definitions of ‘important data’ under the 2017 draft recommended national standard ‘Guidelines for Cross-Border Data Transfer Security Assessments’ and of ‘personal information’ under the PIPL, and the latest consultation on cross-border data transfer security assessment under the Cross-border Data Transfer Security Assessment Measures (Draft for Comment) issued on 29 October 2021. By reference to different scenarios in which a Chinese company or individual may be required by a foreign entity to provide information to it, it then discusses the requirements for evaluating whether any approval from Chinese competent authorities is required, and discusses the criteria for evaluating how, if permissible, the information could be transferred in compliance with Chinese data protection legislation.
Regulators and litigators seem to be playing catch up with Big Tech and misuse of personal information as they try to reign in Big Tech's reach and power.

This article argues that advances in AI will require a fundamental shift in how competition law, particularly Article 101 TFEU, conceptualises information exchange. Drawing on cybernetics and information theory, it reframes ‘agreements’ as measurable exchanges of mutual information between systems. As AI-driven markets become black boxes, intuitions about what it means to ‘agree’ will no longer apply. Enforcement will depend on statistical analysis of machine data flows. Shannon’s concept of information as entropy will be key to how authorities develop the technology needed to detect information exchange and apply the so-called ‘Bob Test’ in a fully algorithmic marketplace.

There has never been so much attention paid to how information technology could help courts and arbitration institutions conduct cases during the Covid-19 pandemic. This is as true in China as in the rest of the world. In fact, information technology has been quietly adopted and widely used by judiciaries in many countries since the 1990s when the Netherlands judiciary set up its first platform to discuss information technology for its courts.
The session will seek to provide insight into the role of lawyers in contributing to this encroachment on global human rights of freedom of expression and access of information through pre-action demand letters, injunctions, and SLAPP suits, as well as the role of the bar, judges, and professional associations in stemming the tide of this abuse.

The Chinese data protection regime, along with extensive supplementary implementing regulations, exerts a comprehensive influence on data protection regulations with extraterritorial implications and significant impacts on companies conducting business in China, with a particular emphasis on the supervision of cross-border data transfers. Companies engaged in the processing of personal information of individuals residing within the territory of China during business operations may be subject to regulatory oversight, regardless of whether they are physically established in China.
Law firms have access to more data (referrals, contact information, opportunities, activities etc.) than ever before. However, most fail to harness that information and use it to further their business development strategy.

In the small hours of the morning of Thursday 13 June 2019, China’s Cyberspace Administration released its Measures on Security Assessment for Cross-border Transfer of Personal Information (Exposure Draft). The Measures, outlined in this article, were open for public comment until 13 July 2019.
The Taxes Committee encourages interface between international tax specialists and promotes the building of networks among tax lawyers worldwide to assist them in better serving the interests of their clients. The committee is divided informally into four practice group areas: Income Taxes, Other Taxes, Tax Litigation and Employee Benefits.

The Principles on Effective Interviewing for Investigations and Information Gathering, officially launched in June 2021, offer a solution-oriented approach to moving away from confession-based interrogations, towards rapport-based interviewing alongside the implementation of legal and procedural safeguards.
