This session will explore the complex issues surrounding assisted human reproduction. For some having a child is straightforward, the issue for them may be contraception. For others, having a child can be fraught with difficulties. Infertility is recognised by the World Health Organisation (WHO) as a disease affecting millions which also impacts their families. Assisted reproduction may bring hope, but there are often obstacles along the way ranging from the availability of fertility treatment and affordable healthcare, legal issues connected with establishing parentage and nationality, to discrimination.

The Negligence and Damages Committee has the object of providing information from a range of jurisdictions worldwide. Participants will gain practical knowledge which will enable them to deliver a better service to clients in their own jurisdiction. Equally, when consulted by clients who were injured in other jurisdictions, on ships, on aircraft or elsewhere, the committee activities provide information and networking opportunities with colleagues which will enable lawyers to undertake such cases on an international basis.

Arbitration is regulated in Brazil by means of Federal Law No 9,307, which in its original version did not expressly state the possibility of the Public Administration to elect this mechanism of dispute resolution in its contracts. This omission generated intense doctrinal and jurisprudential debates on the legality of the insertion of arbitration clauses in those contracts.

Third IBA India Litigation and ADR Symposium 2024: From fringe to focal: India at the centre of international dispute resolution
The Rule of Law Forum, established in 2007, supports IBA members in advocating for the Rule of Law, as per the 2005 Prague Resolution. Originally the Rule of Law Action Group, the Forum operates within the Section on Public and Professional Interest (SPPI). Its purpose is to assist members in responding to the IBA Council's call to support the Rule of Law in their communities. The Forum's activities are led by Co-Chairs, with Vice-Chairs assisting them. The Forum does not have formal membership but maintains a circulation list. Liaison members from other IBA committees help integrate Rule of Law into their work.

Fourth IBA India Litigation and ADR Symposium
The Leisure Industries Section started as the Travel Law Section and addressed the needs of travel law practitioners serving the travel industries. It grew to merge with the Tourism and Sports and Gaming sections expanding in its scope to provide a specialist network of professionals in the leisure industries.
The Section recognises that lawyers who work in the leisure industries often practice in one of the more traditional legal fields (aviation, property, finance, maritime, intellectual property, employment, litigation, conflict of laws, consumer law, insurance and trade law). The Section provides a focused forum on issues which emerge due to the greater amount of leisure time available and the increased internationalisation of sports and gaming.
Upon the change of office in December 2019, the new Argentine Government (the 'Government') presented a bill (which Congress passed as Law No 27,541) declaring a state of emergency in a number of areas. Among the most relevant modifications, Law No 27,541: (1) levied a new tax on access to the foreign exchange market; (2) abrogated taxation on certain financial transactions; and (3) introduced relevant amendments to the Income Tax Law and Personal Assets Tax Law.

The European Regional Forum (ERF), established in 1989, has over 8,000 members. The forum is divided into four regions - Northern, Western, Central, and Southeastern - each led by a Chair and Vice-Chair. We have five working parties - communications, D&I, ESG, mental wellbeing, and next-gen law - and we organise four conferences annually (automotive & mobility services, fashion & luxury law, ESG and start-up) in addition to many leading and participating in many smaller initiatives.

21st Annual IBA Anti-Corruption Conference
Membership of the Forum is open to judges of all levels of court and seniority, whether exercising general or special jurisdiction, and including part-time retired judges. It is hoped that members of the IBA who have been active in its committees and constituents while in practice as lawyers will find in the Judges' Forum an additional means of maintaining their involvement after appointment or election to the Bench.
The activities of the Forum are normally concentrated on organisation of sessions at the Annual Conferences of the IBA. It has been the practice in recent years for those sessions to be co-sponsored with other IBA committees and constituents, dealing with subjects of mutual interest such as litigation, education, ethics and elimination of bias. The Forum also produces an ad hoc newsletter; contributions are encouraged.

This article analyses the current regulatory trends in Argentina concerning drug pricing and market access. Based on the complex structure of the Argentine healthcare system, the strategies employed by pharmaceutical companies and healthcare payers, the existing legal frameworks and the role of institutions, such as CONETEC and CATPROS, are discussed. The article also highlights the recent initiative to create a new national health technology assessment agency (ANEFiTS), which could redefine the rules governing access, coverage and pricing in the country.
The main areas are patents, trade marks, copyright, trade secrets and unfair competition. Allied to these are a number of related areas including data protection, database protection, privacy, design rights, domain names and the like.
In the entertainment law area the key focus is on the creation, provision and delivery of content in relation to print, films, broadcasts, cable programmes, musical works and sound recordings. There is also involvement with media law including defamation and privacy and authors' rights in a more general sense.
The article examines the Competition Commission of India’s (CCI) decisional practice in cases of abuse of dominance in relation to big tech companies. The authors note that the CCI has adopted a cautious approach, and has on certain occasions expressed its reluctance in early intervention in a nascent sector. The article examines the need for the CCI to be driven by a fact-based approach in light of the jurisprudence from other mature regulators.
Balancing innovation, access, and market competition in a post-pandemic world as the USPTO reviews the link between drug pricing and exclusivity, other regions (including the European Medicines Agency (EMA), China's NMPA, and India's IPO)are also scrutinizing their pharmaceutical patent frameworks. The use of artificial intelligence (AI) in healthcare has grown exponentially, as a reflection of the accelerated pace of technological innovation that characterises this field. This fast pace of development, of which generative AI is an example, brings both benefits and risks, which translate into challenges for Brazil in regard to the process of regulating this field.
The panel will focus on new legal and business challenges in the industry. Apart from well-known issues, such as emerging Chinese electric vehicle (EV) producers, we will focus on: the challenges posed to parts of the automotive industry linked to the electrification of the automotive; the legal risks and challenges of the Functions on Demand (FoD); and the new distribution model in Europe – based upon the agency model rather than traditional dealership.

The LGBTQI+ Law Committee tracks advancements and setbacks in various areas, including discrimination, criminalisation, family rights, recognition and status, identity, among others, and considers the legal implications of cultural and socio-economic issues related to LGBTQI+ interests.
The Committee aims to promote diversity and inclusiveness in the legal profession and society at large by presenting LGBTQI+ ideals and calling attention to legal matters and developments through its sessions, publications, projects and collaborations with other IBA committees, and external parties. The Committee welcomes LGBTQI+ individuals, and all allies and encourages all persons interested in our projects to join the Committee.
The article describes and assesses the abuse of dominance investigations carried out by the Brazilian competition authorities in the digital sector. With nine cases already decided and six ongoing probes as of July 2019, there is a clear concern about false positives and avoidance of severe intervention, and no precise guidance on how companies should behave. The research also reveals interesting findings such as the importance of third parties, areas of concern and the inexistence of convictions.
IBA Asset Recovery Conference
The Aviation Law Committee is concerned with several major areas of law. Aircraft transactions and financing are always a major interest. The Committee also follows developments of international law with respect to airlines in both economic and tort areas, and also focuses on competition issues related to aviation.
The Committee provides an opportunity not only to contribute to the development of aviation law but also to make useful contacts with aviation attorneys from all over the world. This is particularly important in an international industry such as aviation, where attorneys are required to deal with aviation attorneys in other countries on a regular basis.

As of now, it makes no sense to calculate the exact cost of damages inflicted by the aggression of the Russian Federation: every day brings millions, and sometimes even dozens of millions of dollars in material damages, along with non-material losses that cannot yet be accurately measured. It also makes no sense to rely on voluntary compensation from the Russian Federation. Therefore, under these circumstances, the only realistic source of funding to compensate Ukraine for the damage caused by aggression is frozen Russian assets. Over the last year and a half, the subject of their confiscation has been widely discussed, but progress has been more than modest.

Through the various Vision 2030 programmes, Saudi Arabia seeks to introduce new strategies to fulfil public health needs through insurance-based financing and increasing private sector participation.
It is one of the fastest growing economies in the world and, after many years of discussion, there appears to be some progress on ‘liberalisation’ – allowing foreign lawyers to carry on some form of legal work in India.

A summary of the 2019 IBAHRI activities in Kazakhstan.
Richard Aronowitz is Global Head of Restitution at Christie’s and a member of the UK government's Advisory Group on Spoliation Matters. He began his career in the art world as a furniture porter at Bonhams in 1993, then joined Sotheby’s as an Impressionist and Modern art specialist in 1997, before leaving to become Director of the Ben Uri Gallery in 2003. He re-joined Sotheby’s as European Head of Restitution in 2006, then Christie’s in March 2022 as Global Head of Restitution.
Richard is the author of the novels Five Amber Beads; It’s Just the Beating of my Heart; An American Decade; and Night Comes Down (forthcoming from Guernica Editions in 2025), as well as a book of poetry: Life Lessons .
2nd Annual IBA Asset Recovery Conference
The Arab Regional Forum provides lawyers active in, or with an interest in the region, with a means to establish contact and exchange information with each other. A particular focus of interest is the continuing economic importance of the region, including reconstruction and investment projects following peace initiatives.
