In international arbitration, litigants commonly come from very different legal systems. When a French company retains counsel in the United States to initiate an international arbitration against a government or company in Asia, what evidentiary and procedural rules should govern the parties’ dispute? Most commonly, the answer is the Rules on the Taking of Evidence in International Arbitration, issued by the International Bar Association (IBA).

In addition to reviewing the current legal position in different countries from a comparative perspective, the committee also examines international and supranational instruments, such as the United Nations Convention on the International Sale of Goods, Incoterms and the Uniform Customs and Practice for Documentary Credits and relevant instruments of the European Union and Mercosur.
The Committee also focuses on law reform in the fields of law within its scope, and since 1997 has monitored and offered suggestions in connection with the proposed Hague Convention on International Jurisdiction and the Effects of Foreign judgments in Civil and Commercial Matters.

Anxieties regarding health and fitness related issues have mostly proved unfounded - the success of the event/mini tournament is a testament to the commitment, languages, enthusiasm, endeavours and differing playing styles of those who have in recent years graced the stadia of Buenos Aires, Madrid, Dublin, Vienna, Washington, Sydney, and Seoul. Pretty it may not be and careers as professional footballers a complete historical fantasy, but our annual event generates huge interest, passion and most importantly friendship between all the players and many spectators who come to cheer us on. The venue will be confirmed shortly but kick off will be between 1600 and 1630.

The 2020 review of the IBA Rules on the Taking of Evidence in International Arbitration applied the ‘if it ain’t broke, don’t fix it’ maxim. The existing rules had achieved a successful balance between civil and common law traditions, as reflected in the 2016 IBA report on the reception of the IBA arbitration soft law products. This meant that only minor changes were required, mainly to adjust the rules to new and already widely accepted trends in international arbitration, and to take into account the technological challenges facing the arbitration community.
Confidentiality is often described as one of the key reasons parties choose to resolve disputes through international arbitration.

Hon Justice Ayotunde Phillips was appointed the 14th Chief Judge of Lagos State in 2012 and retired from the position in June 2014. A year on she talks to the IBA about her time as a judge, the evolution of the judiciary and the significant role of women in the country’s judicial system. She speaks about the outlook for Nigeria’s judiciary and the challenges it continues to face.
This session will examine the issues impacting global supply chains in terms of conflict both in trade as well as on the actual battlefield, the trend towards regional blocs and “near” or “friend” shoring, and discuss solutions to assist global business operations.

The first issue of the IBAHRI Covid-19 Human Rights Monitor assesses gender-based violence and women’s health, LGBTQI+ rights, prison and detention conditions, refugee camps and asylum procedures. Concerns are raised over reported increases in domestic violence in a number of jurisdictions and the lack of basic protective measures to prevent the spread of Covid-19 in prisons and detention centres.
The Maritime and Transport Law Committee is one of the oldest and most established committees of the IBA, with more than 650 members worldwide.The Committee is a platform where leading maritime law professionals meet, create connections and discuss the most current legal issues in the field of maritime and transport law. The Negligence and Damages Committee has the object of providing information from a range of jurisdictions worldwide. The Taxes Committee encourages interface between international tax specialists and promotes the building of networks among tax lawyers worldwide to assist them in better serving the interests of their clients. Over the years, there has been an issue on the validity and enforceability of non-compete clauses in employment contracts in Nigeria. The traditional and longstanding view is that these clauses restrict the employees fundamental rights including the employees’ right to freedom of association and right to earn a living, thereby impacting on their right to have a quality life. One of the effects of this, is that, it stifles mobility of labour and restricts the employee’s right to work. There is, however, a growing recognition that non-compete clauses may serve to protect the legitimate and reasonable investment of employers. The question, however, remains as to the factors to be considered in determining the reasonability of the non-compete clause.
