Indian courts have adopted a novel and commercially pragmatic approach in ordering recalcitrant debtors to deposit money as security in aid of a claim in arbitration where there are clear admissions of liability or their defence is moonshine.
The Women Lawyers’ Committee (WLC) aspires to empower its 3000 highly valued members from all over the world to engage, network and share knowledge. The committee was originally an interest group which was introduced as an IBA constituent in 1996 to allow efficient global networking of women lawyers.
WLC aims to level the playing field in the legal profession and inspire leaders to work to achieve gender parity. It's 20 committee officers create awareness tools to help the profession achieve this goal, while at the same time facilitate an efficient global network for women lawyers to connect and develop business and expertise, supported by its Advisory board.
We welcome members with all genders and encourage all perspectives and remain a committee dedicated to the cause of women lawyers.

In Austria, using SAFEs as an instrument for early-stage financing is still quite novel. Therefore, the Austrian startup-finance ecosystem does not yet have standard form documents.

The International Commerce and Distribution Committee examines legal issues fundamental to the growth and development of international commerce.
The Committee deals extensively with issues relating to international sales contracts, agency and distribution, cross-border acquisitions, warranties and financing of international sales.
In addition to reviewing the current legal position in different countries from a comparative perspective, the committee also examines international and supranational instruments, such as the United Nations Convention on the International Sale of Goods, Incoterms and the Uniform Customs and Practice for Documentary Credits and relevant instruments of the European Union and Mercosur.
The Committee also focuses on law reform in the fields of law within its scope, and since 1997 has monitored and offered suggestions in connection with the proposed Hague Convention on International Jurisdiction and the Effects of Foreign judgments in Civil and Commercial Matters.

Simple agreements for future equity (SAFEs) are financing instruments that may be used to raise capital in seed financing rounds. Generally, such financing instruments are viewed as a more founder-friendly alternative to convertible notes on an international level. A SAFE is an investment agreement that gives the investor the right to receive equity of the company under certain circumstances. In 2013, the American startup accelerator Y Combinator introduced the first SAFE, which was based on a pre-money valuation. However, in 2018, Y Combinator amended the form of the SAFE to be based on a post-money valuation. SAFEs or SAFE-like instruments are used in many jurisdictions, such as Austria, Germany, Italy, Norway, Sweden and the United Kingdom. However, this article describes the most relevant aspects of SAFEs from a United States, UK, Austrian and Swedish law perspective. Further, it elaborates on the most frequently used types of seed financing instruments as an alternative to SAFEs in the relevant jurisdictions, including convertible notes (also referred to as convertible promissory notes or convertible loans).

The Negligence and Damages Committee has the object of providing information from a range of jurisdictions worldwide. Participants will gain practical knowledge which will enable them to deliver a better service to clients in their own jurisdiction. Equally, when consulted by clients who were injured in other jurisdictions, on ships, on aircraft or elsewhere, the committee activities provide information and networking opportunities with colleagues which will enable lawyers to undertake such cases on an international basis.

On 1 July 2019, the IBAHRI, Lawyers’ Rights Watch Canada and Lawyers for Lawyers delivered an oral statement during the 41st UN Human Rights Council session concerning attacks against lawyers in China, Philippines, Saudi Arabia and Turkey. The statement urged the Council to insist that these States halt the violations and uphold human rights or face suspension from membership. It also called for the establishment of an independent investigation into human rights violations in the Philippines.

Biennial IBA Latin American Regional Forum conference
The Rule of Law Forum, established in 2007, supports IBA members in advocating for the Rule of Law, as per the 2005 Prague Resolution. Originally the Rule of Law Action Group, the Forum operates within the Section on Public and Professional Interest (SPPI). Its purpose is to assist members in responding to the IBA Council's call to support the Rule of Law in their communities. The Forum's activities are led by Co-Chairs, with Vice-Chairs assisting them. The Forum does not have formal membership but maintains a circulation list. Liaison members from other IBA committees help integrate Rule of Law into their work.

31st Annual IBA Global Insolvency and Restructuring Conference
The European Regional Forum (ERF), established in 1989, has over 8,000 members. The forum is divided into four regions - Northern, Western, Central, and Southeastern - each led by a Chair and Vice-Chair. We have five working parties - communications, D&I, ESG, mental wellbeing, and next-gen law - and we organise four conferences annually (automotive & mobility services, fashion & luxury law, ESG and start-up) in addition to many leading and participating in many smaller initiatives.
Our goals include: addressing the needs of professional organisations and individual members, increasing participation in the IBA, fostering cross-border collaboration among European lawyers and bars and supporting the Rule of Law and civil society. The ERF promotes professional development and networking opportunities through our many initiatives.
The Third Report by the High Level Panel of Legal Experts on Media Freedom
Membership of the Forum is open to judges of all levels of court and seniority, whether exercising general or special jurisdiction, and including part-time retired judges. It is hoped that members of the IBA who have been active in its committees and constituents while in practice as lawyers will find in the Judges' Forum an additional means of maintaining their involvement after appointment or election to the Bench.
The activities of the Forum are normally concentrated on organisation of sessions at the Annual Conferences of the IBA. It has been the practice in recent years for those sessions to be co-sponsored with other IBA committees and constituents, dealing with subjects of mutual interest such as litigation, education, ethics and elimination of bias. The Forum also produces an ad hoc newsletter; contributions are encouraged.

A United Kingdom parliamentary committee has warned that the country’s lawyers ‘may become unable to operate in the EU’ under UK-specific limited liability partnership (LLP) structures if a Brexit agreement with the European Union is not reached.

This article examines how deepfakes – AI-generated or manipulated audio, image, and video – destabilise evidentiary assessment in arbitration. Beyond the risk of convincingly falsified exhibits, deepfakes fuel the ‘liar’s dividend,’ whereby the mere possibility of manipulation is invoked to discredit authentic proof. Detection remains technically challenging, costly, and unevenly accessible – especially for mid- and small-value cases. Drawing on recent litigation experience, the EU AI Act’s transparency framework, and broader evidentiary principles, the article highlights how these difficulties risk undermining fairness, efficiency, and equality of arms. After a brief technical primer on deepfakes and their detection limits, the discussion distills lessons from court cases (including the emergence of the ‘deepfake defence’) and evaluates arbitration’s current evidentiary toolbox, highlighting risks of chilling effects and cost inflation if authenticity burdens are misplaced. While arbitration is not without safeguards – party autonomy, due process, procedural loyalty, ethical duties, and soft-law instruments – the article questions whether these tools are sufficient in practice. The contribution is ultimately pragmatic: safeguard fair and efficient truth-finding by reinforcing proportional verification, targeted expert input, and principled tribunal case management – so that access to justice is preserved when seeing is no longer believing.
Many jurisdictions have ample experience with such public consultation processes, whether in the context of mining or nuclear projects, for example.

The Aviation Law Committee is concerned with several major areas of law. Aircraft transactions and financing are always a major interest. The Committee also follows developments of international law with respect to airlines in both economic and tort areas, and also focuses on competition issues related to aviation.
The Committee provides an opportunity not only to contribute to the development of aviation law but also to make useful contacts with aviation attorneys from all over the world. This is particularly important in an international industry such as aviation, where attorneys are required to deal with aviation attorneys in other countries on a regular basis.
Human rights and nuclear legacy in the Marshall Islands
The Taxes Committee encourages interface between international tax specialists and promotes the building of networks among tax lawyers worldwide to assist them in better serving the interests of their clients. The committee is divided informally into four practice group areas: Income Taxes, Other Taxes, Tax Litigation and Employee Benefits.
Members are encouraged to contribute to the committee newsletter which is published two to three times per year and to present papers at committee conferences and seminars. The session will explore the new shift in business and supply chains from globalisation to regionalisation, the phenomenon known as nearshoring. Panelists from North-America will comment on aspects of this shift to regionalisation, examine various legal and practical issues presented by nearshoring, particularly as they relate to North America, and provide insights on the role of lawyers in connection with those issues.

Bill of Law No. 7,082/2017 promises to change the regulatory framework for clinical research in Brazil, if approved under the proposed terms by the Congress. Many changes relate to a potential decrease in bureaucracy in the ethical and regulatory approval procedures, as a way to stimulate more interest from the industry to sponsor studies.

The Anti-Corruption Law was first regulated, at the federal level, by Decree No 8,420 of 18 March 2015. On 12 July 2022, more than seven years later, Federal Decree No 11,129 of 11 July 2022, which regulates Anti-Corruption Law and repeals Decree No. 8,420/2015, was published by the Brazilian government. This article provides a detailed overview of the new Decree.
The collective effect of these attacks has been to undermine public confidence in the democratic system and elections, waste countless hours of time and resources on recounts and investigations, discourage responsible and fair-minded people from serving as workers and officials in the election process, and suppress the votes to gain political advantage.
