As media law expands beyond print, radio, and TV to new media such as e-commerce, the committee fosters cooperation with journalists and other media professionals. We regularly address legal developments through programs at the IBA Annual Conference and newsletters, reflecting the evolving nature of media law in a globalised world.

The Asset Management and Investment Funds Committee provides a convenient forum for its members to consider current developments in the global investment funds industry, including both regulatory and product development. It also produces newsletters and occasional e-bulletins for its members. In addition to its programmes at the annual IBA conferences, the committee presents an annual conference on Globalisation of Investment Funds normally held in June, which celebrated its 30th successful year in 2020. The event attracts delegates from approximately 30 countries, and features presentations by senior regulators from around the world, senior executives of top fund managers and other fund service providers as well as from leading practitioners in the field.

Online or e-dispute resolution has long been a beneficial option for resolving business disagreements, even before the spread of Covid-19. With the current disruption and bans on travel and meetings in many countries, using remote mediation means that companies still have a means of solving problems and moving their businesses on. The positive experience of e-dispute resolution is such that it is likely to remain long after the pandemic has gone.

The Committee plans to publish a regular newsletter and is seeking an editor, along with volunteers, particularly from outside Canada. The pharmaceutical supply chain in India has traditionally relied on small neighbourhood pharmacies for last-mile distribution. Such pharmacies have proliferated to the point where there is often one on each street, and several within a square mile, in every city. Access to brick-and-mortar pharmacies has therefore generally not been a problem in India, at least in most urban areas, and the industry has prospered over the years.

Twice a year, Florida State University and the International Bar Association offer the exciting opportunity to participate in a ground-breaking, distance learning, international law course. The application process included a 500-1000 word essay on what applicants currently consider to be the most pressing concern in International Human Rights Law. There was no right answer to this question, and we encouraged students to select a topic based on their current experience and interests.

This article examines the regulatory framework in Ukraine for the electronic communications sector, established by the Law on Electronic Communications and its primary goal of achieving harmonisation with European Union legislation. It highlights the key regulatory pillars applicable to the sector, including the principles of general authorisation for market entry, radio frequency spectrum management and enhanced end-user rights. The article also addresses the special regulatory regime under martial law, the sanctions framework and key future developments aimed at the market’s continued evolution.

The International Bar Association (IBA) Legal Policy & Research Unit (LPRU) has released the next episode in its Inspirational Legal Women podcast. It features Alessandra Nascimento Silva e Figueiredo Mourão, founding partner of Nascimento e Mourão Advogados in São Paulo, Brazil.
The Women Lawyers’ Committee (WLC) aspires to empower its 3000 highly valued members from all over the world to engage, network and share knowledge. The committee was originally an interest group which was introduced as an IBA constituent in 1996 to allow efficient global networking of women lawyers.
WLC aims to level the playing field in the legal profession and inspire leaders to work to achieve gender parity. It's 20 committee officers create awareness tools to help the profession achieve this goal, while at the same time facilitate an efficient global network for women lawyers to connect and develop business and expertise, supported by its Advisory board.

Japan has finally started to make tangible progress in regard to reforming its value-added tax (VAT) framework to address the challenges brought about by the rapid expansion of cross-border e-commerce. Ongoing discussions are focused in particular on expanding the platform taxation regime to cover the cross-border sale of goods facilitated by online platforms offering fulfilment services, as well as on revising the de minimis import VAT exemption for low-value imported goods.

The borderless nature of the digital economy and electronic transactions has always been a challenge for law makers and enforcement bodies where their authority is generally limited to a jurisdictional territory. In this article, we discuss three recent developments of the Thai governmental authorities trying to tackle these challenges: VAT on overseas e-service providers; criminal complaints against an overseas cryptocurrency trading platform; and a draft royal decree regulating e-commerce platforms.

Legislation tackling modern slavery is clearly spreading around the world, placing varying obligations on companies over a certain threshold (and individuals within companies) to report, disclose, mitigate, and remediate risks and instances of modern slavery in local and complex domestic and global supply and value chains. This legislation targets medium to large companies as they are often the producer of goods and services tainted by human rights violations, with penalties for breaches and failure to notify.

The law on e-transactions in Vietnam was recently amended in 2023. In this article we have analysed seven outstanding regulations in the amendment, namely: the scope of applications; data and data message; e-certificates; the use of e-signature and trust services; legal framework for applying e-contracts; synchronising the rights and obligations of the owner of the information system and the use of e-transaction accounts; and regulations on data collection, management and sharing among state agencies.
Digital nomads are on the rise and in order to benefit from this new phenomenon, companies need to address the many associated challenges: employment law, visa issues, taxation, etc. The session aims to give useful insights from all of these view angles and to shed light on this somehow untangible phenomenon.

On May 4, 2023, the IBA’s Litigation Committee held an interactive session which touched on various topics involving e-commerce. The panel was chaired by Andreas Frischknecht of Chaffetz Lindsey acting as moderator along with experts from different jurisdictions, namely Karina Goldberg (Attorney-at-law, Ferro Castro Neves Daltro & Gomide Advogados, São Paulo), Antoine Laniez (Attorney-at-law, NautaDutilh, Luxembourg City), Francisco Javier Muñoz (Legal counsel, Mercado Libre, Buenos Aires) and Lucinda Orr (an employed barrister with Enyo Law, London).
Formed in 2005, the Senior Lawyers Committee represents senior lawyers and has received interest from younger IBA members eager to learn from their experience. The Committee aims to combat age discrimination, promote mentorship, and facilitate global networking. The Committee organises sessions and social events, often in collaboration with other IBA committees, focusing on how senior lawyers' expertise can benefit the profession. Recent topics include discrimination, career progression, and mentorship. The Committee also helps senior lawyers find roles where they can share their experience, including in sustainable development projects through IBA member organisations.

With the pandemic hitting hard, online shopping has become the new normal. The pandemic accelerated the shift towards a more digital world and fuelled e-commerce growth, not just on a business-to-consumer basis but on a consumer-to-consumer basis as goods and services become more ‘fluid’ and transactions become less territorial. This article considers the hazards of using e-commerce platforms for various transactions.
Metaverse is growing exponentially with increasing support from investors and business entities. It provides real-life experiences in a simulated environment with unmatched potential for entertainment and earnings, which can be divided into two sorts of platforms in general. The first involves leveraging nonfungible tokens (NFTs) and cryptocurrencies to create blockchain-based metaverse startups. People can buy virtual products and create their own settings on web platforms. The second group uses the metaverse to describe virtual worlds in general, where people might meet for business or enjoyment. In addition, an array of technology solutions for closing contracts and solving disputes is available with the blockchain technology.
These activities trigger a number of legal issues, as for instance the applicable law, securities issues, NFTs and crypto currency regulations, IP enforcement and brand protection, tax issues, contract and tort laws, defamations laws and dispute resolution procedures.

Telemedicine, despite being used in practice, was not explicitly and specifically addressed in Czech law. However, new legislation to introduce the concept of telemedicine into the Czech legal framework is now on the horizon.
The Pro Bono Committee promotes pro bono legal services globally, through the IBA Pro Bono Declaration, the exchange of information and initiatives, and by promoting best practices.
Pro bono work supports access to justice where this right is not fully supported by legal aid. The Committee provides resources, including digital content and articles highlighting pro bono efforts by legal professionals, which can be found below.
