Young Lawyers Private Equity Forum 2024
The Asset Management and Investment Funds Committee provides a convenient forum for its members to consider current developments in the global investment funds industry, including both regulatory and product development. It also produces newsletters and occasional e-bulletins for its members. In addition to its programmes at the annual IBA conferences, the committee presents an annual conference on Globalisation of Investment Funds normally held in June, which celebrated its 30th successful year in 2020. The event attracts delegates from approximately 30 countries, and features presentations by senior regulators from around the world, senior executives of top fund managers and other fund service providers as well as from leading practitioners in the field.
In 2020, most of the world’s countries have had to respond to the severe disruption caused by the Covid-19 pandemic, which emerged in late December 2019 (the ‘pandemic’). The pandemic poses enormous health and socio-economic challenges. As of September 2020, it is not known when the pandemic will end; some countries are already experiencing further waves of infection. Globally, judiciaries and arbitral institutions have been under great pressure to continue operating during the pandemic [...]
Continuing our theme of helping law firms look into the future, Jonathan will provide six predictions of what is going to happen to law firms in the not too distant future and, more importantly, what they should be doing to best prepare for that future.
Building the Law Firm of the Future
Membership of the Forum is open to judges of all levels of court and seniority, whether exercising general or special jurisdiction, and including part-time retired judges. It is hoped that members of the IBA who have been active in its committees and constituents while in practice as lawyers will find in the Judges' Forum an additional means of maintaining their involvement after appointment or election to the Bench.
The activities of the Forum are normally concentrated on organisation of sessions at the Annual Conferences of the IBA. It has been the practice in recent years for those sessions to be co-sponsored with other IBA committees and constituents, dealing with subjects of mutual interest such as litigation, education, ethics and elimination of bias. The Forum also produces an ad hoc newsletter; contributions are encouraged.
In the run-up to the latest round of votes on the UK’s Brexit deal, the Attorney-General Geoffrey Cox QC, MP, was once again pivotal – his advice on the implications of legal assurances from the EU regarding the backstop were central to the debate. But many have brought up the dangers inherent in the role, asking whether ministerial responsibilities have a conflict with legal advice responsibilities.
This session seeks to explore recent regulatory and enforcement trends in various markets around the world for securities law violations. Specifically, the panellists will discuss regulatory focus and recent developments, enforcement cases and securities litigation as well as trends in penalties or damages in recent years.
5th Asia-based International Financial Law Conference
The Oil and Gas Law Committee focuses on issues such as: exploration and production of hydrocarbons, onshore and offshore oil and gas, joint Operating Agreements and industry contracts, financing and insurance, comparative tax regimes, state participation and national oil companies, trans-national pipelines, storage, and refining, sales and shipping agreements, alternative dispute resolutions, licensing, PSA, and other regimes, downstream issues, oil and gas trade and marketing, natural gas transportation and distribution, LNG chain and hydrocarbon regulatory bodies and agencies.
In June, the UK Parliament’s Women and Equalities Committee published a report revealing how employers across numerous sectors have historically used non-disclosure agreements to cover up ‘unlawful discrimination and harassment’.
The furore surrounding NDAs and their role in silencing victims first arose in 2017 after it was alleged that film producer Harvey Weinstein had repeatedly used these agreements to prevent individuals from reporting allegations of sexual misconduct against him.
To uphold the rule of law, justice must be available to all. In countries with no affordable access to justice, many sections of society are denied any real form of justice, which particularly impacts women, children and the poor. What can society do to ensure justice is available to all and what is the role of lawyers in this issue?
IBA Annual Conference Mexico City 2024
The Diversity and Equality Law Committee includes private practitioners, in-house attorneys, and academics working with corporate clients on issues like pay equity, anti-discrimination, and LGBTQ+ rights. Members come from leading law firms, corporations, and various perspectives. The Committee publishes an annual newsletter highlighting new developments and issues of interest. The Committee also comprises the Disability Rights Working Group, focused on disabled individuals' rights in the workplace. Equality before the Law – bar perspectives on the impact of the Covid-19 pandemic. As most of us return to some sort of business as usual post Covid-19, it is important to reflect on, and continue to think about the effects of the pandemic on equality, diversity and inclusion. Eighteen months after Myanmar’s military seized control and arrested then-leader Aung San Suu Kyi, alongside other members of the democratically-elected National Unity Government (NUG), the international community grapples with how to treat the country. As things stand, there’s no sign of an end to the junta’s bloody and contentious rule.
Most commonly, the answer is the Rules on the Taking of Evidence in International Arbitration, issued by the International Bar Association (IBA). The IBA Rules on the Taking of Evidence provides parties and arbitral tribunals from diverse legal backgrounds with uniform guidelines that seek to harmonise evidentiary and procedural principles of both civil law and common law jurisdictions so that the taking of evidence is fair, economical, and efficient.

The International Commerce and Distribution Committee examines legal issues fundamental to the growth and development of international commerce.
The Committee deals extensively with issues relating to international sales contracts, agency and distribution, cross-border acquisitions, warranties and financing of international sales.
In addition to reviewing the current legal position in different countries from a comparative perspective, the committee also examines international and supranational instruments, such as the United Nations Convention on the International Sale of Goods, Incoterms and the Uniform Customs and Practice for Documentary Credits and relevant instruments of the European Union and Mercosur.
The Committee also focuses on law reform in the fields of law within its scope, and since 1997 has monitored and offered suggestions in connection with the proposed Hague Convention on International Jurisdiction and the Effects of Foreign judgments in Civil and Commercial Matters.

The Covid-19 pandemic has seen a surge in gender-based violence, which, along with the Black Lives Matter protests, is forcing a re-evaluation of how justice is delivered. Court processes need to be reimagined, but, to really move forward, biases in legal systems must be addressed.

How are State Parties’ corruption claims being treated by other State Parties’ courts worldwide? Has progress stalled?
This panel will discuss asset recovery flops and triumphs. Is Article 53 of the UN Convention against Corruption (UNCAC) being implemented in a sensible way worldwide? Is it still impossible for many jurisdictions to litigate their losses? It was Latin America’s most hotly contested run-off for decades. Former Brazilian President Luiz Inácio Lula da Silva defeated the incumbent Jair Bolsonaro in the second round at the end of October, winning 50.9 per cent of the vote compared with Bolsonaro’s 49.1 per cent.
There is rightly a focus on India at the moment. It is one of the fastest growing economies in the world and after many years of discussion there appears to be some progress on “liberalisation” – allowing foreign lawyers to carry on some form of legal work in India.

The first months of implementing Anvisa’s RDC 839/2023, which updated the regulatory framework for novel foods and ingredients in Brazil, have already brought some practical challenges for the food industry. For example, the Resolution introduced proactive transparency measures by Anvisa, reinforcing and recognising the confidentiality of the dossiers and exclusivity for companies that can demonstrate that the approvals rely on trade secrets. The purpose of this article is to briefly set out some of the progress and challenges experienced so far, providing insights into expectations for 2025.

The Negligence and Damages Committee has the object of providing information from a range of jurisdictions worldwide. The Aviation Law Committee is concerned with several major areas of law. Aircraft transactions and financing are always a major interest. The Committee also follows developments of international law with respect to airlines in both economic and tort areas, and also focuses on competition issues related to aviation.
The Committee provides an opportunity not only to contribute to the development of aviation law but also to make useful contacts with aviation attorneys from all over the world. This is particularly important in an international industry such as aviation, where attorneys are required to deal with aviation attorneys in other countries on a regular basis.
The International Bar Association’s Human Rights Institute (IBAHRI) and the Anti-Torture Initiative (ATI) express great concern and condemnation for the decision by the Brazilian government to severely limit the work of Brazil’s National Preventive Mechanism (NPM), dangerously reducing protections for individuals deprived of their liberty.

The Business Human Rights (BHR) Committee creates awareness of business and human rights and broader corporate sustainability principles. Preventing and addressing business-related human rights risks is key to ethical business, good governance and increasingly legal compliance for businesses including law firms.
The UN Guiding Principles on Business and Human Rights, as the core international standard, provide guidance on governments’ duty to protect against human rights harm by business; business’ responsibility to respect human rights; and access to remedy for business-related human rights harm.
The BHR Committee promotes legal skills to advise clients in this area and facilitates dialogue among lawyers to support evolution.

The interpretation and impact of EU tax directives on Member State national laws is a fairly new element in the discussions with national tax authorities in the EU, for example, discussions concerning the granting of an exemption that is based on an EU tax directive. In order to interpret the national laws that transpose EU tax directives, one needs to look beyond the national laws themselves. It is necessary to analyse the meaning of the EU tax directive in question. It is important to ascertain what exactly is the obligation on Member States and what is the meaning of certain terms in the EU tax directive that has been transposed into national law? These types of questions relate to the interpretation of EU tax directives and are increasingly relevant for all EU Member States. Moreover, the specific EU tax directive and the context in which it was developed has an impact on the interpretation of the national laws of a particular Member State. These aspects are discussed in this article.
The International Franchising Committee focuses on the law and business of international franchising. Committee interests include: competition law principles, cross-border sales and licensing issues, the business forms employed and trademark and intellectual property protections required to assure franchising success.
The Committee has served and continues to play an educational role for the legal profession, judiciary and legislators, and enables members to examine and comment upon legislative and regulatory proposals affecting international franchising.
