Bullying and Sexual Harassment in the Legal Profession, the International Bar Association (IBA) Legal Policy & Research Unit (LPRU) continues to prioritise and drive positive change within legal workplaces across the globe, with the publication of a thought-provoking discussion paper on ‘Trust Tech’ – technology that enhances and propagates trust in professional settings.
Join us for an insightful discussion into law firm culture, focusing on issues such as bullying and sexual harassment and gender parity. The panel will consider how failing to make these issues a top priority impedes the career progression of women.

Originally constituted following the introduction of multidisciplinary practices (MDPs), the ANLBS exists today as an event driven forum to explore and stay apprised of the legal, regulatory and technological developments impacting how legal services are provided across the globe. Whether driven by regulatory reforms, market trends or technological changes, the ANLBS is focused on exploring the ever changing ways lawyers provide legal services.
The IBA's LPRU has published a report on the nature and prevalence of bullying and sexual harassment in the legal profession around the world, based on the findings of its extensive 2018 survey on the subject. It offers both observations and recommendations for action. The IBA hopes that the report will encourage law firms to revisit their policies and training for responding to and preventing bullying and harassment.
Addressing bullying, harassment and discrimination in the legal profession - a view from the regulatory perch
The panel will cover issues such as: how to recognise LGBTQI+ family units in the context of refugee status, migration and family reunification; the challenges involved in placement and housing of LGBTQI+ refugees and migrants; how to achieve positive integration outcomes for LGBTQI+ refugees in the resettlement country; and LGBTQI+ specific healthcare issues in the migration context, including mental health issues.

The Negligence and Damages Committee has the object of providing information from a range of jurisdictions worldwide. Participants will gain practical knowledge which will enable them to deliver a better service to clients in their own jurisdiction. Equally, when consulted by clients who were injured in other jurisdictions, on ships, on aircraft or elsewhere, the committee activities provide information and networking opportunities with colleagues which will enable lawyers to undertake such cases on an international basis.
Negligence and Damages are evolving fields of law in many jurisdictions. The committee seeks to equip its members with the ability to understand and influence these changes in the legal environment.

The International Bar Association (IBA) has published a Spanish translation of its landmark bullying and sexual harassment report. The Spanish translation of Us Too? Bullying and Sexual Harassment in the Legal Profession will be officially launched in Madrid on Wednesday 22 January at a roundtable event hosted by the IBA in collaboration with the General Council of Spanish Lawyers.
The Maritime and Transport Law Committee is one of the oldest and most established committees of the IBA, with more than 650 members worldwide.The Committee is a platform where leading maritime law professionals meet, create connections and discuss the most current legal issues in the field of maritime and transport law. The Committee arranges a number of sessions on developments in maritime and transport law at the annual conferences of the IBA. Frequent half-year seminars are held in the world’s maritime centres, and the Committee is also active in cooperating with other organisations in the maritime law area such as Comite Maritime International, International Maritime Organisation Legal Council, and maritime law societies in jurisdictions around the world.

At the proposal of the Diversity and Inclusion Council, at the start of 2024 the IBA launched an online Coassemble diversity and inclusion training programme and encouraged all Officers to use it as a means of gaining a practical understanding of how unconscious bias compromises the way we interact with others. The Diversity and Inclusion Council also supported and assisted the IBA European Region Forum to launch a Diversity and Inclusion (D&I) Toolkit to assist law firms in similar endeavours.

IBA Global Insight June/July 2019: Global Insight assesses the extent of the issue and analyses the causes as well as what needs to change
The attendees are invited to read the materials in advance, to acquaint themselves with the case and thus follow the seminar more effectively.
The session will start with the panel (formed of experts in damage valuation and barristers/lawyers) conducting a mock cross-examination of expert witnesses, before providing advice on the dos and don’ts and discussing differences between expert witness examination methods in different jurisdictions.
Subsequently, the audience will decide which was the most effective way of proceeding and will have the chance to participate in a Q&A session with the panel.
The session will be a great opportunity for young lawyers and law students to learn from seasoned professionals and to get acquainted with the difficult art of expert cross-examination.

The Diversity and Equality Law Committee includes private practitioners, in-house attorneys, and academics working with corporate clients on issues like pay equity, anti-discrimination, and LGBTQ+ rights. Members come from leading law firms, corporations, and various perspectives. The Committee publishes an annual newsletter highlighting new developments and issues of interest. The Committee also comprises the Disability Rights Working Group, focused on disabled individuals' rights in the workplace. The Committee collaborates with the Employment and Industrial Relations Law Committee, the Immigration and Nationality Law Committee , and the Global Employment Institute.

Tackling workplace harassment, particularly sexual harassment, remains a significant priority for the UK government, driven by persistent cultural issues and high-profile cases across a variety of sectors. Legislative developments in the last year coupled with upcoming provisions contained in the Employment Rights Bill (ERB) (a very significant new piece of legislation containing a wide range of new employment rights which is currently working its way through the UK Parliament), mean employers are having to reassess and adapt their approach to managing harassment in the workplace.
The panel will cover the steps employers should take to manage psychological risk including risks arising from the workplace environment, bullying and sexual harassment and what regulators around the globe are doing to enforce breaches. This will include a mock regulator interview and highlight some of the questions and issues being investigated by regulators. This panel will also cover recent developments in psychosocial legal duties and ESG reporting and outline interesting cases from different jurisdictions where employers have been prosecuted for a failure to properly manage psychological risk.

The Forum for Barristers and Advocates represents Bar Associations whose members practice as independent referral practitioners in jurisdictions with a divided legal profession. Formed by Bar Leaders, the Forum advocates for the principles of independent advocacy within the IBA. The Forum addresses the importance of advocate and judiciary independence, ethical conduct, and training. The Forum supports human rights and collaborates with the Judges' Forum and other committees on litigation and trial topics. The Forum’s inaugural members include Bar Associations from England and Wales, Scotland, Ireland, South Africa, Australia, and Hong Kong, representing over 16,000 barristers and advocates. Membership is open to bar associations which are full or supporting members of the IBA, and to individual members of any Divisions.

The Immigration and Nationality Law Committee is concerned with all aspects of immigration and nationality law on a worldwide basis, including business-related immigration, family reunion policies, refugees and compassionate cases.
The Committee aims to provide a forum for the discussion of comparative data on immigration and nationality policies of countries worldwide.
The mission and focus of the committee is to provide a platform for lawyers practising immigration laws to receive input and update about the immigration laws of their country and also immigration laws and procedures of other jurisdictions. After addressing the issue of what falls within the concept of sexual harassment under Italian law, this article aims to analyse what means and legal protections are available to encourage employees to blow the whistle when they are victims of sexual harassment at work, as well as what improvements could be made in the future.
The International Commerce and Distribution Committee examines legal issues fundamental to the growth and development of international commerce.
The Committee deals extensively with issues relating to international sales contracts, agency and distribution, cross-border acquisitions, warranties and financing of international sales.
In addition to reviewing the current legal position in different countries from a comparative perspective, the committee also examines international and supranational instruments, such as the United Nations Convention on the International Sale of Goods, Incoterms and the Uniform Customs and Practice for Documentary Credits and relevant instruments of the European Union and Mercosur.
The Committee also focuses on law reform in the fields of law within its scope, and since 1997 has monitored and offered suggestions in connection with the proposed Hague Convention on International Jurisdiction and the Effects of Foreign judgments in Civil and Commercial Matters.
Both Iceland and Sweden have recently passed amendments to their sexual offence laws, reflecting the growing trend in Europe for ‘yes means yes’ legislation. The changes follow the rise of the #MeToo movement and global outcry over divisive cases that have highlighted the strength of public feeling as well as the limitations of current laws.
Legal actions and threatened legal actions are increasingly used against journalists and media organisations to attempt to silence their reporting and stop their work. SLAPPs (‘Strategic Lawsuits Against Public Participation’) are typically brought by powerful individuals or corporations with the intention of harassing, intimidating, and financially or psychologically exhausting opponents via improper use of the legal system, and evading scrutiny in the public interest.

Amid the ongoing Russia-Ukraine conflict, the International Bar Association (IBA) and the Ukrainian National Bar Association (UNBA) have partnered to host a series of online seminars. The first two will focus on defence (21 July) and international criminal law (28 July).
Globally, over the last two decades, more than 2000 journalists have been killed for reporting the news and bringing information to the public. Harassment, intimidation and attacks against journalists and the media has increased worldwide and is seeping into more “democratic” societies as rhetoric against the media has become more amplified and commonplace.
The cycle of harassment oftentimes begins online (and is disproportionately directed at female journalists), but more and more, it moves into the courtroom through judicial harassment aimed at silencing or bankrupting the journalist or media, and the ultimate increasing physical attacks and killings are occurring without accountability.

The Protection Against Harassment of Women at the Workplace Act 2010 is a seminal legislation in Pakistan, providing victims of workplace harassment with an opportunity to pursue legal recourse. However, the law is subject to some limitations: primarily a narrow definition of ‘workplace’ and ‘employee’ with a focus only on sexual harassment of women, limiting the effectiveness of the law in addressing all forms of harassment faced by any employee in different types of workplaces. In 2022, an amendment to the Act was introduced, expanding its scope, addressing the limitations of the initial Act and making justice for victims of workplace harassment more accessible. This article explores the original law’s merits and limitations in addition to the changes brought about by the amendment, thus highlighting the importance of strong legal protections against workplace harassment in Pakistan.

As regulators in various jurisdictions continue to grapple with how and whether alternative business structures for delivery of legal services should be permitted, one solution in three Canadian provinces and one US state (so far) has been a form of pilot project, or "Sandbox". A Sandbox provides a limited exemption from the ordinary prohibitions on non-lawyer ownership and delivery but is it a solution? Is private equity investment an option, even with guardrails?

In early April, the Lord Chief Justice of England and Wales, told the House of Lords Constitution Committee that judges should ‘not display behaviour which is unreasonably putting pressure on people.’
This followed earlier warnings he gave in February that ‘little tolerance’ would be shown towards judges who did not ‘behave with courtesy and respect for all who appear in our courts and tribunals’.

The ILO Convention C190 is the first international treaty to recognise the right of everyone to a world of work free from violence and harassment. The scope of C190 is, however, too wide and exceeds just labour or work scenarios which have led to few jurisdictions actually implementing it. This article will approach the scope and discussions around this important ILO regulation.
Claims filed against companies that are alleged, or whose boards are alleged, to have permitted an atmosphere in which sexual misconduct or harassment was tolerated or to have misrepresented the measures the companies had taken to prevent or respond to misconduct, are on the rise.
Also in the legal world, in our own working environment, we all have a responsibility to create a culture where bullying, harassment and discrimination doesn’t happen, and challenging it or reporting it if we see it happening.

The Committee addresses, among others, issues as diverse as sustainable development, biodiversity, air, water, groundwater and waste regulation, climate change, safety in the workplace, protection of endangered species, food safety, environment and trade.
In June, the UK Parliament’s Women and Equalities Committee published a report revealing how employers across numerous sectors have historically used non-disclosure agreements to cover up ‘unlawful discrimination and harassment’.
The furore surrounding NDAs and their role in silencing victims first arose in 2017 after it was alleged that film producer Harvey Weinstein had repeatedly used these agreements to prevent individuals from reporting allegations of sexual misconduct against him.
With the increase in awareness of environmental rights, climate change litigation is rapidly evolving with novel claims and theories being tested around the world. At the same time, judicial doctrine and decisions are creating challenges for both plaintiffs and defendants, including governments and industries. What can we expect from climate-related litigation against oil and gas companies moving forward? What is the role of Alternative Dispute Resolutions (ADR) under Oil & Gas related disputes?
