A review of Ghana’s role in interoperable payment systems integration in Africa, at the point that the country has joined the Pan-African Payment and Settlement System.

On 1 January, new financial legislation entered into force in Switzerland, bringing significant changes to the regulatory framework applicable to financial sector participants. In particular, the Federal Financial Services Act and its implementing ordinance impose new obligations on those endeavouring to market financial products and services in Switzerland.
In addition, how does the DMA compare with similar initiatives all around the world – does it entail an advantage or a disadvantage for the EU globally in the digital world? Is this something revolutionary or just a mere repetition of the issues that the telecommunications industry faced in the 1990s? The panel intends to explore all these questions and aims to provide a comprehensive overview of the situation.
32nd Annual IBA Communications and Competition Law Conference
The Rule of Law Forum, established in 2007, supports IBA members in advocating for the Rule of Law, as per the 2005 Prague Resolution. Originally the Rule of Law Action Group, the Forum operates within the Section on Public and Professional Interest (SPPI). Its purpose is to assist members in responding to the IBA Council's call to support the Rule of Law in their communities. The Forum's activities are led by Co-Chairs, with Vice-Chairs assisting them. The Forum does not have formal membership but maintains a circulation list. Liaison members from other IBA committees help integrate Rule of Law into their work.

Building upon the recent European Banking Authority report, the article offers insight into how to get the most out of the available or upcoming tools as an intermediate step to allow the sustainable securitisation market to develop to its full potential. It also glances through relevant Italian legislation and how it can be positively influenced by recent developments at the EU level.

The Covid-19 pandemic has delivered a shock to the world economy and underlined the importance of bankruptcy law in regulating our relationships if hard times strike. In the author's view, at the larger level, it is even more compellingly clear how we need to understand the legal systems in the world better so as to inform our policy choices for the future.

ESG issues are also gaining traction in other circles in the legal profession, notably alternative business structures. ESG frameworks evaluate business practices and performance but also measure risks and opportunities. The rise of the gig economy and legal tech are on the cusp of transforming legal services as we know it, yet without a proper regulatory framework, the legal profession might render services that go awry in various jurisdictions. Further, this will have a significant impact on young lawyers’ careers and future lawyers. The “Uberisation” of legal services has also brought with it a proliferation in the number of platforms that cater to the consumers’ needs in the legal industry. Biennial IBA African Regional Forum Conference: future-proofing the African legal profession
The North American Regional Forum (NARF) of the IBA unites legal professionals from the US, Canada, Mexico, and the Caribbean, providing a platform for collaboration on key business law issues like corporate, finance, trade, and litigation. NARF addresses regional concerns, including NAFTA, foreign investment, and cross-border security, while also tackling global challenges such as climate change and international trade. It promotes North American perspectives within IBA programs, ensuring representation on panels and committees. NARF also organises regional conferences, networking opportunities, and fosters communication among North American lawyers, strengthening business relationships within the legal community.

Digital therapeutics, in the form of software designed to treat disorders and diseases, are spreading at varying rates across countries worldwide. Applications include the treatment of conditions such as anxiety and depression, insomnia, obesity and diabetes. There are many benefits of these new technologies in terms of treatment efficacy, adherence and cost savings for national healthcare systems. However, their widespread use is often hampered by the lack of specific rules and procedures for market access, clinical and technological evaluation, approval and reimbursement by national health systems or private insurers. This article addresses these issues with particular reference to the European Union and Italian context.
Arizona, Utah and Puerto Rico have broken new ground by allowing limited non-lawyer ownership, but private equity hasn't waited for regulatory permission everywhere. Instead, investors are finding creative workarounds through management service organisations (MSOs). This session will examine how prevalent these structures have become, where regulators are drawing the line, and what it all means for US firms navigating a patchwork of global regulations.

On 16 January 2023 France’s National Financial Prosecutor’s office updated its guidelines on the implementation of corporate settlements, which were initially published jointly with the French Anti-Corruption Agency on 29 June 2019. On the following day, the US Department of Justice published a revised Corporate Enforcement and Voluntary Self Disclosure Policy.
Digital nomads are on the rise and in order to benefit from this new phenomenon, companies need to address the many associated challenges: employment law, visa issues, taxation, etc. The session aims to give useful insights from all of these view angles and to shed light on this somehow untangible phenomenon.

Following on from discussions held at the 5th Annual Conference of the IBA War Crimes Committee, we will hold a conversation with the Heads of the International, Impartial and Independent Mechanism (IIIM), Independent Investigative Mechanism for Myanmar (IIMM), and United Nations Investigative Team to Promote Accountability for Crimes Committed by Da’esh (UNITAD), to track progress in their operations, and to identify challenges and opportunities for this new generation of accountability mechanisms.
The European Regional Forum (ERF), established in 1989, has over 8,000 members. The forum is divided into four regions - Northern, Western, Central, and Southeastern - each led by a Chair and Vice-Chair. This article addresses Germany’s new State Treaty on the modernisation of media legislation (Medienstaatsvertrag or MStV). Special emphasis is given to the aims of new media regulation, in particular the regulation of media platforms, user interfaces and media intermediaries.
Risks linked to organisations’ dependencies and impacts on nature – from climate change, biodiversity loss and water scarcity to land degradation and disease – are increasingly recognised as material legal and financial risks. This keynote highlights these trends, future directions, and how the IBA’s new Nature-Intelligent Legal Services Toolkit helps lawyers to understand their clients’ exposure to nature-related risks and build nature considerations into their legal services.

With the pandemic hitting hard, online shopping has become the new normal. The pandemic accelerated the shift towards a more digital world and fuelled e-commerce growth, not just on a business-to-consumer basis but on a consumer-to-consumer basis as goods and services become more ‘fluid’ and transactions become less territorial. This article considers the hazards of using e-commerce platforms for various transactions.
The session will address this hot topic from several perspectives, including: the migration from the traditional to the digital media, challenges from an antitrust perspective, and many others related to the exploitation of sports rights. Also, it will address how sports events´ owners and producers are dealing with “active” fans who want to choose what, when and how to watch and how much the new players - Facebook, Amazon, Netflix, Google, Tik Tok, Kwai and other digital media – are willing to pay for sports content and how will their payback be.

In recent years, Australia has, similarly to the European Union and many other jurisdictions, shone a regulatory spotlight on the practices of digital platforms. This article looks at the steps Australia has taken – and is proposing to take – to regulate those platforms, including through the introduction of equivalent laws to the European Union’s Digital Markets Act (DMA) and Digital Services Act (DSA).
The Class Actions Committee serves as a platform for lawyers to discuss differing class action and collective redress regimes, monitor international developments, and debate key policy and rule of law issues. Class actions are becoming increasingly common, providing access to justice and holding corporations and authorities accountable.
Jurisdictions vary widely in their approaches, with some countries facing fundamental challenges. Global coordination in prosecuting and defending major cases is growing, with fostering collaboration and knowledge-sharing being vital. The Committee provides a forum for international lawyers to come together and discuss these differences, as well as network with other professionals within this space.

The Committee also comprises the Disability Rights Working Group, focused on disabled individuals' rights in the workplace. The Committee collaborates with the Employment and Industrial Relations Law Committee, the Immigration and Nationality Law Committee , and the Global Employment Institute.
