New York State is considering legislation that would implement the Covered Agreements on insurance regulation between the US and the EU and the UK, respectively (the Covered Agreements). However, the legislation does not contain the reciprocity language required by the Covered Agreements, apparently leaving this for regulation in the discretion of the New York Superintendent of Financial Services (the state’s insurance regulator). This may leave the legislation vulnerable to federal pre-emption.
While lawyers will adapt their working methods and use new technologies, they will continue to consider themselves as advocates of those who need them and as guardians of the rule of law as an overarching principle of freedom and democracy. This will not apply, on an algorithm, be it as intelligent as it may be. Bars should, therefore, actively participate in the regulation of AI being applied in the areas of advocacy. Acknowledging the increasing importance of AI in modern society, and the expected benefits when used at the service of the legal profession, key questions need to be discussed when drafting a new framework on AI.

The Forum for Barristers and Advocates represents Bar Associations whose members practice as independent referral practitioners in jurisdictions with a divided legal profession. Formed by Bar Leaders, the Forum advocates for the principles of independent advocacy within the IBA. The Forum addresses the importance of advocate and judiciary independence, ethical conduct, and training. The Forum supports human rights and collaborates with the Judges' Forum and other committees on litigation and trial topics. New York State’s anti-surrogacy statute passed in 1992 was, until recently, one of the most restrictive surrogacy laws in the United States. This article discusses the changes to the law.
This session will feature a roundtable discussion of experts who will recount on the most noticeable developments they have observed in 2023 affecting the legal profession. As regulators in various jurisdictions continue to grapple with how and whether alternative business structures for delivery of legal services should be permitted, one solution in three Canadian provinces and one US state (so far) has been a form of pilot project, or "Sandbox". A Sandbox provides a limited exemption from the ordinary prohibitions on non-lawyer ownership and delivery but is it a solution? Is private equity investment an option, even with guardrails? Do ethical rules serve to protect the guild or consumers? This panel will explore the business and regulatory aspects of North American and other experiments and how they might impact integration and engagement of firms internationally.

As part of the IBA presidential task force on artificial intelligence, the Bar Issues Commission is tasked with reviewing the impact on regulatory and ethical rules regarding lawyers.

Efforts to innovate and re-imagine the delivery of legal services have taken a new turn, one that includes permitting alternative business structures and professionals other than lawyers delivering legal services direct to consumers. In a growing number of jurisdictions, regulators and the organized bar have begun implementing limited, supervised testing of new methods of delivery via a policy tool called a regulatory sandbox.

The forum is divided into four regions - Northern, Western, Central, and Southeastern - each led by a Chair and Vice-Chair. We have five working parties - communications, D&I, ESG, mental wellbeing, and next-gen law - and we organise four conferences annually (automotive & mobility services, fashion & luxury law, ESG and start-up) in addition to many leading and participating in many smaller initiatives.

An overview of periods of limitation application to artworks transactions in France, Hungary, Italy and New York
Traditionally, law firms were owned and invested in by lawyers to ensure that the firm remained independent and unbiased. However, this meant firms were restricted to the amount the owners could afford to invest into it. Since the Legal Services Act came into force in 2007 in the UK, law firms are now able to operate as Alternative Business Structures (ABS). Most notably, ABS’s are eligible to receive funding from external sources and be managed by non-solicitors. They’re also able to provide several services under one brand name – including non-legal services. In recent discussions, we are discovering that mainly common law firms are thinking about the possibilities and opportunities given by ABS. But where are the civil law firms? May they lose market shares and clients in their own countries when foreign law firms from common law jurisdictions offer services under the ABS umbrella internationally? Do clients interpret ABS as a sign of unreliability, although there are already plenty of professionals working in traditional law firms that are not legally fully qualified yet, as, for example, paralegals? What about initiatives in the Common Market and International Trade Agreements that may be capable to change the professional lives of lawyers in civil law countries (and not only there…)? We will talk with lawyers, policy makers and legal tech providers from civil and common law jurisdictions, to understand where the legal profession stands today and how it will flow tomorrow in the international legal market on ABS.

Outokumpu Stainless USA, LLC (GE Energy), holding that non-signatories to an arbitration agreement can compel arbitration of agreements that are subject to the Convention on the Recognition and Enforcement of Foreign Arbitral Awards (New York Convention or simply ‘Convention’) by relying on traditional legal and equitable principles.

El International Bar Association’s Human Rights Institute (IBAHRI) condena la sentencia de cinco años de prisión dictada contra la jueza María Lourdes Afiuni el 21 de marzo de 2019, por el delito de corrupción propia. La jueza Afiuni ha visto sus más elementales derechos humanos transgredidos tras ser arrestada arbitrariamente en 2009 y haber estado detenida durante casi una década. Este último castigo, en ausencia de evidencia en su contra, supone una gran preocupación para el IBAHRI.
With no doubt the world has accelerated a number of significant changes affecting the way employees work. Work from home, cross-border remote work, hybrid on-and-off the office arrangements, need to conciliate with personal requests, are all just examples on how the world at work has changed. These changes also affect other significant issues such as how to give proper training, how to motivate employees, how to compensate employees, and how to monitor performance. These were all aspects to be discussed as part of this session.
