This session discussed the benefits of an Initial Public Listing and listing on a trading venue. Advantages can include: management retains ‘control’; it is more permanent than some other funding tools; it is advantageous for obtaining financing from banks; listed shares are a good ‘currency’ in M&A transactions where the shares can be offered in exchange; and/or employees can be incentivised by shares with a real ‘exit’ opportunity.
The session will explore how the rules and practice of international trade are evolving, as reflected in the expanded use of trade defence tools such as trade remedies, safeguards, unilateral tariffs and countermeasures, the return of managed trade arrangements and the reordering of global trading blocs. The session will be practical and forward-looking; it will focus on what lawyers need to know to help clients structure their supply chains and the extent to which domestic courts and international institutions like the WTO can offer meaningful recourse to protect parties’ interests in rules-based trade.

This article intends to briefly describe: how the Brazilian legislative framework regulates the incorporation of new pharmaceutical products into the Brazilian public healthcare system (Sistema Único de Saúde or SUS), commonly known as ‘reimbursement’ in other international jurisdictions; which public authorities are involved; what the ‘judicialisation’ phenomenon is; and the importance of strategic legal support throughout the process of incorporation.

Like many regulators around the world, the South African Competition Commission is increasingly turning to its power to conduct market inquiries as a measure to not only better understand the dynamics of markets that may be operating inefficiently, but also as a tool for ex ante regulation of market conduct without the rigour of a full-blown prosecution involving the adversarial testing of evidence. Especially in the case of novel and fast-moving markets in the new digital economy, a slew of market inquiries have culminated in pointed and interventionist ‘remedies’. A key procedural question is the extent to which remedies from a market inquiry are capable of direct enforcement on their face or whether the Commission’s powers are more muted, requiring sector-specific regulation within the four corners of enabling legislation, or follow-on prosecution by the Commission for prohibited conduct. Despite the perceived urgent need to regulate markets that move faster than prosecution in the ordinary course, and tempting analogies to be drawn with the constitutionally imbued powers of the Public Protector, the writers caution against a purposive interpretation that may trammel the rights of respondent companies in complex circumstances at least once removed from a vertical application of the Bill of Rights.

On 8 April 2020, the Prime Minister of Vietnam issued Decision No 14/2020/QÐ-TTg which replaced Decision No 04/2014/QÐ-TTg from January 2014 on regulating the coordination between the Vietnamese state bodies in international investment dispute settlement. US President Donald Trump’s bombing campaign against Iran, launched alongside Israel in February without the support of NATO allies, is a strategic gamble that appears to have been taken hastily and without clearly defined objectives. The war saw the assassination of Iran’s leader, the Ayatollah Ali Khamenei, on the first day of hostilities.
This session will explore the challenges that rightsholders may face in seeking remediation for business-related human rights harm, including power asymmetries, lack of meaningful participation, exclusion of context-sensitive approaches, limited community trust in companies, and limited enforcement of decisions through judicial, quasi-judicial and non-judicial processes. It will also explore how businesses seeking to comply with or apply international BHR laws and standards can work to mitigate some of these barriers, including how to reasonably defend against actions in line with these standards.
The session will delve into the role of lawyers, both in-house and external, in supporting businesses to take this type of approach, as well as the role of plaintiff lawyers in strategic litigation to help break down barriers and contribute to all parties acting in good faith in these types of proceedings.
IBA Annual Conference Copenhagen 2026
The Rule of Law Forum, established in 2007, supports IBA members in advocating for the Rule of Law, as per the 2005 Prague Resolution. Originally the Rule of Law Action Group, the Forum operates within the Section on Public and Professional Interest (SPPI). Its purpose is to assist members in responding to the IBA Council's call to support the Rule of Law in their communities. The Forum's activities are led by Co-Chairs, with Vice-Chairs assisting them. The Forum does not have formal membership but maintains a circulation list. Liaison members from other IBA committees help integrate Rule of Law into their work.
