4th Asia-based International Financial Law Conference
The Maritime and Transport Law Committee is one of the oldest and most established committees of the IBA, with more than 650 members worldwide.The Committee is a platform where leading maritime law professionals meet, create connections and discuss the most current legal issues in the field of maritime and transport law. The Central Bank of Brazil is preparing a significant reform of the country's foreign exchange regulation, which aims to simplify the current laws and regulation. The old rules, which are still in force, reflect the previous governmental concern about foreign exchange control and the impact on the daily operation and currency flows of the market. The intention behind the reform is to grant to foreign capital the same legal treatment offered to local capital under equivalent conditions.
Partners as leaders: understanding how to lead the lawyers of tomorrow
The Asset Management and Investment Funds Committee provides a convenient forum for its members to consider current developments in the global investment funds industry, including both regulatory and product development. It also produces newsletters and occasional e-bulletins for its members. In addition to its programmes at the annual IBA conferences, the committee presents an annual conference on Globalisation of Investment Funds normally held in June, which celebrated its 30th successful year in 2020. The United Kingdom is going it alone with a proposal for a digital services tax (DST), with the aim of increasing the tax tech giants such as Facebook and Google pay in the UK. The DST was confirmed by the Chancellor Philip Hammond in his Budget at the end of October.
In this session the panel will debate on how we have evolved from the old and by all desired total secrecy and the adage “Vivons heureux, vivons cachés” in private wealth matters, to a form of total transparency towards the (tax) authorities and banks. The 2020 Government Work Report of China delivered at the ‘two sessions’ makes clear reference to a ‘new infrastructure’ for the first time. On 4 October 2023 the European Regional Forum’s Young Lawyers Working Party held a webinar titled 'Partners as leaders: understanding how to lead the lawyers of tomorrow’. During the webinar, moderator Julia Hepner discussed with speakers Mark Longworth, Vanessa Byrne and Alexandra Martins, the subject of how young or current partners can unlock their own leadership skills to generate loyalty and create and develop strong and diverse teams and to retain talents. This article summarises the main takeaways.

On the other hand, could compensating whistleblowers undermine a company’s efforts to provide a “speak up culture” or risk leading to a surfeit of meritless or frivolous complaints? The European Regional Forum (ERF), established in 1989, has over 8,000 members. Facebook’s parent company Meta has been requested by the Italian tax authorities to pay EUR 870 million (USD 925 million) in unpaid VAT sales tax from 2015 to 2021. Based on information provided by an Italian newspaper, the Italian tax authorities seem to be arguing that Facebook membership is granted upon a consideration in kind.

In the competitive legal market, law firms invest substantial resources in marketing. However, many firms fail to prioritise the ultimate goal of these investments: converting leads into clients. A necessary key performance indicator (KPI) to measure marketing success is the number of leads generated, as leads represent potential business opportunities. However, while generating leads is crucial, success is ultimately determined by how effectively those leads turn into paying clients. Without conversion, marketing efforts become a sunk cost rather than a growth driver.

10th Biennial IBA Global Immigration Conference
The Taxes Committee encourages interface between international tax specialists and promotes the building of networks among tax lawyers worldwide to assist them in better serving the interests of their clients. The committee is divided informally into four practice group areas: Income Taxes, Other Taxes, Tax Litigation and Employee Benefits.
Members are encouraged to contribute to the committee newsletter which is published two to three times per year and to present papers at committee conferences and seminars. LEO satellite constellations have the potential to provide connectivity in geographic areas which are hard to reach with fixed and terrestrial mobile infrastructure and also to provide services in jurisdictions with limited infrastructure. However, the operators of satellite constellations potentially face numerous legal challenges before they could be seen as significant competitors to terrestrial telecommunications infrastructure providers. Satellite constellations are subject to complex spectrum allocation, filing and coordination proceedings at international level and, subsequently, also to national spectrum assignment proceedings in order to become operational and enter the market. National security and cyber security risks, as well as potential requirements to comply with existing telecommunications infrastructure regulation, are also issues to be considered by LEO satellite operators and service providers.

The Committee aims to provide its members, and the Division as a whole, with information about developments in insurance and reinsurance law and markets throughout the world as well as with specialist knowledge to assist in the efficient solution of practical insurance problems. The International Franchising Committee focuses on the law and business of international franchising. Committee interests include: competition law principles, cross-border sales and licensing issues, the business forms employed and trademark and intellectual property protections required to assure franchising success.
The Committee has served and continues to play an educational role for the legal profession, judiciary and legislators, and enables members to examine and comment upon legislative and regulatory proposals affecting international franchising. Through the committee's regular newsletter, International Franchising Committee members are kept up to date on legal developments, seminars and publications of interest around the world.
Over the last years, the convergence of financial services and technology industry has resulted in the emerging of new players, which have expanded their horizons all over the world. This
has been a great opportunity to open financial markets to new players and for traditional credit entities that were forced to adapt to FinTech in their line of business. Around the world, the legal response to this matter has been diverse, although we could still trace certain similarities.
In this panel, we will go through the legal framework that rules the FinTech industry in the different continents, analysing how governments have taken proactive and/or reactive regulatory approaches encompassing and/or decoupling banks, financial institutions, and technology businesses; particularly, regarding crypto assets, service/payment providers, digital wallets and open banking.

The Anti-Money Laundering and Sanctions Expert Subcommittee focuses on anti-money laundering requirements and financial and trade sanctions legislation, regulation and trends as they impacts lawyers. The Committee provide a forum to discuss and consider legislation impacting the practice of law, considering the ever-expanding multi-jurisdictional approach to lawyer regulation.
