This panel on decentralised finance discussed how blockchain-based finance works and how it may be treated for tax purposes for individuals in the respective jurisdictions of the panellists. IBA Middle East Conference: Law firms and in-house legal departments working together
Formed in 2005, the Senior Lawyers Committee represents senior lawyers and has received interest from younger IBA members eager to learn from their experience. The Committee aims to combat age discrimination, promote mentorship, and facilitate global networking. The Committee organises sessions and social events, often in collaboration with other IBA committees, focusing on how senior lawyers' expertise can benefit the profession. Recent topics include discrimination, career progression, and mentorship. Venture debt, a different funding alternative for startups, has positioned itself firmly in the venture business in the past few years, reaching high numbers in the US market by 2022, and more recently has begun to gain position in other markets, such as Latin America. This type of financing seems counterintuitive at first, since the logic behind loan financing has not aligned traditionally with the high-risk profile and low cash flows of startups. This has led to burdensome requirements for its founders, who have had to back up the loans personally, but the empirical data seems to point towards a significant use and growth of this type of financing. This article looks at how venture debt works and why it works.
The Antitrust Section provides an international forum for thought leadership with respect to antitrust law developments and the profession through submissions to competition agencies, training programs/missions, developing the law through our conferences, publications, and interaction with antitrust enforcement authorities and the profession.
In addition, there is a strong commitment to bring together international practitioners to facilitate closer working relationships. The Section is increasingly relied upon by government officials and members of the private sector for its expertise and practical input into antitrust developments, including through its Working Group submissions.

Aboard the International Space Station, scientific research is led by astronauts of different nationalities. This research prepares for space exploration missions but also brings benefits for humanity on Earth. It raises the question of which law applies to these kinds of experiments in general and clinical trials in particular, as well as the extent of intellectual property in space.
The War Crimes Committee works to promote justice around the world and uphold the principle of accountability. We focus on atrocity crimes, international criminal law, and practice. We provide a forum for practitioners and scholars, offering reliable resources and a network of contacts in this field. The committee supports international, ad hoc, and domestic war crimes tribunals and collaborates with the IBA Human Rights Institute to promote justice and accountability. We also have a working relationship with the International Committee of the Red Cross. The Committee aims include being a leading professional body for international criminal law, providing valuable resources, and inspiring young lawyers in this area.

In this article, the authors trace the history, evolution and latest developments of the antitrust laws’ application to labour markets in the United States. Then, they describe common types of claims in labour markets cases, before analysing recent criminal and civil wage-fixing, no poach, and merger challenges. The authors conclude by providing actions companies should consider taking, as they seek to avoid finding themselves as a defendant in an antitrust–labour markets case.
This session will look at the legal principles behind electronic bills of lading, how they work in practice and the impact of existing and proposed new legislation on this rapidly developing area of law.
IBA Maritime and Transport Law Committee Mid-Year Conference: The new world of shipping post-Covid
The Diversity and Equality Law Committee includes private practitioners, in-house attorneys, and academics working with corporate clients on issues like pay equity, anti-discrimination, and LGBTQ+ rights. Members come from leading law firms, corporations, and various perspectives. The Committee publishes an annual newsletter highlighting new developments and issues of interest. The Committee also comprises the Disability Rights Working Group, focused on disabled individuals' rights in the workplace. The Committee collaborates with the Employment and Industrial Relations Law Committee, the Immigration and Nationality Law Committee , and the Global Employment Institute.

Senate Minority Leader Chuck Schumer warned: ‘The President must not overstep his authority or indulge his autocratic tendencies for purposes not truly related to this public health crisis.’ In fact, if anything, the President has under-used the powers to address the health crisis.
India continues to be one of the fastest growing economies in the world. The vision of the Indian government to achieve the GDP target of USD5 trillion by 2025 has seen several reforms in the existing law, improving ease of doing business and key investments in strategic sectors. India has one of the most vibrant start-up markets, with a fast maturing PE/VC industry. Data and technology are key drivers and concerns for the stakeholders. Manufacturing in identified areas is a priority and several initiatives have been taken to achieve this. India recognises the need to be at the centre of world trade and is embarking on the ambitious path of concluding free trade agreements with several countries and blocks to ensure key goods, parts and technology are available to Indian entrepreneurs and consumers while allowing greater opportunities for its domestic industry and workforce to operate at a global level.

6th IBA Global Entrepreneurship Conference: The Netherlands – sailing the seas of global innovation
The Family Law Committee provides a unique forum for members from different countries and different legal systems to exchange views, meet during conferences and debate issues concerning the substantive and procedural aspects of family law. The work of the committee has focused on developments of international significance, involving all aspects of family law, for example, marriage, divorce, inheritance, human rights in the family, adoption, international child abduction, etc. There is a close interaction within the committee and its members through newsletters and via e-mail.
It also demonstrates a lack of the ability to articulate ideas and themes in the lawyer’s own words, basic communications skills needed at all professional levels. How should law firms and universities deal with this worrying new mindset and potentially unethical practice - do we need to be more accepting of such new approaches and, if not, how can we effectively control this rapidly escalating problem?

The main areas are patents, trade marks, copyright, trade secrets and unfair competition. Allied to these are a number of related areas including data protection, database protection, privacy, design rights, domain names and the like.
In the entertainment law area the key focus is on the creation, provision and delivery of content in relation to print, films, broadcasts, cable programmes, musical works and sound recordings. There is also involvement with media law including defamation and privacy and authors' rights in a more general sense.
This session looked at the motivations for partner moves; lateral hiring strategies; and how to ensure the lateral hire can benefit the firm, and more.
The Poverty and Social Development Committee, builds on years of work under various IBA auspices. We engage the legal profession to contribute to UN Sustainability Goal #1: Eradicating Poverty. Our committee advocates for using law to protect individuals and communities from poverty, promoting well-being. We believe legal professionals have a duty to create and apply law for good, preventing exploitation and mitigating harm. Planned projects include a podcast, a practical book for lawyers, a session at the IBA Annual Conference, and supporting NGOs focused on poverty eradication. We invite members to join our efforts.
Employee privacy rights at work, Neil Hodge, In-House Perspective March 2020
The Committee focuses on inheritance rights, will making, lifetime giving, trusts, creditor claims, regulatory compliance, charities, taxation, property rights, and conflict of law rules, considering both domestic and cross-border implications. Members benefit from enhanced knowledge, expertise in cross-border issues, global networking, and access to leading experts. The committee addresses international planning, comparative law, and topics like individual tax in cross-border contexts, trusts for planning, international successions, and asset protection. It frequently holds joint sessions with the Taxes committee and other IBA sections, offering a valuable resource for practitioners in private client work.
Even though Turkey’s Labour Law No 4857 does not regulate how employers track the working times of their employees in any detail, such tracking has become more important in view of the recent decision of the Court of Justice of the European Union (CJEU), stating that employers must set up an objective, reliable and accessible system that can track working times.

The African Regional Forum aims to enhance the value and significance of the International Bar Association (IBA) by addressing issues unique to African lawyers. Remote working has arrived as a result of the deep post-pandemic change in employees’ expectations, focused on achieving a better work–life balance, consequently alternative working arrangements had and still have a central role in the labour sector. In Argentina, and Latin America, a new trend that has come to stay is hybrid-style working, which implies a combination of in-person work and remote work. In order to implement this hybrid-style working format, human resources departments are currently using encouragement measures to entice employees back into the office.

10th Biennial IBA Global Immigration Conference
The Mediation Committee focuses on laws, practices and procedures relating to the mediation, conciliation, and negotiation of transnational disputes, as well as other alternative dispute resolution (ADR) processes. The committee seeks to advance the information available to the international legal community about such processes and techniques for implementing them; to contribute to the development of improved practices and ethical standards in the field; and to draw attention to legal developments and problems relating to mediation and ADR. This article considers the preliminary draft bill of the ‘Startup Law’ (Act 14/2013), which introduces the regulation of a new residence and visa authorisation covering third-country nationals working remotely from Spain for foreign companies.
On average we work for more than 50 years, and then retire. Is this model still fit for purpose in 2023 (if it ever was) or is it time to reassess priorities? After all, no one will remember you for working long hours. This session examines the four-day work week, whether it is part of an unstoppable movement to recalibrate our lives to get better work/life balance, its implications for diversity and inclusion and whether it is an option for all or only the privileged few.

But true internationalisation is more than just taking on occasional cross-border matters.

IBA Middle East Conference: Law firms and clients working together
The Rule of Law Forum, established in 2007, supports IBA members in advocating for the Rule of Law, as per the 2005 Prague Resolution. Originally the Rule of Law Action Group, the Forum operates within the Section on Public and Professional Interest (SPPI). Its purpose is to assist members in responding to the IBA Council's call to support the Rule of Law in their communities. The Forum's activities are led by Co-Chairs, with Vice-Chairs assisting them. The Forum does not have formal membership but maintains a circulation list. Liaison members from other IBA committees help integrate Rule of Law into their work.

The Leisure Industries Section started as the Travel Law Section and addressed the needs of travel law practitioners serving the travel industries. It grew to merge with the Tourism and Sports and Gaming sections expanding in its scope to provide a specialist network of professionals in the leisure industries.
The Section recognises that lawyers who work in the leisure industries often practice in one of the more traditional legal fields (aviation, property, finance, maritime, intellectual property, employment, litigation, conflict of laws, consumer law, insurance and trade law). The Section provides a focused forum on issues which emerge due to the greater amount of leisure time available and the increased internationalisation of sports and gaming.

Outside lawyers do most of their work on the deal pre-closing, but most of the clients’ value is generated post-closing. This panel of experienced in-house and outside counsel will deal with how to manage all phases with a view toward the integration – starting with the warranties, the pre-closing coordination and interim covenants, and then the actual integration post-closing.

The scope of the Committee’s work covers network, service and content-related developments across all delivery platforms. We will examine the impact of ESG in the workplace; in particular, how ESG can impact an employer’s policies and an employee’s freedom of expression and how those issues can subsequently be balanced.
Annual IBA Employment and Diversity Law Conference
The European Regional Forum (ERF), established in 1989, has over 8,000 members. The forum is divided into four regions - Northern, Western, Central, and Southeastern - each led by a Chair and Vice-Chair. We have five working parties - communications, D&I, ESG, mental wellbeing, and next-gen law - and we organise four conferences annually (automotive & mobility services, fashion & luxury law, ESG and start-up) in addition to many leading and participating in many smaller initiatives.
Our goals include: addressing the needs of professional organisations and individual members, increasing participation in the IBA, fostering cross-border collaboration among European lawyers and bars and supporting the Rule of Law and civil society. The ERF promotes professional development and networking opportunities through our many initiatives.
Financial institutions often retain consultants to investigate claims of harassment, data breaches, and other troubling events that could lead to liability to employees, customers, or consumers. In the event of litigation, opposing counsel often seek discovery of the fruits of these internal investigations, such as interview notes and confidential internal documents, to try to find damaging evidence.
With no doubt the world has accelerated a number of significant changes affecting the way employees work. Work from home, cross-border remote work, hybrid on-and-off the office arrangements, need to conciliate with personal requests, are all just examples on how the world at work has changed. These changes also affect other significant issues such as how to give proper training, how to motivate employees, how to compensate employees, and how to monitor performance.

In today's world a lawyer may face conflicting duties and the application of professional standards may be far from apparent. The Committee works closely with the IBA Standing Committee on Professional Ethics which is concerned with the maintenance and periodical reform of the International Code of Ethics.

The use of generative AI models, such as Midjourney, raises new and untested copyright issues. The World Intellectual Property Organization (WIPO) has identified numerous issues relating to copyright and AI, which warrant discussion. This article addresses a few of the issues in respect of establishing copyright protection in the UK for AI-generated works under section 9.3 of the Copyright, Designs and Patents Act.
The Women Lawyers’ Committee (WLC) aspires to empower its 3000 highly valued members from all over the world to engage, network and share knowledge. The committee was originally an interest group which was introduced as an IBA constituent in 1996 to allow efficient global networking of women lawyers.
WLC aims to level the playing field in the legal profession and inspire leaders to work to achieve gender parity. It's 20 committee officers create awareness tools to help the profession achieve this goal, while at the same time facilitate an efficient global network for women lawyers to connect and develop business and expertise, supported by its Advisory board.
