In this Global Insight interview, Martyn Day, co-founder of law firm Leigh Day, reflects on some of the most important cases he’s been involved in, including taking on the UK Ministry of Defence over allegations of British Army mistreatment of civilians and detainees – themes once again in the spotlight with news of SAS activity in Afghanistan.
Pricing, billing and collections are not seen as an attractive part
of the practice of law. Many lawyers, including many partners,
shy away from getting involved in the ‘business aspects’ of the
practice of law. However, financial hygiene, getting the pricing
right, getting the billing right and ensuring cash is collected, are
critical to the success of any law firm and are ultimately jobs that all
partners need to pay attention to. It is also important that law
firms put in place the right mechanisms to ensure the burden
on partners is not too great and/or using too much of their
time. Striking the balance whilst underscoring the importance of
financial hygiene is the topic of this session.
6th Asia Law Firm Management Roundtable: Is your firm 'fit for the future'?
Membership of the Forum is open to judges of all levels of court and seniority, whether exercising general or special jurisdiction, and including part-time retired judges. It is hoped that members of the IBA who have been active in its committees and constituents while in practice as lawyers will find in the Judges' Forum an additional means of maintaining their involvement after appointment or election to the Bench.
The activities of the Forum are normally concentrated on organisation of sessions at the Annual Conferences of the IBA. It has been the practice in recent years for those sessions to be co-sponsored with other IBA committees and constituents, dealing with subjects of mutual interest such as litigation, education, ethics and elimination of bias. The Forum also produces an ad hoc newsletter; contributions are encouraged.
The Covid-19 pandemic has caused governments the world over to implement schemes to avoid mass unemployment during periods of economic shutdown. Margaret Taylor assesses the programmes in place across a number of jurisdictions and the consequences as these schemes wind down.
The independence of lawyers and free exercise of the legal profession is under threat around the world. Lawyers are subject to attacks and violations of their rights in staggering numbers. This panel will examine relevant protections in place for lawyers, the gaps and failures in their enforcement, and how to make improvements moving forward. We’ll hear from lawyers who have been politically targeted, persecuted and arbitrarily detained as consequence of their legal representation or advocacy. Despite their higher frequency in tertiary education, women face great challenges in securing management positions. Numerous studies have reported how invisible barriers, such as unconscious bias, are responsible for perpetuating the workplace gender gap.
It has been said that there are basically three types of practice orientation: (1) the legal technical approach (2) the wise advisor (3) the lawyer with a high moral purpose as guided by the lawyers' conscience. It has been well recognised that the solution to the social challenges which intersect poverty such as migration climate change and wealth inequality must involve a lawyer’s commitment to a high moral imperative. This requires that that the lawyer approach legal problem-solving guided by such purpose.

The current era of technology and reachable-everywhere-and-anytime lawyers imposed its rules. The Taxes Committee encourages interface between international tax specialists and promotes the building of networks among tax lawyers worldwide to assist them in better serving the interests of their clients. 13th Annual IBA Real Estate Investments Conference

The Communications Law Committee is a leading global forum for legal practitioners with specialist expertise or interest in the communications sector. In March 2019, the English High Court ruled that the UK government’s Right to Rent scheme – which obliges landlords and agents to check the immigration status of their tenants – is incompatible with human rights. The ruling adds to the mounting pressure to scrap the scheme.
As the shortage of residential properties increases around the globe, inflation rates have affected interest rates of mortgage loans reducing even more the chance of purchasing real estate. The Indigenous Peoples Committee addresses development issues affecting land and people from the legal perspective of those impacted, rather than developers, governments, or businesses. The committee aims to enhance communication among lawyers worldwide on issues concerning indigenous peoples, and establish links with organisations like the UN Sub-Committee on Indigenous Peoples and the World Bank. The Committee plans to publish a regular newsletter and is seeking an editor, along with volunteers, particularly from outside Canada. To reduce travel costs, the committee will utilise e-communication to advance its projects, programs, and publications.
Navi Pillay, United Nations High Commissioner for Human Rights, was the interviewee for a wide-ranging IBA webcast and Q&A, broadcast on Friday 30 May 2014 as part of the IBA's webcast series.
A South African of Indian Tamil origin, Ms Pillay served as the first non-white female judge of the High Court of South Africa and President of the International Criminal Tribunal for Rwanda before taking up her post at the UN in 2008.
In 2022 many countries adopted ambitious and generous strategies to scale-up renewable energy capacity, through a combination of funding or offtake programs to rapidly build-out renewable power production or to expand domestic manufacturing capacity and supply chains and access to components and raw materials. The programmes were often taken to address energy price inflation and volatility or in response to perceived threats to national security due to armed conflicts and natural disasters. What were these legal regimes? What is the impact a year later? Have projects advanced towards energy justice (the goal of achieving equity in both the social and economic participation in the energy system)?

The African Regional Forum aims to enhance the value and significance of the International Bar Association (IBA) by addressing issues unique to African lawyers. In late March, the Guatemalan government introduced a Covid-19 alert app, called Alerta Guate. Privacy concerns mounted quickly. For example, the app’s privacy policy allows for user data to be held for up to ten years, far beyond the likely duration of the Covid-19 pandemic.
Construction disputes often include many low value claims (eg, low value variations which are disputed in principle and/or quantum). Addressing them like other claims risks disproportionate costs. What are the options for addressing such claims (eg, sampling)? The panel will produce a menu of options and debate their advantages and disadvantages.
8th Biennial Conference on Construction Projects from Conception to Completion
The Antitrust Section provides an international forum for thought leadership with respect to antitrust law developments and the profession through submissions to competition agencies, training programs/missions, developing the law through our conferences, publications, and interaction with antitrust enforcement authorities and the profession.
In addition, there is a strong commitment to bring together international practitioners to facilitate closer working relationships. The Section is increasingly relied upon by government officials and members of the private sector for its expertise and practical input into antitrust developments, including through its Working Group submissions.
The UK government is under pressure to pass legislation that would impose a time limit on immigration detention as several reports highlight serious failings in the country’s immigration system.
There is hardly a jurisdiction or region of the world that has not kicked into high gear enacting new regulation and enforcing old regulations for environmental protections, consumer rights, global trade, product safety, marketing, labor laws and human rights at a time when customers are dialing back their spending and capital is increasingly constrained.

The mission of the Committee is to address issues of particular interest to start ups, owner-managed, closely held and family businesses and their legal advisors, and to organisations with ambitions for growth. In a context of increasing global mobility and tax competition, several jurisdictions have introduced preferential regimes to attract high-net-worth individuals (HNWIs), digital nomads, and internationally mobile professionals. At the same time, the debate around a global minimum wealth tax, particularly targeting ultra-high net worth individuals (UHNWIs), has gained momentum in international fora.
The Forum for Barristers and Advocates represents Bar Associations whose members practice as independent referral practitioners in jurisdictions with a divided legal profession. Formed by Bar Leaders, the Forum advocates for the principles of independent advocacy within the IBA. The Forum addresses the importance of advocate and judiciary independence, ethical conduct, and training. The Forum supports human rights and collaborates with the Judges' Forum and other committees on litigation and trial topics. The Forum’s inaugural members include Bar Associations from England and Wales, Scotland, Ireland, South Africa, Australia, and Hong Kong, representing over 16,000 barristers and advocates. Membership is open to bar associations which are full or supporting members of the IBA, and to individual members of any Divisions.
The adoption of a business-as-usual approach by immigration courts in the United States has worsened the health crisis facing the American public.
This session will explore utilisation of the capital markets as an alternative funding vehicle for high growth companies. Our panel will provide insights from Euronext, issuers and bankers on the various listing venues available, trends and opportunities.
Given some of the challenges for high growth companies in accessing finance, our panel will discuss the opportunities offered via the capital markets as a growth tool.

The Maritime and Transport Law Committee is one of the oldest and most established committees of the IBA, with more than 650 members worldwide.The Committee is a platform where leading maritime law professionals meet, create connections and discuss the most current legal issues in the field of maritime and transport law. The Committee arranges a number of sessions on developments in maritime and transport law at the annual conferences of the IBA. Frequent half-year seminars are held in the world’s maritime centres, and the Committee is also active in cooperating with other organisations in the maritime law area such as Comite Maritime International, International Maritime Organisation Legal Council, and maritime law societies in jurisdictions around the world.
When the Covid-19 pandemic closed in on the United States, instead of closing down, the US immigration courts adopted a business-as-usual approach. This has furthered the health crisis facing the American public.
The negotiation process will provide an opportunity for national bars around the world to engage with their governments to advocate positions on the details, scope and remedies.
IBA Annual Conference Toronto 2025
The Diversity and Equality Law Committee includes private practitioners, in-house attorneys, and academics working with corporate clients on issues like pay equity, anti-discrimination, and LGBTQ+ rights. Members come from leading law firms, corporations, and various perspectives. The Committee publishes an annual newsletter highlighting new developments and issues of interest. The Committee also comprises the Disability Rights Working Group, focused on disabled individuals' rights in the workplace. The Committee collaborates with the Employment and Industrial Relations Law Committee, the Immigration and Nationality Law Committee , and the Global Employment Institute.
This note addresses principles, practices and pitfalls in respect to preliminary interim measures, that is, temporary decisions in the nature of ex parte preliminary orders taken before hearing the affected party (and sometimes without notice). Overall, the popular phrase ‘pushing the envelope’ provides a metaphorical template for considering whether ex parte preliminary orders ‘attempt to extend the current limits of performance’ or simply ‘go beyond commonly accepted boundaries’.
While their LPs expect returns to be materialized and new capital to be deployed, PE funds are currently struggling with limited and expensive sources of debt financing and gaps in expected valuations.

The International Commerce and Distribution Committee examines legal issues fundamental to the growth and development of international commerce.
The Committee deals extensively with issues relating to international sales contracts, agency and distribution, cross-border acquisitions, warranties and financing of international sales.
In addition to reviewing the current legal position in different countries from a comparative perspective, the committee also examines international and supranational instruments, such as the United Nations Convention on the International Sale of Goods, Incoterms and the Uniform Customs and Practice for Documentary Credits and relevant instruments of the European Union and Mercosur.
The Committee also focuses on law reform in the fields of law within its scope, and since 1997 has monitored and offered suggestions in connection with the proposed Hague Convention on International Jurisdiction and the Effects of Foreign judgments in Civil and Commercial Matters.
