IBA Global Insight April/May 2016 - The ‘dumping’ of cheap steel from China into global markets continues to cause economic damage. With the Chinese government struggling to address steel overcapacity amid domestic tensions, other nations must take action.
This panel will cut through the complexity at the intersection of sport-specific legislation and corporate insolvency legislation, and discuss the unique balance required to align sport specific rules within the broader insolvency framework governing insolvent corporations. While highlighting the distinct landscape of football club restructuring, the panel will also discuss creative strategies that might be implemented to successfully restructure a football club.

Game On: How the Right of Publicity, Legalised Gambling and Fair Pay to Play Laws Are Changing US Professional and Amateur Sports
Increasingly, sports organisations are relying on specialised dispute resolution bodies to decide sports-related disputes. From the ad hoc tribunals at the Olympic Games and the FIFA World Cup that hear eligibility and doping disputes in real time, to the specialised sports tribunals located around the world, these sports arbitral institutions aim to resolve sports-related disputes as efficiently as possible. This session will shed light on how sports-related disputes are resolved, looking at the common features shared by sports tribunals (compared to internal dispute resolution bodies of sports federations), including as regards their independence and decision-making process.

The Leisure Industries Section started as the Travel Law Section and addressed the needs of travel law practitioners serving the travel industries. It grew to merge with the Tourism and Sports and Gaming sections expanding in its scope to provide a specialist network of professionals in the leisure industries.
The Section recognises that lawyers who work in the leisure industries often practice in one of the more traditional legal fields (aviation, property, finance, maritime, intellectual property, employment, litigation, conflict of laws, consumer law, insurance and trade law). The Section provides a focused forum on issues which emerge due to the greater amount of leisure time available and the increased internationalisation of sports and gaming.

An engaging and dynamic panel took place at this year’s Annual Conference, titled ‘How to score in football’s World Cup host countries’. The session was organised jointly by all six IBA regional fora: African, Arab, Asia Pacific, European, Latin American and North American. This produced a rare and enriching collaboration among the Association’s global divisions.

Football 256 purported to carry out an awards ceremony via their social media channels – ‘Football 256 Best of the Season Awards’ – for the recently concluded 2020-2021 StarTimes Uganda Premier League. In response, the Federation of Uganda Football Associations (FUFA) threatened legal action against Football 256, the football clubs, club officials and players.
Anxieties regarding health and fitness related issues have mostly proved unfounded - the success of the event/mini tournament is a testament to the commitment, languages, enthusiasm, endeavours and differing playing styles of those who have in recent years graced the stadia of Buenos Aires, Madrid, Dublin, Vienna, Washington, Sydney, and Seoul. Pretty it may not be and careers as professional footballers a complete historical fantasy, but our annual event generates huge interest, passion and most importantly friendship between all the players and many spectators who come to cheer us on.

The Women Lawyers’ Committee (WLC) aspires to empower its 3000 highly valued members from all over the world to engage, network and share knowledge. The committee was originally an interest group which was introduced as an IBA constituent in 1996 to allow efficient global networking of women lawyers.
WLC aims to level the playing field in the legal profession and inspire leaders to work to achieve gender parity. It's 20 committee officers create awareness tools to help the profession achieve this goal, while at the same time facilitate an efficient global network for women lawyers to connect and develop business and expertise, supported by its Advisory board.

IBA Annual Conference Toronto 2025
The Taxes Committee encourages interface between international tax specialists and promotes the building of networks among tax lawyers worldwide to assist them in better serving the interests of their clients. The committee is divided informally into four practice group areas: Income Taxes, Other Taxes, Tax Litigation and Employee Benefits.
Members are encouraged to contribute to the committee newsletter which is published two to three times per year and to present papers at committee conferences and seminars. In October 2020, SK hynix announced it would acquire Intel’s NAND memory and storage business to enhance the competitiveness of its NAND flash solutions. The deal would make SK hynix second only to Samsung among the world’s largest NAND memory makers. A number of competition authorities reviewed the deal. In May 2021, the European Commission and Korea’s antitrust agency cleared the deal without any issues. The UK’s Competition and Markets Authority followed suit and found that there would be ‘strong remaining competitors’ who had their own plans to ‘expand their capacity’. The Committee on Foreign Investment in the United States (CFIUS) also weighed in with approval. China was the final antitrust hurdle. As with many other semiconductor reviews before it, the State Administration for Market Regulation (SAMR) approved the SK hynix/Intel deal a year later but imposed a range of behavioural conditions to address competition concerns (not identified elsewhere) and security of supply.

The African Continental Free Trade Area agreement (AfCFTA) is one of the most ambitious and progressive trade agreements concluded in recent years. Proper implementation is key to its success, however. One notable obstacle to the agreement is the fragmented trade and regulatory landscape against which it has been negotiated. Member states of AfCFTA are party to a plethora of regional trade agreements and economic communities with differing approaches and degrees of integration, which creates a risk of inconsistency, increased compliance costs and inefficiencies for member states and businesses alike. This article explores how Article 19 of AfCFTA tackles this fragmentation by providing a mechanism for harmonisation while preserving higher levels of regional integration

The Indigenous Peoples Committee addresses development issues affecting land and people from the legal perspective of those impacted, rather than developers, governments, or businesses. The committee aims to enhance communication among lawyers worldwide on issues concerning indigenous peoples, and establish links with organisations like the UN Sub-Committee on Indigenous Peoples and the World Bank. The Committee plans to publish a regular newsletter and is seeking an editor, along with volunteers, particularly from outside Canada. To reduce travel costs, the committee will utilise e-communication to advance its projects, programs, and publications.

As President of the International Bar Association, Horacio Bernardes Neto has ratified the IBA Climate Crisis Statement. In a message to IBA members, Mr Neto outlined the IBA’s responsibilities as the global voice of the legal profession, stating, ‘I believe the legal profession must be prepared to play a leading role in maintaining and strengthening the rule of law, and supporting responsible enlightened governance in an era marked by climate crisis’.

For good or ill, football has become a significant part of our culture and who we are. As a result, national or regional governments show a desire to lend a helping hand to teams in their environments. This often takes place as a way of attracting foreign investors, who are enticed by the possibility of owning a football team playing in the world’s most prestigious football leagues.
Every year, millions of hours of legal and professional services are donated to serve indigent clients. Measuring the impact of these hours may result in better data around client impact trends, provide better value to pro bono stakeholders by assisting law firms in better understanding and tailoring the resourcing of their programmes – and it may add value to the broader access to justice ecosystem.

With members from over 50 countries - including experts in museums, galleries, auction houses, and cultural heritage protection - the Committee fosters communication among legal professionals on all matters involving Art and Cultural Property Law. Our goal is to establish a worldwide network of Art and Cultural Property lawyers with information and discussion links to relevant NGOs, institutes of art law, and governmental organisations.

The IBA Business Human Rights Committee and the IBA Legal Policy & Research Unit have announced free, in-person training sessions on business and human rights for in-house lawyers and corporate counsel on business and human rights.
The IBA Arbitration Committee has embarked upon a project to review privilege laws and practices around the world, with a view to discussing whether they can be harmonised so as to develop international standards for applying privilege in international arbitration.

The mission of the Committee is to address issues of particular interest to start ups, owner-managed, closely held and family businesses and their legal advisors, and to organisations with ambitions for growth. The Committee's aim is to provide a focus for the different needs of ownership, management and financing of such organisations. Particular focus is placed on: management and ownership issues, finance and the raising of tier one and two capital, shareholder issues and agreements, business succession plans, exit planning, relationships with outside investors, protection of minority interests, dispute monitoring and resolution, the role of professionals in management and advisory roles and relevant issues arising from tax, employment, real estate, estate planning and family law.

For months, Saudi columnists agreed that a bid by their country’s sovereign wealth fund, the Saudi Public Investment Fund (PIF), to buy Newcastle United, an English Premier League football team, was a big win, a safe investment, a visionary decision by ‘the leadership’. For the Saudi media, their initial confidence came to a halt in late July when PIF lost patience waiting for the Premier League to complete its vetting process and withdrew the offer.
This panel will explore how the acquisition and holding of professional sports franchises may be structured in various jurisdictions in both the domestic and cross-border ownership contexts. Unique tax and audit challenges as well as the manner in which different jurisdictions address the risks associated with multi-jurisdictional investment structures will also be discussed.

In the past, businesses preferred to remain apolitical – to not be involved or active – in supporting or promoting any particular religious, social or political initiatives or causes. Today, more and more businesses are actively taking and promoting positions on such matters as part of their corporate culture and encouraging (and in some cases requiring) employees to follow suit. This is increasingly resulting in conflict where employees argue that their personal rights are being infringed at the expense of corporate culture.

The Immigration and Nationality Law Committee is concerned with all aspects of immigration and nationality law on a worldwide basis, including business-related immigration, family reunion policies, refugees and compassionate cases.
The Committee aims to provide a forum for the discussion of comparative data on immigration and nationality policies of countries worldwide.
The mission and focus of the committee is to provide a platform for lawyers practising immigration laws to receive input and update about the immigration laws of their country and also immigration laws and procedures of other jurisdictions. We achieve this by holding annual conferences and presentation of papers, newsletters and providing other online resources to enhance the knowledge of its member in multiple jurisdictions.
